Civil contempt of court in California can cost you up to $1,000 and five days in jail for each separate violation of a court order, and if the thing you failed to do is still within your power, a judge can keep you locked up until you do it. Because California treats every contempt case as quasi-criminal regardless of the underlying lawsuit, you also get the protections of a criminal defendant: the right to counsel, the right to remain silent, and the right to make the other side prove each element beyond a reasonable doubt.
What the Other Side Has to Prove
A contempt finding requires three elements, and the party bringing the action carries the burden on all of them.
First, a valid court order has to exist, and it has to be clear enough that a reasonable person would know what compliance looks like. Vague or ambiguous orders are hard to enforce through contempt because you can argue you didn’t know what the order actually required of you.
Second, you must have known about the order. Personal service is the clean way to show this, but presence in court when the order was announced also counts, as do other circumstances showing you were aware.
Third, your disobedience must have been willful. A genuine inability to comply, despite reasonable efforts, is not willful disobedience. The court is asking whether your noncompliance was a choice.
The standard of proof is the one that catches people off guard. California’s Court of Appeal has held that “a contempt proceeding, even though arising in a civil action, is quasi criminal in nature and the respondent therein is to be accorded all of the constitutional and procedural safeguards of any criminal proceeding.”1Justia Law. Martin v. Superior Court For punitive sanctions, that means proof beyond a reasonable doubt, not the preponderance standard used in ordinary civil disputes.2Justia Law. In re Cassil (1995)
The Child Support Shortcut
One important exception shifts some of the proof burden. Under Code of Civil Procedure section 1209.5, if the person seeking enforcement shows that a child support order was made, filed, and served on the parent (or that the parent was in court when it was announced) and that the parent did not comply, that combination is treated as prima facie evidence of contempt. The parent then has to explain why they failed to pay rather than the other side having to build willfulness from scratch.3California Legislative Information. What You Actually Face
California imposes contempt penalties through two separate mechanisms that can operate in the same case.
Punitive Sanctions: Up to $1,000 and Five Days Per Count
Under section 1218(a), a person found guilty of contempt faces a fine of up to $1,000 payable to the court, imprisonment of up to five days, or both, for each count. Each separate violation of a court order can be charged as its own count, so repeated noncompliance stacks fast. The court can also order you to pay the reasonable attorney fees and costs the other side spent bringing the contempt action.4California Legislative Information. California Code of Civil Procedure 1218
Coercive Jail: Until You Comply
Section 1219 covers the situation where the contempt is a failure to do something you still have the power to do. There, the court can imprison you until you perform the act, which must be identified in the commitment order.5California Legislative Information. California Code of Civil Procedure 1219 Unlike the five-day cap on punitive confinement, coercive confinement has no fixed time limit. You hold the keys: the moment you comply, the confinement ends.
Family Law’s Escalating Penalties
When the violated order is a family law order, section 1218(c) imposes a mandatory escalator on top of the general penalties:
- First finding: community service of up to 120 hours, or imprisonment of up to 120 hours, per count.
- Second finding: community service of up to 120 hours in addition to imprisonment of up to 120 hours per count.
- Third or subsequent finding: imprisonment of up to 240 hours and community service of up to 240 hours per count, plus an administrative fee for community service supervision.
The court must consider the parties’ work schedules when ordering community service or jail. As an alternative, the court can grant probation or a conditional sentence: up to one year for a first finding, two years for a second, and three years for a third or later finding.4California Legislative Information. California Code of Civil Procedure 1218
There is a side consequence many people miss. A party held in contempt of a dissolution, domestic partnership, or legal separation order loses the ability to enforce that same order against the other party through execution or other means. The restriction does not apply to child or spousal support orders.4California Legislative Information. California Code of Civil Procedure 1218
How the Case Unfolds
The procedure depends on where the contempt happened.
If contempt occurs in the immediate view and presence of the court or a judge in chambers, the judge can punish it on the spot by issuing an order reciting what happened and imposing the penalty. No separate hearing, no advance notice.6California Legislative Information. California Code of Civil Procedure 1211 This is rare in civil matters.
