Child Support Lien in Wisconsin: Docket, Payoff, and Release

A child support lien in Wisconsin is an automatic legal claim the state attaches to everything a delinquent parent owns once their overdue support is entered on the statewide child support lien docket. Under Wis. Stat. § 49.854, that claim runs to real estate, vehicles, bank accounts, and other property, and it blocks any sale or transfer until the debt is settled.1Wisconsin State Legislature. When the Lien Attaches

The lien takes effect the moment the parent’s information is entered on the statewide support lien docket and that docket is delivered to the register of deeds in the county where the property is located.1Wisconsin State Legislature. Wisconsin Statutes 49.854 – Liens Against Property for Delinquent Support Payments No court order is needed at that step; the statute does the work.

The Department of Children and Families then mails the parent a notice stating that the lien exists, the amount owed, and the right to challenge it. From that notice, two deadlines run. A parent can file a written request for a financial records and court order review within 10 business days, or skip that step and request a direct court hearing within 20 business days.1Wisconsin State Legislature. Wisconsin Statutes 49.854 – Liens Against Property for Delinquent Support Payments A parent who goes through the records review first and disagrees with the result still has 5 business days afterward to request a court hearing. Miss the deadlines and the lien stands.

A lien lasts 5 years from the date it was docketed. Even after full payment, the satisfied entry stays visible on the docket for another six months before it disappears.3Wisconsin Department of Children and Families. Wisconsin’s Child Support Lien Docket Handbook

What Property the Lien Covers

The statutory definition of property is broad. It includes real property, tangible and intangible personal property, financial accounts, and rights to property existing at the time of levy.1Wisconsin State Legislature. Wisconsin Statutes 49.854 – Liens Against Property for Delinquent Support Payments In concrete terms:

  • Any land, house, or commercial building the parent owns in Wisconsin.
  • Vehicles, trucks, boats, and other items requiring a state certificate of title. When a lien exists, the vehicle title itself notes it.3Wisconsin Department of Children and Families. Wisconsin’s Child Support Lien Docket Handbook
  • Checking, savings, and other accounts at financial institutions, which the department can instruct the institution to freeze up to the amount owed.1Wisconsin State Legislature. Wisconsin Statutes 49.854 – Liens Against Property for Delinquent Support Payments
  • Money owed to the parent from lawsuit judgments or settlements, which the department can intercept under Wis. Stat. § 49.856, and one-time pension lump sums under Wis. Stat. § 49.852.

One meaningful limit: the lien is not effective against a good-faith buyer of titled personal property unless the lien was already recorded on the title.1Wisconsin State Legislature. Wisconsin Statutes 49.854 – Liens Against Property for Delinquent Support Payments Someone who buys a car without knowledge of the lien, and without it appearing on the title, is protected. Real estate buyers get no such carve-out, because the docket goes directly to the county register of deeds.

What Else Can Happen as Arrears Grow

The lien by itself just sits on the property. The harder enforcement tools kick in as the balance climbs, each with its own threshold.

Before any of these actions, the agency mails written notice to the parent’s address on file. A hearing is available, but it is limited to whether the debt amount is correct, not whether the enforcement action is fair.6Wisconsin Department of Children and Families. Federal Tax Refund Intercept

The federal Tax Refund Offset Program lets the state grab a delinquent parent’s IRS refund. If the custodial parent receives Temporary Assistance for Needy Families benefits, the minimum arrears to trigger an offset is $150; otherwise it is $500.7Administration for Children and Families. When Is a Child Support Case Eligible for the Federal Tax Refund Offset Program The offset usually arrives with no fresh warning beyond the original lien notice.

Passport Denial and Revocation

Federal law bars the State Department from issuing a passport to anyone who owes more than $2,500 in child support, and it permits revocation of an existing passport.8Office of the Law Revision Counsel. 42 USC 652 – Duties of Secretary Even once the debt is paid, reissuance takes a minimum of two to three weeks while the agencies verify payment and remove the parent’s name.9U.S. Department of State. Passports and Child Support Debt A revoked passport cannot be used for travel after the debt is cleared; the parent must wait for a new one. A parent caught overseas with a revoked passport may receive only a limited-validity passport for direct return to the United States.

