Default Divorce in New York: Forms, Deadlines, and Judicial Review

A default divorce in New York lets you finalize your marriage’s end when your spouse ignores the papers you served on them. Once their response deadline passes with no appearance or answer, you can file a complete default judgment package, and a judge will review it and sign the Judgment of Divorce without your spouse ever participating. The process is procedurally strict, and one deadline in particular has killed more of these cases than any other.

When Your Spouse Is in Default

Your spouse is in default once their time to respond to the divorce papers runs out. If they were served personally inside New York, they have 20 days to file a Notice of Appearance or Answer. If they were served outside the state or by any method other than personal delivery, that stretches to 30 days.1New York State Unified Court System. How to Respond to a Summons and Complaint in a Divorce Case If they let the deadline pass, you can proceed alone.

Default doesn’t happen automatically on the court’s end. You still have to file the paperwork that asks the court to treat the silence as a default and enter a judgment on that basis. Nothing moves until you do.

Residency and Grounds You Need First

Before any of this works, a New York court has to have authority over your case. Domestic Relations Law Section 230 gives you five residency paths, and you only need to meet one. The straightforward one: either spouse has lived in New York continuously for at least two years before filing. That drops to one year if you married in New York, lived here together as a married couple, or the grounds for divorce arose here.2New York State Senate. New York Code DOM – Required Residence of Parties If both of you still live in New York and the grounds arose here, there’s no minimum period at all.

You also need a legal ground. For a default, the no-fault ground is almost always the right choice: a sworn statement that the marriage has been irretrievably broken for at least six months.3New York State Senate. New York Domestic Relations Code 170 – Action for Divorce Fault grounds require proof of specific conduct, which adds work you don’t need when your spouse isn’t contesting anything.

Serving the Papers Correctly

A default divorce stands or falls on whether service was done right. New York requires personal service of the Summons with Notice (or Summons and Verified Complaint), together with the Notice of Automatic Orders and the Notice of Guideline Maintenance. If children are involved, the Child Support Standards Chart goes with it.4New York Courts. The automatic orders under Domestic Relations Law Section 236 bind both spouses as soon as the action is filed. Neither of you can transfer or hide marital property beyond normal spending, cash out retirement, change insurance beneficiaries, or drop the other from health, dental, or auto insurance.5New York State Senate. New York Domestic Relations Code 236 They apply to you too, even though you’re the one filing.

If You Can’t Find Your Spouse

When your spouse’s whereabouts are genuinely unknown, you can ask the court for permission to serve by publication. You have to show the judge you made a real effort to locate them first. If granted, you publish the summons once a week for three consecutive weeks in a court-designated English-language newspaper, and typically also mail a copy to the last known address unless no plausible one exists. Service is complete 21 days after the first publication date.6FindLaw. New York Civil Practice Law and Rules CPLR Rule 316

Courts examine these requests carefully. A “diligent search” means documenting contact with relatives, checks of social media and prior addresses, outreach to former employers. If a judge later decides your effort was thin, the whole divorce can be reopened.

The One-Year Deadline That Kills Default Cases

This is the one to circle. Under CPLR 3215(c), if you don’t take steps to enter a default judgment within one year after your spouse’s response deadline expires, the court will dismiss your case as abandoned.7New York State Senate. New York Civil Practice Law and Rules 3215 – Default Judgment There’s no warning letter. The court can do it on its own. If that happens, you start over: new filing fees, new service, new wait.

Once your spouse’s time runs out, keep moving. Pull the forms together, finish the financial disclosures, and file the full package well inside that one-year window.

The Default Judgment Paperwork

The court won’t finalize anything until a specific set of forms is complete and consistent. The Unified Court System publishes the full packet and runs a free Uncontested Divorce DIY Program that walks you through filling them out.8New York Courts. Uncontested Divorce Program The core documents:

  • Summons with Notice or Summons and Verified Complaint (Forms UD-1/UD-1a and UD-2), which initiate the action and spell out the relief you’re asking for.
  • Affirmation of Service (Form UD-3), the proof that service was done properly.
  • Sworn Statement of Removal of Barriers to Remarriage (Form UD-4), required in every case.
  • Affirmation of Regularity (Form UD-5), which is where you confirm your spouse defaulted, no extension was granted, and the response time has run.9New York State Unified Court System. Form UD-5 – Affirmation of Regularity
  • Plaintiff’s Affirmation (Form UD-6), your sworn statement of the facts and grounds.
  • Income and support worksheets (Form UD-8) if maintenance or child support is at issue.
  • Note of Issue, Findings of Fact and Conclusions of Law, Judgment of Divorce, and supporting documents (Forms UD-9 through UD-14), which put the case on the calendar and give the judge the drafts to sign.4New York Courts. New York Divorce Forms

