Colorado HOV lanes mostly operate as Express Lanes, where you either pay a toll or ride free by carpooling with at least three people in the vehicle. That three-person threshold (HOV3+) is the detail drivers get wrong most often, because many other states let two people qualify. The Colorado Department of Transportation runs these corridors through the Colorado Transportation Investment Office, and getting the rules wrong can mean a surprise toll or a civil penalty in the mail.
Where the Lanes Are and Which Ones Carpools Ride Free
CDOT’s Express Lane network runs along the Front Range on several corridors:
- I-25 from downtown Denver to US 36, US 36 to E-470, and Monument to Castle Rock, with a Berthoud-to-Fort Collins segment in testing
- US 36 from Federal Boulevard to Table Mesa Drive
- C-470 from I-25 to Wadsworth Boulevard
- I-70 (Central 70) from I-25 to Chambers Road
- I-70 Mountain Express Lane from Idaho Springs to Empire
A free carpool option exists only on I-25, US 36, and Central 70. On C-470 and the I-70 Mountain Express Lane, everyone pays regardless of how many people are in the car.1Colorado Department of Transportation. Express Lanes – Get a Pass
One traditional HOV lane sits outside this network. Highway 82 between Basalt and Buttermilk, near Aspen, uses a two-person minimum (HOV2) during weekday peak hours: upvalley from 6 a.m. to 9 a.m. and downvalley from 3 p.m. to 6 p.m.2City of Aspen. High Occupancy Vehicle (HOV) Lanes
The HOV3+ Occupancy Rule
On CDOT’s Express Lanes, qualifying for free travel means a driver plus at least two passengers, three people total. Children and infants count toward the total.3Colorado General Assembly. High Occupancy Vehicle/Toll Express Lanes
Two people in the car means you pay the toll like everyone else. Running an Express Lane with fewer than three occupants while your transponder is set to HOV mode is a violation.
How to Pay: Transponders and License Plate Tolls
You need either a transponder or a license plate toll account to use an Express Lane. Three options cover most drivers.
The Switchable HOV3+ Transponder is the only device that lets you ride free as a carpool. It mounts on the windshield and has a toggle: slide it to HOV when you have three or more people on a corridor that supports the free option, or slide it to Toll when traveling with fewer. Drivers who always carpool can order this transponder at no cost. The standard ExpressToll sticker pass works for drivers who always pay. Without any transponder, cameras read your plate and bill you at a higher license plate toll rate.1Colorado Department of Transportation. Express Lanes – Get a Pass
Tolls change with time of day and congestion. The price on the overhead sign before you enter is the price you pay for that trip.4Colorado Department of Transportation. Using the Lanes
Penalties for Breaking Express Lane Rules
CDOT uses cameras to track lane entry, exit, and transponder signals. Violations arrive as civil penalties tied to the registered license plate, not criminal traffic tickets.
The base civil penalty is $75 if paid within 20 days. After 20 days it rises to $150. Signage along the corridors warns of fines up to $250, the statutory maximum.5Colorado Department of Transportation. Fines for Express Lane Weaving Violations
Weaving Across the Solid Line
Solid white lines separate Express Lanes from general traffic, and you can only enter or exit at marked access points with dashed lines. Crossing a solid line to cut in or out is its own civil penalty, also starting at $75. CDOT expanded weaving enforcement on Central 70, I-25 South Gap, and US 36 beginning in January 2025.6Colorado Department of Transportation. Traditional HOV Lane Infractions
Using a designated HOV lane in violation of posted restrictions is classified by state statute as a Class A traffic infraction, with an increased penalty for a third or subsequent offense within 12 months.7Justia. Colorado Code 42-4-1012 – High Occupancy Vehicle Class A traffic infractions carry fines from $15 to $100 under the general penalty schedule.8FindLaw. Colorado Code 42-4-1701 – Traffic Offenses and Infractions Classified This is what applies to the Highway 82 HOV lanes near Aspen, where enforcement comes from officers rather than cameras.
What Happens If You Ignore the Bill
Unpaid Express Lane penalties don’t fade away. After initial billing and late fees, accounts head to a collections firm. If the balance still goes unpaid, the Colorado Transportation Investment Office can ask the Department of Revenue to place a hold on your vehicle registration, which blocks renewal until the tolls, late fees, and penalties are cleared.9E-470. Violations
The registration hold is what turns a $75 ticket into a real problem. Paying promptly is far cheaper than letting the account escalate.
Motorcycles, Buses, and Electric Vehicles
Motorcycles ride free on I-25, US 36, C-470, and Central 70 without a transponder or toll account. The I-70 Mountain Express Lane is the exception: motorcyclists pay the posted toll there, and should have a transponder to avoid the higher license plate rate.4Colorado Department of Transportation. Using the Lanes Transit buses, including Bus Rapid Transit, also use the Express Lane corridors. On Highway 82 near Aspen, buses, carpools with at least two occupants, motorcycles, and alternative fuel vehicles qualify.2City of Aspen. High Occupancy Vehicle (HOV) Lanes
Colorado’s older program allowing hybrids and inherently low-emission vehicles to use Express Lanes solo with a special permit ended on May 31, 2020, after federal authorization under 23 U.S.C. ยง 166 expired.10Colorado Department of Transportation. Hybrid Vehicle Program Ending Although the Colorado Clean Pass Act (HB19-1199) envisioned an annual access fee for plug-in electric vehicles, no active statewide program gives solo EVs free or discounted Express Lane access as of 2026. Electric vehicles follow the same rules as any other car.
Driving Record and Insurance
Express Lane civil penalties are tied to the vehicle’s license plate, not the driver, and they do not appear on your driving record or add points. Traditional HOV lane infractions issued by officers under state statute are different: they are traffic offenses that go on your record. Colorado suspends adult drivers 21 and older who accumulate 12 or more points within any 12 months or 18 or more within any 24 months, with lower thresholds for minor drivers.11Colorado Department of Revenue. Point Suspensions
A single HOV infraction is unlikely to move your insurance rate much on its own, but repeated violations can. For most Colorado drivers, the bigger financial exposure comes from the civil penalty side, where unpaid tickets quietly compound into a registration hold.
