Cooling-Off Period in California: Three-Day Rule and Exceptions

The cooling off period in California is not a single rule but a set of them, each tied to a specific kind of transaction. A door-to-door sale gives you three business days to cancel. A timeshare gives you seven calendar days. An expensive gym contract can give you up to 45 days. Refinancing your home gives you three business days to rescind. Divorce carries a six-month waiting period before it can be finalized, and a firearm purchase carries a mandatory 10-day wait before delivery. Each window has its own trigger, its own method of cancellation, and its own consequences for missing the deadline.

Door-to-Door and Home Solicitation Sales

If someone sells you something at your home, workplace, dormitory, or a temporary location like a hotel or convention center, you have until midnight of the third business day after the sale to cancel for a full refund. Saturday counts as a business day. Sundays and federal holidays do not.1Federal Trade Commission. Buyer’s Remorse: The FTC’s Cooling-Off Rule May Help

If you are 65 or older, California extends the window to five business days. The seller has to state that extended deadline in the contract and on the cancellation form.2California Legislative Information. California Civil Code 1689.7 – Home Solicitation Contracts

At the sale, the seller is supposed to hand you two copies of a cancellation form along with a dated contract or receipt that lists their name and address.1Federal Trade Commission. Buyer’s Remorse: The FTC’s Cooling-Off Rule May Help If any of that is missing, your cancellation rights may extend beyond the standard window.

Home Repair After a Disaster

Contracts for home repair or restoration on property damaged by a flood, fire, earthquake, or similar disaster carry a seven-business-day right to cancel instead of three or five. The contract must include a prominent notice of that right in the same language used during the sales pitch. If you cancel, the contractor has 10 days to return your money.2California Legislative Information. California Civil Code 1689.7 – Home Solicitation Contracts

Sales the Three-Day Rule Does Not Cover

The federal Cooling-Off Rule has significant gaps, and buyers who assume any purchase can be undone within three days are often wrong. The rule does not cover:

  • Purchases under $25 at your home or under $130 at a temporary location.
  • Sales made entirely online, by mail, or by phone.
  • Sales completed at the seller’s permanent place of business after you negotiated there.
  • Emergency purchases where you needed the goods or services immediately.
  • Repairs you asked for. Anything you bought beyond the repair you requested is still covered.
  • Real estate, insurance, and securities transactions.
  • Motor vehicles sold at temporary locations by sellers who have at least one permanent business location.
  • Arts and crafts sold at fairs, malls, civic centers, or schools.

These exclusions apply to the federal rule.1Federal Trade Commission. Buyer’s Remorse: The FTC’s Cooling-Off Rule May Help California’s own consumer protection statutes sometimes reach situations the federal rule does not, so an excluded sale is not automatically a dead end.

How to Cancel and What the Seller Owes You

Sign and date one of the cancellation forms the seller provided, then mail it to the address listed for cancellations. The envelope has to be postmarked before midnight of the final business day in your window.1Federal Trade Commission. Buyer’s Remorse: The FTC’s Cooling-Off Rule May Help Certified mail with a return receipt is not required, but it is cheap insurance if the seller later claims nothing arrived.

Once the seller receives your notice, they have 10 days to refund your money, return any trade-in, and cancel any checks you signed.1Federal Trade Commission. Buyer’s Remorse: The FTC’s Cooling-Off Rule May Help If the seller left goods with you, make them available for pickup in the condition you received them. The seller then has 20 days to pick the items up or reimburse you for shipping them back. If they do neither within those 20 days, you can keep the goods with no further obligation.

Timeshare Purchases

You can cancel a timeshare purchase contract within seven calendar days after receiving the public report or signing the purchase agreement, whichever happens later. The contract must spell out the cancellation period and the address where you send your notice, and any attempt by the developer to get you to waive this right is void.3California Department of Real Estate. Notice of Cancellation Rights (Time-Share)

Your notice is effective on the date you send it, not the date the developer receives it. Mail it on day seven and it counts, even if the envelope sits unopened for another week.3California Department of Real Estate. Notice of Cancellation Rights (Time-Share)

Health Studio Contracts

Gym and health studio contracts in California carry extended cancellation periods that scale with the total contract price, including initiation and membership fees:

  • $1,500 to $2,000: 20 days to cancel after signing.
  • $2,001 to $2,500: 30 days to cancel.
  • $2,501 or more: 45 days to cancel.

Contracts under $1,500 may carry a shorter baseline cancellation period under the same statute, so check the cancellation language in your agreement no matter the price.4California Legislative Information. California Code Civil Code 1812.85 – Health Studio Services Contracts

Right of Rescission on Home Loans

Federal Regulation Z gives you three business days to cancel certain loans secured by your primary home. The right applies when you refinance an existing mortgage or open a home equity line of credit, meaning any situation where a new lien is placed on a home you already own.5Consumer Financial Protection Bureau. 12 CFR 1026.23 – Right of Rescission

The three-day clock does not start until all three of the following have happened: you sign the loan agreement, you receive the required Truth in Lending Act disclosures, and you receive two copies of the notice explaining your right to rescind. Until the last of the three occurs, the clock has not started.6eCFR. 12 CFR 1026.23 – Right of Rescission The lender cannot disburse funds or record the new lien during the rescission window.

Rescission does not apply to a purchase money mortgage, the loan you use to buy or build the home in the first place.5Consumer Financial Protection Bureau. 12 CFR 1026.23 – Right of Rescission A refinance can be unwound; a home purchase cannot.

The Six-Month Waiting Period for Divorce

California imposes a six-month waiting period before a court can finalize a divorce. The clock begins when the petition and summons are served on the other spouse, or when that spouse makes an appearance in the case, whichever comes first. Because the statute requires six months to expire, the earliest possible termination date is six months and one day after that triggering event.7California Legislative Information. California Code FAM 2339 – Dissolution of Marriage and Legal Separation

The court cannot shorten the period even if both spouses agree on everything. It can extend it for good cause.7California Legislative Information. California Code FAM 2339 – Dissolution of Marriage and Legal Separation The waiting period applies only to ending the marital status itself. A court can resolve property, support, and custody on a separate timeline, which is why many divorces take longer than six months regardless of the statute.

Firearm Purchase Waiting Period

California requires at least 10 days between the purchase application and delivery of any firearm, handgun or long gun, through a licensed dealer or a private sale run through one.8California Legislative Information. California Code PEN 27540 – Delivery of Firearms The 10 days run even if the Department of Justice clears the background check sooner. For the overwhelming majority of individual buyers, there is no way to shorten the wait.
