Davis County Marriage License: Requirements, Fees, and Validity

To get a Davis County marriage license, both applicants appear together at the County Clerk’s office at 61 South Main Street in Farmington, present valid government-issued photo ID, and pay the $60 fee, which includes two certified copies of the certificate. Utah has no waiting period, so the license is issued on the spot and you can hold the ceremony the same day. The license is valid for 32 days and can only be used within Utah.

Who Can Apply

Both applicants must be at least 18 to marry without additional approval. Applicants who are 16 or 17 face a much longer path: a parent or legal guardian must appear in person before the county clerk and sign a written consent, and the minor and the consenting adult must petition a juvenile court judge or court commissioner for written authorization. The judge must find that the minor is marrying voluntarily and that the marriage serves the minor’s best interest. A mandatory 72-hour waiting period runs between filing the petition and judicial approval, and a judge cannot authorize the marriage if the age gap between the parties exceeds four years.1Utah Legislature. Utah Code 81-2-304 – Marriage by Minors, Consent of Parent or Guardian, Juvenile Court Authorization No one younger than 16 can legally marry in Utah.

Utah also voids marriages between close relatives: parents and children, siblings, aunts or uncles and nieces or nephews, and first cousins. First cousins have a narrow exception when both parties are 65 or older, or both are 55 or older with a district court finding that either party is unable to reproduce.2Utah Legislature. Who Can Officiate

Utah authorizes a broad range of officiants:

  • Ministers, rabbis, priests, or leaders of any denomination who are at least 18 and in regular communion with their religious community
  • Native American spiritual advisors
  • The governor, lieutenant governor, attorney general, state treasurer, state auditor, mayors, county executives, and members of the Utah Legislature or the state’s congressional delegation
  • Justices, judges, or commissioners of any Utah court of record, judges of courts not of record, federal judges and magistrates, and retired judges under rules set by the Utah Supreme Court

After the Ceremony

The officiant signs the marriage certificate and records the date and location of the wedding, and two witnesses who are at least 18 must also sign. The officiant then has 30 days to return the completed license to the Davis County Clerk’s office. An officiant who misses that deadline commits an infraction under Utah law.9Utah Legislature. Once the clerk records the returned license, the office mails the two certified copies to the address you listed on the application. Those copies are your official proof of marriage for name changes, insurance enrollment, banking, and anywhere else you need to show you are legally married.
