A DC domestic partnership is a legal status that couples can register with the Vital Records Division at DC Health for a $45 fee, giving them many of the same rights as married spouses under District of Columbia law. Both same-sex and opposite-sex couples qualify, and the registration provides concrete protections around inheritance, hospital visitation, property division, and DC tax filing. What it does not do is create a federally recognized marriage, which is the single most important thing to understand before you decide whether registration is right for you.
Who Can Register
Both partners must be at least 18 and legally able to enter a contract.1D.C. Law Library. District of Columbia Code 32-702 – Domestic Partnership Registration and Termination Procedures Neither person can already be married or in another registered partnership. And you must be in a committed relationship, which the statute defines in a specific way: you share a mutual residence.2D.C. Law Library. District of Columbia Code 32-701 – Definitions
That mutual residence requirement is where most applicants stumble. Saying you live together is not enough. DC Health will accept a current lease or rental agreement naming both partners, a mortgage listing both as borrowers, a deed showing shared title, or a sworn affidavit executed within the past six months if both partners’ photo IDs show the same home address.3DC Health. Domestic Partnership One of those documents has to come with you to the appointment.
You do not have to live in DC to register. Couples who reside outside the District can still file their partnership in the city, though whether that registration carries any weight back home depends on your state’s laws.
How to Register
Registration takes place at DC Health’s Vital Records Division at 899 North Capitol Street NE, First Floor, and both partners must appear in person.3DC Health. Domestic Partnership There is no interview or waiting period, although the Registrar has authority to examine applicants under oath.
Bring three things:
- The Domestic Partnership Registration Form, which you can download from the DC Health website or pick up at the office.
- Proof of mutual residence — one of the documents listed above.
- A valid government-issued photo ID for each partner.
Both partners sign the declaration under penalty of perjury, affirming they meet every eligibility requirement.1D.C. Law Library. District of Columbia Code 32-702 – Domestic Partnership Registration and Termination Procedures The $45 filing fee can be paid by credit or debit card, check, or money order.4DC Health. What Rights the Partnership Gives You Under DC Law
Registration is not symbolic. It triggers specific protections under DC law that unregistered couples do not have.
Hospital Visitation and Healthcare Access
Every hospital and long-term care facility in the District must allow a registered domestic partner to visit as a family member.5D.C. Law Library. District of Columbia Code 32-704 – Domestic Partnership Benefits Without that status, a partner who is not a legal spouse or blood relative can be turned away during a medical emergency.
Inheritance If Your Partner Dies Without a Will
If your partner dies intestate, you inherit the same share a surviving spouse would receive under DC law. The exact share depends on whether your partner left children or surviving parents.6D.C. Law Library. District of Columbia Code 19-302 – Share of Spouse or Domestic Partner Without registration, you have no automatic inheritance rights at all.
Wrongful Death Standing
DC’s wrongful death statute treats registered domestic partners the same as spouses. If your partner dies because of someone else’s negligence, you have standing to sue, and damages are assessed based on the injury to you as the surviving partner.7D.C. Law Library. District of Columbia Code 16-2701 – Liability; Damages; Prior Recovery as Precluding Action An unregistered partner would face serious obstacles bringing the same claim.
Property Division When the Partnership Ends
If the partnership ends through court action, DC applies the same equitable distribution framework used in divorce. Each partner keeps separate property acquired before the partnership or received as a gift, and the court equitably divides everything else accumulated during the partnership.8D.C. Law Library. District of Columbia Code 16-910 – Assignment and Equitable Distribution of Property Cohabiting couples without a registration get none of this.
DC Family and Medical Leave
Under the DC Family and Medical Leave Act, your domestic partner counts as a family member, so an eligible employee can take leave to care for a partner with a serious health condition, as long as they have shared a mutual residence within the past year.9D.C. Office of Human Rights. Frequently Asked Questions About the D.C. Family and Medical Leave Act Federal FMLA does not cover domestic partners, so this DC protection fills a real gap.
Health Insurance for DC Government Employees
District government employees in the DC Employees Health Benefits Program can enroll their domestic partner in family coverage. The employee pays 25% of the family premium and the District covers the remaining 75%.10D.C. Law Library. District of Columbia Code 32-706 – District of Columbia Employees Health Benefits Program Private employers set their own policies, so whether your workplace extends partner coverage depends on the plan.