The Notice of Guideline Maintenance explains how New York calculates spousal support, and the income cap on guideline maintenance adjusts periodically. Check the current figure on the court system’s website before you finalize your papers, because an outdated number gets filings sent back.10New York State Unified Court System. Filing fees apply at the index number stage and again at the Request for Judicial Intervention. If you can’t afford them, you can apply for a fee waiver by filing an affidavit of hardship under CPLR 1101.11New York State Senate. The Military Service Affidavit

Federal law adds a step that catches many filers. Before entering a default judgment in any civil case, including divorce, the Servicemembers Civil Relief Act requires an affidavit stating whether the defendant is in active military service. If your spouse is on active duty, the court must appoint an attorney to represent them before signing anything. If you can’t determine their status, you have to say so, and the court may require a bond to protect their interests.12Office of the Law Revision Counsel. 50 USC 3931 – Protection of Servicemembers Against Default Judgments Lying on this affidavit is a federal crime punishable by up to one year in prison. The Department of Defense runs a free online tool for verifying military status.

What the Judge Decides Without Your Spouse There

A default doesn’t mean the court rubber-stamps your requests. Under DRL Section 170(7), a no-fault divorce can’t be granted until all economic issues are resolved, by agreement or by the court itself.3New York State Senate. New York Domestic Relations Code 170 – Action for Divorce In a default, the judge decides those issues on whatever evidence you submit.

For custody, the judge must find the arrangement serves the children’s best interests. For child support, when the other parent has defaulted and offered no financial information, the court sets support on whatever’s available about their circumstances, and that order can later be increased retroactively without a showing of changed circumstances.13New York State Senate. New York Domestic Relations Code 240 – Custody and Child Support A defaulting parent risks support set higher than it would have been with their actual numbers on the table.

Property is divided under equitable distribution. Equitable means fair, not equal, and with only your side in front of the judge, your financial disclosures carry the whole weight. One hard limit: the judgment can’t exceed or differ in type from the relief you requested in your Summons with Notice or Verified Complaint.7New York State Senate. Judicial Review and the Signed Judgment

Once the full package is filed, the file goes to a judge for review. The judge checks residency and grounds, confirms service was proper, and verifies that the proposed judgment matches what was pleaded.4New York Courts. New York Divorce Forms Review takes weeks to months depending on the county. Incomplete paperwork is the usual cause of delay; if something’s off, the file comes back with a note explaining what to fix.

When the judge signs the Judgment of Divorce, you’re legally single. The judgment gets entered in the county records, and you then have to serve a copy of the judgment with a Notice of Entry on your former spouse and file an Affirmation of Service of the Judgment of Divorce with the court.4New York Courts. Health Insurance After Finalization

The automatic orders that kept you on your spouse’s health plan during the case end when the judgment is signed. Divorce is a qualifying event under federal COBRA, so if you were covered under a spouse’s employer plan, you can continue coverage for up to 36 months, paying the full premium plus a small administrative fee. The deadline is tight: you or a qualified beneficiary must notify the plan within 60 days of the divorce becoming final.14U.S. Department of Labor. Put it on your calendar the day the judgment is signed, and have a plan in place before then.

If Your Spouse Later Tries to Undo the Judgment

A default judgment isn’t locked in forever. Under CPLR 5015, a defaulting spouse has a few grounds to try to vacate it:

  • Excusable default. The spouse has to show a reasonable excuse for not responding (serious illness, military deployment, never actually receiving the papers) and a potentially valid defense. The motion must be made within one year after being served with a copy of the judgment and notice of entry.15New York State Senate. New York Civil Practice Law and Rules R5015 – Relief From Judgment or Order
  • Lack of jurisdiction. If service was never properly made, the court didn’t have authority to enter the judgment in the first place. No time limit applies.
  • Fraud or misconduct. If the filing spouse lied about assets, income, or service, the court can set the judgment aside.

Excusable default has real force. Judges look at how long the default ran, whether the excuse holds up, and whether there’s a genuine dispute about custody, support, or property. Ignoring the papers because dealing with them was unpleasant generally doesn’t qualify. A spouse who was hospitalized, incarcerated, or genuinely unaware has a reasonable chance. If a judgment is vacated, the case essentially restarts from the point the answer would have been due.15New York State Senate.
