Delaware Clean Slate Act: Automatic Expungement and Its Limits

Delaware’s Clean Slate Act is a 2021 law that directs the state to automatically expunge eligible criminal records every month, with no application, court appearance, or fee required from the person whose record is being cleared. The State Bureau of Identification began that monthly process on August 1, 2024, and an estimated 290,000 residents have records that qualify.1Delaware Code Online. Delaware Code Title 11 – Expungement of Criminal Records – Section: 4373A If your record doesn’t fit the automatic criteria, you can still ask the bureau to clear it or file a petition in Superior Court.

How the Automatic Process Works

Senate Bill 111 created the system in 2021. Before it, even people with clearly eligible records had to pull their own case information and submit paperwork. Now the Delaware Criminal Justice Information System scans the state’s criminal records database each month to flag records that meet the eligibility rules, and the bureau manually reviews each one before expunging it.1Delaware Code Online. That manual review has slowed the rollout. One thing to know up front: the law specifically says you cannot sue the state for failing to identify your record. If the system misses you, the remedy is to file for expungement yourself.

Which Records Get Cleared Automatically

The automatic track covers two groups: cases that ended without a conviction, and some conviction records after a waiting period.

Cases That Ended Without a Conviction

If your case was “terminated in favor of the accused,” it qualifies for automatic expungement with no waiting period, no matter what else is on your record. That includes an acquittal, a nolle prosequi (prosecutor dropped the charges), a dismissal for any reason, an arrest where no charges were filed within a year, probation before judgment that you completed, or a case at least 7 years old with no final disposition and no active warrants.2Justia. Convictions Eligible Regardless of Your Other Record

A handful of convictions clear automatically even if you have other criminal history, as long as every charge in that specific case qualifies:3Justia. Delaware Code Title 11 4373 – Mandatory Expungement, Application Through SBI

  • Violations, 3 years after conviction.
  • Marijuana possession and drug paraphernalia possession, no waiting period.
  • Underage alcohol possession or consumption, no waiting period.

Convictions Eligible Only With a Clean Record Otherwise

For most other categories, you need no other disqualifying convictions anywhere on your record:3Justia. Delaware Code Title 11 4373 – Mandatory Expungement, Application Through SBI

  • Misdemeanors, 5 years after conviction.
  • Drug possession beyond marijuana, 5 years after conviction.
  • A short list of felonies, 10 years after conviction or release from incarceration, whichever is later.

The felony list is narrow: certain miscellaneous drug offenses, dealing in counterfeit controlled substances, maintaining a drug property, possession of burglary tools, second-degree forgery, and unlawful use of a payment card.3Justia. The Catch That Trips Most People Up

For most conviction categories above, Delaware requires that nothing else on your record is itself ineligible for expungement. A single disqualifying conviction can block every other conviction from being cleared, even ones that would qualify on their own.3Justia. The exceptions matter: violations after 3 years, marijuana and paraphernalia possession, and underage alcohol offenses clear case-by-case regardless of your other history. There is also a one-time rule for felonies. If you’ve already had a felony conviction expunged, any felony conviction you pick up after that expungement date is permanently ineligible.2Justia. What the Clean Slate Act Will Not Clear

Five convictions can never be expunged under any Delaware provision: second-degree vehicular assault, incest, third-degree unlawful sexual contact, coercion, and unlawfully dealing with a child.2Justia. Delaware Code Title 11 4372 – Applicability, Definitions, Effect of Expungement

A broader group is excluded from the automatic track but may still qualify through a court petition. That includes domestic violence crimes (offenses against a family member, former spouse, cohabitant, co-parent, or dating partner), crimes against children or vulnerable adults, sex offenses under subchapter VI of Chapter 5 of Title 11, and specific misdemeanors such as sexual harassment, indecent exposure, organized retail crime, official misconduct, resisting arrest, hate crimes, and various weapons offenses.3Justia. Delaware Code Title 11 4373 – Mandatory Expungement, Application Through SBI A petition is a separate process where a judge weighs whether keeping the record causes you a “manifest injustice.”4Delaware Code Online. If the System Hasn’t Reached You Yet

There is no online portal to check whether the monthly process has caught up to your record. The most reliable confirmation is to request a certified criminal history from the State Bureau of Identification for $72.5Delaware State Police. Obtaining a Certified Delaware Criminal History You can also look up case records at a court clerk’s office in person.

If a record that should have been cleared is still showing, you can submit a mandatory expungement request directly to the bureau at any time, or file a petition in Superior Court. You don’t have to wait for the automatic cycle to find you.

What Expungement Actually Gives You

Once a record is expunged, Delaware law says you are not required to disclose the arrest, charge, or conviction to anyone, for any purpose, and nobody should ask.2Justia. Delaware Code Title 11 4372 – Applicability, Definitions, Effect of Expungement On job applications, housing applications, and loan forms, you can legally answer “no” to criminal history questions if the only offenses on your record have been expunged. Accessing or disclosing an expunged record without a court order is itself a class B misdemeanor, with narrow exceptions for law enforcement investigations, applications to law enforcement agencies, and limited criminal justice uses like determining diversion-program or concealed-carry eligibility.6Delaware Code Online. When an expungement order is granted on a petition, all law enforcement and court records tied to the case must come out of public access within 60 days.2Justia. Delaware Code Title 11 4372 – Applicability, Definitions, Effect of Expungement

Where State Expungement Falls Short

Two gaps catch people off guard.

A Delaware expungement doesn’t automatically scrub your record from the FBI’s database. The state is supposed to notify the FBI and request deletion, but federal and state databases often sit out of sync, and federal arrest data only comes out at the submitting agency’s request or by federal court order.7FBI. Identity History Summary Checks Frequently Asked Questions If an expunged record still appears on a federal background check, contact the State Bureau of Identification to confirm the removal request went out.

For immigration purposes, an expunged conviction is still a conviction. USCIS policy is explicit that state actions to expunge, dismiss, or vacate a guilty plea or conviction under a state rehabilitative statute have no effect on the underlying conviction for immigration purposes.8USCIS. Policy Manual Volume 12 Part F Chapter 2 – Adjudicative Factors Officers can require original conviction records even after state expungement, and controlled substance offenses and crimes involving moral turpitude remain disqualifying. If you’re a noncitizen counting on expungement to solve an immigration issue, talk to an immigration attorney first.