DC Tax Filing
Registered partners can file their DC income taxes jointly, or they can file separately on a combined form prescribed by the Chief Financial Officer. The DC code treats registered partners as if they had the federal right to file jointly.11D.C. Law Library. District of Columbia Code 47-1805.01 – Returns – Forms Joint filing often produces a lower combined tax bill when partners earn very different incomes.
DC estate tax is a separate consideration. The exemption for decedents dying in 2026 is $4,988,400.12DC Office of Tax and Revenue. Notice of Oct. 1, 2025 Tax Changes One important limit: DC does not allow portability of the estate tax exemption between domestic partners (or spouses). If one partner dies without using their full exemption, the survivor cannot claim the unused portion. Couples with combined estates near the threshold should plan around that with an estate attorney.
What the Partnership Does Not Give You
This is the part worth reading twice. Registered domestic partnership is a creature of DC law, and several important rights sit outside DC’s reach.
Federal taxes. The IRS does not recognize domestic partnerships as marriages. Partners must file their federal returns as single or, if independently qualified, as head of household. Married filing jointly and married filing separately are not available.13Internal Revenue Service. Answers to Frequently Asked Questions for Registered Domestic Partners and Individuals in Civil Unions You will run one set of rules for your DC return and a different set for your federal return every April.
Social Security. The Social Security Administration classifies domestic partnerships as “non-marital legal relationships” and decides benefits eligibility based on whether the partnership gives inheritance rights under local law. Because DC does, a DC-registered partner should qualify for spousal and survivor benefits, using the registration date as the “marriage date” for duration requirements (one year for spousal, nine months for survivor).14Social Security Administration. GN 00210.004 – Non-Marital Legal Relationships The catch: eligibility depends on the laws of the state where the benefit-earning partner is domiciled, so if that partner lives outside DC in a state that does not recognize the partnership, the answer can change.
Recognition in other states. No federal law requires other states to honor a DC domestic partnership. Marriage carries nationwide recognition; domestic partnership does not. Some states recognize out-of-state partnerships or civil unions, but many do not. If you register in DC and move to a state that does not, you can lose the rights listed above. Couples who may relocate should seriously weigh marriage instead, or consult an attorney in the destination state before counting on anything.
Domestic Partnership or Marriage
DC legalized same-sex marriage in 2010, so the partnership registry is no longer the only path for same-sex couples. Both options are open to any couple. The choice depends on what you need.
Marriage gives you automatic federal recognition: joint federal tax filing, Social Security benefits without the non-marital relationship analysis, and recognition in every state. Domestic partnership gives you most of the same rights under DC law and almost nothing under federal law.
Some couples prefer the partnership because they want legal protections without the cultural weight of marriage. Others choose it for tax reasons, since two high earners filing separately as single individuals at the federal level sometimes pay less than they would as a married couple. Neither answer is wrong, but you should know exactly what you are getting before you register.
How to End a DC Domestic Partnership
DC provides three ways to terminate, and the timing depends on which one applies.
Administrative Termination Through Vital Records
Either or both partners can file a termination statement with the Vital Records Division. If both consent and sign, it takes effect six months after filing, and benefits continue to accrue during that wait.1D.C. Law Library. District of Columbia Code 32-702 – Domestic Partnership Registration and Termination Procedures If only one partner files, that partner must serve a copy on the other by mail or in person, and the same six-month wait applies. One exception shortens the process: if the other partner abandoned the relationship and has been gone from the mutual residence or out of contact for at least six months before filing, the termination is effective immediately.
Judicial Termination
A partnership can also be ended by court decree, in a process that mirrors divorce.15D.C. Law Library. D.C. Law 21-105 – Domestic Partnership Termination Recognition Amendment Act of 2015 This is the right route when there are disputes over property or debt, because the court can apply the equitable distribution rules under DC Code § 16-910.8D.C. Law Library. District of Columbia Code 16-910 – Assignment and Equitable Distribution of Property If you and your partner share significant assets, judicial termination with an attorney is the safer path.
Termination by Operation of Law
The partnership ends automatically if the partners marry each other or if either partner marries someone else, and it ends immediately on the death of either partner.1D.C. Law Library. District of Columbia Code 32-702 – Domestic Partnership Registration and Termination Procedures You should still notify Vital Records and provide any required documentation, but the termination itself does not wait on that notification.
