Gambling is legal in Colorado in several distinct forms: casino games at licensed properties in Black Hawk, Central City, Cripple Creek, and two tribal casinos in the southwest corner of the state; sports betting in person and through mobile apps; the state lottery; pari-mutuel horse racing; registered daily fantasy sports contests; and licensed charitable bingo and raffles. Colorado gambling laws keep most other wagering off-limits, including online casino games and any home game where the host takes a cut. Each legal category has its own location rules, age threshold, and regulator, and the lines between legal and illegal are narrower than many people assume.
What Colorado Allows
Seven kinds of gambling have a legal path in the state:
- Casino gaming at commercial casinos in three mountain towns
- Casino gaming at two tribal casinos
- Sports betting, in person and on mobile apps tied to licensed casinos
- The Colorado Lottery, including Powerball and Mega Millions
- Pari-mutuel wagering on horse racing, live and simulcast
- Daily fantasy sports contests through registered or licensed operators
- Bingo and raffles run by licensed nonprofit organizations
Online casino games, unlicensed sports books, and for-profit home games fall outside those categories and are illegal.
Casino Gaming: Only in Five Places
The Colorado Limited Gaming Act, codified at Title 44, Article 30, authorizes commercial casino gambling only in Black Hawk and Central City in Gilpin County and Cripple Creek in Teller County.1Colorado Department of Revenue. Colorado Code 44-30 – Colorado Limited Gaming Act Those are the only locations in the state where a non-tribal casino can operate. Licensed casinos offer slot machines, blackjack, poker, roulette, and craps.2Ballotpedia. Colorado Amendment 77 – Allow Voters in Central, Black Hawk, and Cripple Creek Cities to Expand Authorized Games and Increase Maximum Bets Initiative (2020)
Individual bets were capped at $100 for years. Voters changed that in 2020 by approving Amendment 77, which removed bet limits and game-type restrictions from the state constitution and gave each gaming town the authority to raise or eliminate caps and approve new game types through local elections.3Colorado General Assembly. Two tribal casinos operate under federal Indian Gaming Regulatory Act compacts with the state. The Ute Mountain Casino, owned by the Ute Mountain Ute Tribe, sits near Towaoc about 10 miles south of Cortez. The Sky Ute Casino and Lodge, owned by the Southern Ute Indian Tribe, is near Ignacio roughly 25 miles southeast of Durango. Both offer slot machines, poker, blackjack, craps, roulette, and live keno, and both still operate under a $100 bet limit, though their compacts leave room for higher stakes through negotiation or litigation.4Department of Revenue – Specialized Business Group. Sports Betting: In Person and on Your Phone
Colorado legalized sports betting after voters passed Proposition DD in November 2019. You can place wagers at physical sportsbooks inside the authorized mountain-town casinos or through mobile apps run by operators partnered with those casinos.5Colorado General Assembly. Proposition DD – Legalization and Taxation of Sports Betting For mobile betting, you only need to be physically located in Colorado when you place the bet; you do not need to live here.
Most professional and collegiate events are fair game, with two important exceptions. Betting on high school sports is prohibited, and proposition bets on the performance of individual college athletes are also banned.6Colorado Secretary of State. 1 CCR 207-2 – Sports Betting Regulations The minimum age is 21, the same as casino play.
Lottery, Horse Racing, and Daily Fantasy
The Colorado Lottery sells scratch-off tickets and draw games and participates in multistate jackpot games like Powerball and Mega Millions. The purchase age is 18.7Justia. Colorado has one live horse racetrack, Bally’s Arapahoe Park in Aurora, which hosts a summer season. Several off-track betting facilities operate year-round across the state, offering simulcast wagering on horse and greyhound races broadcast from other tracks, and they can accept phone wagers from customers with a wagering account. Live greyhound racing no longer takes place in Colorado. The minimum age to buy or redeem a pari-mutuel ticket is 18.9Department of Revenue – Specialized Business Group. Racetracks and OTBs
Daily fantasy sports contests are legal and sit under their own framework, not the sports betting rules. Operators serving more than 7,500 Colorado customers must hold a full license from the Division of Gaming; smaller operators only have to register. Registration has been mandatory since July 2017.10Department of Revenue – Specialized Business Group. Charitable Bingo and Raffles
Nonprofits can run bingo games and raffles as fundraisers only after obtaining a license from the Colorado Secretary of State.11Colorado Secretary of State. Bingo and Raffles The licensing bar is higher than many people expect. The organization must be a bona fide nonprofit that has existed in Colorado continuously for at least five years, with a dues-paying membership actively carrying out its purpose during that entire period. Eligible groups include religious, charitable, labor, fraternal, educational, volunteer firefighter, and veterans’ organizations, along with political parties.12Colorado Secretary of State. Home Poker and Social Gambling
Colorado carves out an exemption for casual gambling among friends, but it is narrower than most people think. A game qualifies as social gambling only when it is incidental to a genuine social relationship between the players, involves only natural persons, and no one is engaged in professional gambling.14Justia. Colorado Code 18-10-102 – Definitions
The key word is “incidental.” A home poker night among coworkers who regularly socialize outside the game fits. A weekly game that someone advertises on social media to attract strangers does not. The moment a host takes a rake, charges an entry fee, or otherwise profits from running the game, it crosses into professional gambling, which is a criminal offense. You can play poker at home; nobody except the actual players can make money from the game itself.
Online Gambling: Mostly Illegal
Colorado does not license or regulate online casino games. You cannot legally play real-money online slots, blackjack, or roulette through a state-sanctioned platform. The state considers internet casino gambling illegal under both state and federal law, and the Colorado Limited Gaming Control Commission bars anyone licensed in the casino industry from involvement with internet gaming sites accessible to Colorado residents.15Department of Revenue – Specialized Business Group. What is Legal? Gambling Questions in Colorado
Online sports betting is the one exception, because Proposition DD specifically authorized mobile apps tethered to licensed brick-and-mortar casinos. If a website offers online slot machines or table games and claims to be legal in Colorado, it is not operating under state regulation.
Age Requirements
- 21 and older: casino gaming and sports betting, in person or on mobile. Minors cannot stay in the gaming area of a casino, though they may pass through to reach a restaurant or other unrestricted area.16Department of Revenue – Specialized Business Group. Playing in a Casino – Gaming

Penalties for Illegal Gambling
Colorado treats gambling violations on a sliding scale. Simple participation in illegal gambling is a petty offense.17Justia. Colorado Code 18-10-103 – Gambling Professional gambling, which includes running a game for profit or rigging the odds beyond normal skill or luck, is a class 2 misdemeanor punishable by up to 120 days in jail, a fine of up to $750, or both.18Justia. Colorado Code 18-1.3-501 – Misdemeanors Classified – Penalties Larger operations can draw felony charges for related offenses like racketeering or money laundering.
Repeat offenders face escalating consequences. Colorado defines a “repeating gambling offender” as anyone convicted of certain gambling crimes within five years of a prior misdemeanor conviction, or at any time after a prior felony conviction under the gambling statutes.14Justia. Colorado Code 18-10-102 – Definitions
Self-Exclusion if You Need a Break
Colorado runs a voluntary self-exclusion program for people who want to be barred from regulated gambling. You can sign up for a ban lasting one, three, or five years, and the exclusion covers casinos, in-person sportsbooks, and online sports betting apps. Removal is not automatic when your term ends; you have to request reinstatement and receive approval from the Division of Gaming Director. Applications can be submitted online, by mail, or in person at the Division’s office in Lakewood.19Bet Smart. Self-Exclusion