Interest on the Balance

Wisconsin charges simple interest at 1% per month on arrears that equal or exceed one month’s worth of court-ordered support. Once the current support obligation ends (for example, the child ages out), interest accrues on the entire remaining balance regardless of size.10Wisconsin State Legislature. Wisconsin Statutes 767.511 – Interest on Arrearage That works out to 12% a year. On a $10,000 arrearage, interest alone adds $1,200 each year. The rule covers child support, family support, maintenance, and medical and birth expenses.1Wisconsin State Legislature. How to Check the Docket

The Wisconsin Child Support Lien Docket is publicly searchable online. You can search by name, using at least the first three characters of the last name, or by lien docket number from a prior search. Only the last four digits of a Social Security number appear in results.11Wisconsin Child Support Lien Docket. Wisconsin Child Support Lien Docket Name checks run any time, but detailed data like lien amounts and end dates is only available during posted business hours. Title examiners, insurers, and closing agents routinely search the docket before any real estate or high-value asset transfer, because an active entry means the owner cannot deliver clear title.

Paying Off a Lien

The first step is to contact the county child support agency with authority over the case and request a payoff letter. That letter states the exact amount needed to satisfy the lien, including accrued interest. All payments go through the Wisconsin Support Collections Trust Fund. Paying the other parent directly does not count and will not clear the lien.12Wisconsin Department of Children and Families. Ways to Pay Support

Payment form matters. For regular ongoing support, online payments by credit card, debit card, or bank transfer are fine. For lien satisfaction, the handbook requires a money order, cashier’s check, attorney trust account check, or title company or escrow check. Personal checks are not accepted. Payment is mailed to the Wisconsin Support Collections Trust Fund at PO Box 070799, Milwaukee, WI 53207-0799. The full amount in the payoff letter must be received and processed within 30 days of the letter’s date, or a new payoff letter will be needed.3Wisconsin Department of Children and Families. Build in processing time. Online credit or debit card payments can take up to 5 business days plus another 7 calendar days. Bank account transfers may take up to 10 business days to reach the Trust Fund.12Wisconsin Department of Children and Families. Ways to Pay Support If you are working against a closing date, those windows matter.

Clearing Title After the Debt Is Paid

Payment and release are two different steps. Once the lien is fully paid, the county agency marks it satisfied on the docket, and then the paperwork to clear your property depends on what you own.

For real estate, the agency issues a Release of Lien Real Property document. The closing agent is responsible for filing that release with the county Register of Deeds to clear title.3Wisconsin Department of Children and Families. Wisconsin’s Child Support Lien Docket Handbook If you are selling to clear the lien, loop your closing agent in early so the payoff and the release can be coordinated with the sale proceeds.

For vehicles and other titled personal property, the release goes through the Department of Transportation. You submit the release of lien form along with your current title to the DOT by mail or at a DMV Customer Service Center. A $5 counter fee applies in person.3Wisconsin Department of Children and Families. Wisconsin’s Child Support Lien Docket Handbook

If you are not clearing a specific property and simply want to pay off the debt, the agency issues a Satisfaction of Lien letter confirming full payment. That document is for your records; it is not filed with the Register of Deeds. Either way, the satisfied entry stays visible on the docket for six months after payoff before dropping off.

Partial Release for a Single Property

If you need to sell one property but cannot pay the entire balance, you can ask the county child support agency for a release of lien tied to that property alone. The agency will want a written request explaining the reason, a proposed closing statement, a property tax assessment or recent appraisal, a title report, and the amount of sale proceeds you propose to put toward the lien.3Wisconsin Department of Children and Families. Wisconsin’s Child Support Lien Docket Handbook The decision is discretionary. There is no guarantee, especially when the offered payment is small compared to the total. When the sale generates real equity for the debt, agencies often cooperate, because partial payment beats waiting.
