Denton County Marriage License: Fees, Waiting Period, and Expiration

To get a Denton County marriage license, both applicants must appear together at any of the six County Clerk branch offices with a qualifying photo ID, pay $81 (or $21 if you bring a Twogether in Texas premarital education certificate), and then wait 72 hours before the ceremony. The license is valid anywhere in Texas and expires 90 days after it is issued.

Who Can Apply

Both applicants must be at least 18 and currently unmarried. Parental consent does not substitute for age in Texas; anyone under 18 can only marry with a court order removing the disabilities of minority.1State of Texas. Texas Code Family Code Chapter 2 – The Marriage Relationship

If either of you was recently divorced, Texas law prohibits remarriage until the 31st day after the divorce decree is signed. The one exception: former spouses remarrying each other can do so immediately.2State of Texas. Texas Code Family Code 6.801 – Remarriage

What to Bring

Each applicant needs one ID that proves identity and age. A Texas driver’s license, U.S. passport, or certified birth certificate all work, and so do a current military ID, a foreign passport, federal immigration documents with a photo, a U.S. citizenship certificate, or school records in some cases. A driver’s license or state ID that expired within the past two years is still accepted.1State of Texas. Texas Code Family Code Chapter 2 – The Marriage Relationship

You do not need to bring your Social Security card, but you will be asked to write your Social Security number on the application if you have one. Have the full names and birthplaces of both sets of parents ready; the application asks for them.

Fees

The standard fee is $81. Couples who complete the state’s Twogether in Texas premarital education course pay $21 instead, a $60 savings.3Denton County, TX. To claim the discount, bring the completion certificate to the clerk’s office. It must have been issued within one year of your application date.

Where and How to Apply

You can pre-fill the application on Denton County’s online portal before you visit, or complete the whole thing at the counter. If you start online, both applicants must appear at the clerk’s office within three days. Miss that window and the application is deleted; you start over.5Denton County, TX. The 72-Hour Waiting Period

Texas law requires a 72-hour cooling-off period between the time the clerk issues the license and the ceremony. The clock starts at issuance, not when you submit the online application.6State of Texas. Texas Code Family Code 2.204 – 72-Hour Waiting Period

Four groups can skip the wait:

  • Active-duty members of the U.S. armed forces.
  • Department of Defense employees or contractors.
  • Couples who present a signed waiver from a judge with family law jurisdiction, a justice of the peace, or certain other judicial officers, issued for good cause.
  • Couples who present a Twogether in Texas completion certificate to the clerk.

The premarital course is the route most couples can actually use, and it is the one that also cuts the fee.

The 90-Day Expiration

A Denton County marriage license is valid anywhere in Texas, but it expires on the 90th day after issuance if the ceremony has not taken place.5Denton County, TX. If your wedding is months away, time the application so you are inside the 90-day window on the ceremony date.

When One Applicant Cannot Appear

If one applicant is 18 or older but physically unable to come to the clerk’s office, the other applicant, or any other adult, can apply on their behalf. The absent applicant provides a notarized affidavit and a copy of their qualifying ID, and the person appearing in person hands both to the clerk.7State of Texas. Texas Code Family Code 2-006 – Absent Applicant

If both applicants are absent, the clerk can issue a license only when both are armed forces members stationed in another country supporting combat or another military operation. In that situation, the person applying on each absent applicant’s behalf must submit an affidavit of the applicant’s military status. The same narrow military circumstance is the only basis for marriage by proxy in Texas, where a civilian physically stands in for the absent service member during the ceremony itself.8State of Texas. Texas Code Family Code 2-203 – Marriage by Proxy No other category of applicant qualifies.

After the Ceremony

Your officiant completes the ceremony date, county, and their own information on the license, signs it, and returns it to the Denton County Clerk within 30 days. Missing that deadline is a misdemeanor punishable by a fine of $200 to $500.9State of Texas. Texas Code Family Code 2-206 – Return of License Penalty The duty is on the officiant, not on you, but if the license is never returned, the marriage is not recorded. Following up is worth the two minutes, especially if a friend or family member is officiating.

Once the license is on file, you can order certified copies through the county’s Vital Statistics portal or by mail. A certified copy is $16 plus $1 per page; a non-certified copy is $1 plus $1 per page. Mail requests need both names as they appear on the license, the marriage date, and a cashier’s check or money order payable to Juli Luke, Denton County Clerk.10Denton County, TX.
