Clay County Sales Tax: $5,000 Cap, Holidays, and Use Tax

The sales tax rate in Clay County, Florida is 7.5%. That total combines the 6% statewide sales tax with a 1.5% local discretionary surtax collected for the county.1Florida Department of Revenue. Discretionary Sales Surtax Rate Table2Florida Legislature. Florida Statutes 212.05 – Sales, Storage, Use Tax3Florida Senate. Florida Statutes 212.055 – Discretionary Sales Surtaxes The state collects the full 7.5% at the register and routes the local share back to the county.

The $5,000 Cap on Big-Ticket Purchases

The 1.5% local surtax only applies to the first $5,000 of a single item’s price. Anything above that is taxed at the 6% state rate alone.4Florida Legislature. Florida Statutes 212.054 – Discretionary Sales Surtax; Limitations, Administration, and Collection So the most local surtax you will ever pay on one item is $75.

Buy a $40,000 vehicle in Clay County and the math works out like this: 6% state tax on the full $40,000 is $2,400, and 1.5% on the first $5,000 is $75. Total tax: $2,475, not the $3,000 you would owe if the full 7.5% applied straight through. The cap matters most on cars, boats, and heavy equipment.

Items normally sold together or that assemble into one working unit count as a single item for the cap, as long as a single invoice covers the sale.4Florida Legislature. Florida Statutes 212.054 – Discretionary Sales Surtax; Limitations, Administration, and Collection A boat sold on the same invoice as its trailer, for example, is treated as one item.

What Gets Taxed and What Doesn’t

The 7.5% rate hits most retail sales of physical goods: furniture, electronics, clothing (outside tax-holiday windows), building materials, auto parts, and similar items. A handful of services are taxable too, including nonresidential pest control, commercial cleaning, and security services.

Several big categories are fully exempt from both the state tax and the local surtax:

Commercial Rent

Florida used to charge sales tax on commercial rent. That stopped on October 1, 2025, when both the state tax and all local surtaxes on commercial lease payments were permanently repealed. Businesses renting office, retail, or warehouse space in Clay County owe no sales tax on those lease payments. Parking garages, boat docking fees, aircraft storage, and short-term lodging of six months or less remain taxable.7Florida Department of Revenue. Tax Information Publication 25A01-04

Digital Products

Florida does not currently tax most digital goods. Downloaded music, e-books, streaming subscriptions, and software-as-a-service are generally treated as intangible services, so the 7.5% does not apply. Software delivered on physical media like a disc or USB drive is taxable like any other physical good. This area shifts, so sellers of digital products should check with the Florida Department of Revenue periodically.

Hotels and Short-Term Rentals

Short-term lodging in Clay County is taxed at a combined 12.5%, which stacks the 6% state rate, the 1.5% local surtax, and additional tourist development taxes.8Florida Department of Revenue. History of Local Sales Tax and Current Rates Any stay of six months or less falls into this bracket.

Sales Tax Holidays

Florida suspends state and local sales tax on qualifying purchases during an annual back-to-school holiday. For 2026, the holiday runs the full month of August and covers learning aids and puzzles priced at $30 or less, school supplies at $50 or less, clothing and footwear at $100 or less per item, and personal-use computers and accessories at $1,500 or less. Timing larger school purchases into that window avoids the full 7.5%. Florida has also run disaster preparedness holidays in some years, but those are set session by session and are not guaranteed.

When You Owe Use Tax

If you buy something from an out-of-state seller or an online source that doesn’t collect Florida sales tax, you owe the equivalent tax yourself. This is use tax, and it runs at the same 7.5% combined rate.9Florida Department of Revenue. Consumer Information

In practice, most large online retailers and marketplace platforms already collect Florida tax at checkout, so use tax mainly comes up with smaller sellers, private-party deals, or things you buy while traveling. You can file and pay online through the Department of Revenue or mail Form DR-15MO. Returns are quarterly: January through March purchases are due by April 20, and so on.9Florida Department of Revenue. If You Collect Sales Tax as a Business

Dealers registered in Florida report both the 6% state tax and the 1.5% Clay County surtax on Form DR-15, filed electronically through the Department of Revenue’s e-Services portal. Returns and payments are due on the 1st of the month after each reporting period and become late after the 20th.10Florida Department of Revenue. Sales and Use Tax Returns Instructions for DR-15

Most new businesses file monthly. Florida generally requires monthly filing when your annual sales tax liability exceeds $1,000. Lower-volume businesses may be assigned quarterly, semi-annual, or annual filing. Your assigned frequency is on your sales tax registration certificate.

Remote sellers that exceed $100,000 in Florida sales during the prior calendar year must register and collect the full state and local tax, including the Clay County surtax, even without a physical location in the state.11Florida Legislature. Florida Statutes 212.05965 – Marketplace Providers Marketplace platforms like Amazon, eBay, and Etsy are required to collect and remit tax on behalf of their third-party sellers, so sellers exclude those marketplace sales from their own returns. Sales you make on your own website or at a trade show stay your responsibility.

Deadlines, Penalties, and the Collection Allowance

Missing the 20th-of-the-month deadline triggers a penalty of 10% of the tax due, with a $50 minimum. Interest accrues at 1% per month on any unpaid balance from the 21st forward.12Florida Senate. Florida Statutes 212.12 – Dealer’s Credit for Collecting Tax; Penalties for Noncompliance Filing late and paying late at the same time doesn’t double the penalty; you get hit with one 10% charge, still subject to the $50 minimum.

Timely electronic filers get a small reward. If you file and pay electronically by the deadline, you can keep 2.5% of the tax you collected, up to $30 per reporting period.13Florida Senate. Florida Statutes 212.12 – Dealer’s Credit for Collecting Tax One late filing in a period forfeits that allowance entirely.