Almost all civil contempt is indirect, meaning the disobedience happened outside the courtroom: a missed support payment, an ignored property transfer, a violated custody schedule. The process starts when someone presents an affidavit to the court describing the facts.6California Legislative Information. California Code of Civil Procedure 1211 The court issues an order to show cause requiring you to appear and explain why you should not be held in contempt.
Family law cases use standardized Judicial Council forms. Form FL-410 (Order to Show Cause and Affidavit for Contempt) satisfies the affidavit requirement. It must be accompanied by an Affidavit of Facts: FL-411 for financial matters, or FL-412 for domestic violence, custody, and visitation issues. The affidavit has to identify the order that was violated, when it was issued, how it was violated, and when the violation happened.7Judicial Branch of California. Contempt Procedures Handout
The hearing itself is a formal proceeding with testimony, evidence, and cross-examination. The party alleging contempt goes first and must prove every element. You then present your defense, call witnesses, and challenge the evidence against you.
If you ignore the order to show cause or skip the hearing, the court can deem all the allegations admitted and treat them as true. Doing nothing is the worst available strategy.
Your Rights in the Proceeding
The quasi-criminal classification gives you the same core protections a criminal defendant has.1Justia Law. Martin v. Superior Court
You have a constitutional right to retained or appointed counsel. If you appear without a lawyer, the court must advise you of this right and ask whether you want representation. If you want to hire counsel or apply for a public defender, the court should postpone the proceeding to allow time to do so. Counsel must be appointed before arraignment.7Judicial Branch of California. Contempt Procedures Handout
You also cannot be compelled to testify against yourself, you have the right to confront and cross-examine witnesses, and punitive sanctions require proof beyond a reasonable doubt.2Justia Law. In re Cassil (1995)
Defenses That Work
Inability to comply. This is the strongest defense in financial contempt cases. If you could not pay or could not transfer the asset because you lacked the resources despite reasonable efforts, the court cannot hold you in contempt for something that was impossible. You carry the burden on this defense, and you need specifics. Vague claims of being broke will not do it. Come prepared with bank statements, pay stubs, evidence of job searches, and documentation of your expenses and debts. Courts look skeptically at claimed poverty unsupported by paper.
Ambiguous order. If the order was genuinely unclear about what it required, that ambiguity cuts in your favor. You cannot willfully disobey an order you could not reasonably understand. This works best where the language is open to more than one reasonable reading, not where you simply didn’t read it closely.
Lack of knowledge. If you were never properly served and had no actual knowledge of the order, you cannot be held in contempt. Defective service or gaps in the record about how the order was communicated can support this.
Good faith is not a defense. One point surprises people. A good faith effort will not by itself prevent a contempt finding when the violation is established. The U.S. Supreme Court held in McComb v. Jacksonville Paper Co. that because civil contempt is remedial, the intent behind the violation does not matter: an act does not stop being a violation because it was done innocently. The question is whether the violation happened, not whether you meant well.
Challenging a Contempt Finding
Section 1222 declares contempt judgments and orders “final and conclusive,” which means a contempt order is not directly appealable through the ordinary appellate process.8California Legislative Information. California Code of Civil Procedure 1222 The proper remedy is a petition for a writ of review, such as habeas corpus or prohibition, filed with a higher court to challenge the lawfulness of the underlying order or the contempt finding itself.
Section 1209 provides an automatic stay for a narrow group. If an attorney, their agent, or investigator is held in contempt for conduct related to preparing or conducting a case, execution of the sentence is stayed while they file a petition for extraordinary relief within three judicial days. The same protection applies to public safety employees held in contempt for failing to comply with a subpoena while acting within the scope of their employment.9California Legislative Information. California Code of Civil Procedure 1209
A motion to discharge the contempt is another option. A motion to modify the underlying order may fix the problem going forward, but it does not erase a contempt finding already made. Whatever route you take, move quickly and through the correct channel. Ignoring a contempt order while you think about your options is how short sentences become long ones.
