If you live in Aiea and are looking into debt settlement, the first thing to know is that Hawaii law blocks most of the companies you’ll see advertising online. For-profit debt settlement firms cannot legally conduct debt-adjusting services in Hawaii. Only nonprofit credit counseling organizations and attorneys licensed in Hawaii may do this work.1Hawaii.gov DCCA. What Debt Settlement Actually Costs You
Your Credit Score
Settlement programs usually require you to stop paying creditors while you build up a lump sum to offer. Because payment history is the most heavily weighted factor in credit scoring, those deliberate missed payments can lower a score by more than 100 points.12Investopedia. How Will Debt Settlement Affect My Credit Score The negative marks stay on your credit report for seven years from the date of the first missed payment.13Experian. How Long Do Settled Accounts Remain on a Credit Report
The damage can also outlast the program. The National Foundation for Credit Counseling reports that more than 90% of consumers in debt settlement programs do not settle all their enrolled debts, and that by the third year participants have typically resolved only about 43% of their total debt.14National Foundation for Credit Counseling. Taxes on Forgiven Debt
The IRS generally treats canceled debt as taxable income. When a creditor forgives $600 or more, it may issue a Form 1099-C, and you must report the amount on your return whether or not you receive the form.15IRS. Tax Consequences of Debt Settlement If you settle $10,000 for $5,000 and sit in the 22% federal bracket, the forgiven $5,000 could add about $1,100 to your federal tax bill. Hawaii state income tax may apply as well.
There are exceptions. Debt discharged in bankruptcy is generally not taxable, and if you were insolvent at the time of settlement you may exclude the forgiven amount from income by filing IRS Form 982.15IRS. Topic No. 431, Canceled Debt – Is It Taxable or Not
Fees
Nationally, for-profit settlement companies typically charge 15% to 25% of enrolled debt, plus account maintenance fees.14National Foundation for Credit Counseling. How to Recognize an Illegal Offer
You will still see for-profit debt relief ads targeting Hawaii from the mainland. A few signs mark an offer that cannot legally be made to you:
- Any upfront fee. Federal law bars for-profit debt relief firms from collecting any fee before they have settled, reduced, or changed the terms of at least one debt, obtained your agreement, and received at least one payment under the new agreement.17Federal Trade Commission. Debt Relief Services and the Telemarketing Sales Rule
- Guaranteed results. No one can guarantee a specific reduction in a specific timeframe; creditors are not obligated to negotiate.18AARP. Debt Relief Scams
- Instructions to cut off all contact with creditors. That often accelerates lawsuits and collection activity.
- Refusal to explain fees, process, and risks before asking for your financial information.18AARP. Debt Relief Scams

When Bankruptcy Fits Better Than Settlement
Settlement is not the right answer for everyone. In 2023 Hawaii had 1,060 bankruptcy filings, up roughly 9% from 2022, with 686 Chapter 7 cases and 367 Chapter 13 cases.20American Bankruptcy Institute. Filing Trends: Hawaii
Hawaii lets filers choose between state and federal exemptions. Under state exemptions, a head of household or person over 65 can protect up to $30,000 in home equity, with $20,000 for others, plus vehicle equity up to $2,575 and unlimited tools of the trade. Federal exemptions protect $25,150 in home equity, $4,000 in vehicle equity, and up to $13,900 of any property through a wildcard. Attorneys generally advise homeowners to pick state exemptions and renters to pick federal ones.21FindLaw. Hawaii Bankruptcy Exemptions and Law
Bankruptcy has two advantages settlement does not. The automatic stay halts collection calls, wage garnishments, and lawsuits the moment you file. And debt discharged in bankruptcy is generally not taxable income. The tradeoff is credit reporting: Chapter 7 stays on your report for ten years and Chapter 13 for seven, though the practical weight of either often fades well before then.
Collection Protections While You Decide
While you work out which path makes sense, Hawaii law limits what collectors can do. Under HRS Chapter 443B and Chapter 480D, all collection agencies in Hawaii must register with the DCCA. Collectors cannot call before 8:00 a.m. or after 9:00 p.m., must stop contact if you ask in writing, and cannot threaten arrest, use profane language, or try to collect their own service fees. If you dispute a debt in writing within 30 days of first contact, the agency must stop collection until it verifies the debt.22Hawaii.gov DCCA. Collection Agencies
If a collector crosses those lines, file a complaint with the DCCA’s Regulated Industries Complaints Office at 808-587-4272, or take independent legal action.
