Do Food Stamps Put the Father on Child Support in California?

No. Receiving food stamps does not put the father on child support in California. CalFresh, the state’s food stamp program, has no requirement that you cooperate with child support enforcement and does not refer your case to any child support agency. If you apply only for CalFresh, no case will be opened against the other parent on account of your benefits.

The confusion is understandable, because a different California benefit program does trigger a child support case automatically. That program is CalWORKs, the cash aid program, and families often apply for both at the same time.

What Triggers a Child Support Case in California

CalFresh follows federal SNAP rules, and those rules do not include a blanket child support cooperation mandate. You can receive CalFresh for your children even when there is an absent parent and no support order exists. Nothing in the CalFresh application process sends your information to a child support agency.

CalWORKs is different. California law requires every CalWORKs applicant and recipient to cooperate with the county welfare department and the Local Child Support Agency (LCSA) in establishing paternity and securing a support order for any child with an absent parent, unless they qualify for a good cause exception.1California Legislative Information. California Welfare and Institutions Code 11477 Medi-Cal carries a similar cooperation requirement for medical support. CalFresh does not.

So the practical rule is simple. If your household is on CalFresh only, the father is not pulled into a child support case because of your benefits. If you add CalWORKs to the picture, the CalWORKs side of the application is what starts the process.

What Happens If You Apply for CalWORKs Too

When you apply for CalWORKs for a child with an absent parent, the county welfare department is required to refer your case to the LCSA.2California Department of Social Services. All County Letter 07-51 The referral is automatic. You cannot opt out unless good cause applies.

From there, the LCSA takes over the child support side of the case. The agency works to locate the noncustodial parent, establish paternity if needed, and get a court order for child support and health insurance coverage.3Legal Information Institute. California Code of Regulations Title 22 Section 112150 – Case Processing CalWORKs Referrals Your welfare caseworker still handles benefits eligibility; the LCSA caseworker handles the support order. Two agencies, two tracks, one triggered the other.

As part of CalWORKs, you also assign your rights to child support collected to the state while you are on aid. The state keeps a share to offset the cost of the cash grant and passes a portion through to the family.4Santa Clara County Social Services Agency. Good Cause: Getting Excused From Cooperation

If you are on CalWORKs and pursuing child support would put you or your child at risk, you can ask to be excused. California recognizes good cause in several situations:5California Legislative Information. California Welfare and Institutions Code 11477.04

  • Pursuing support would increase the risk of physical, sexual, or emotional harm to the child.
  • Contact with the other parent would increase the risk of abuse to the custodial parent or caretaker.
  • The child was conceived through rape or incest. No criminal conviction is required.
  • Legal adoption proceedings are underway, or you are working with an adoption agency.
  • You are cooperating in good faith but genuinely cannot identify or locate the other parent.
  • Other reasons it would not be in the child’s best interests to pursue support.

You can claim good cause when you first apply or at any point after a case has been opened. If you raise it later, the LCSA must suspend child support activity while the county evaluates your claim.6California Legislative Information. California Welfare and Institutions Code 11477.02 Tell your caseworker and submit form CW 51. Evidence such as police reports, restraining orders, or sworn statements from people familiar with your situation strengthens the claim, though the county evaluates each case on its own facts.7California Department of Social Services. Form CW 51 – Good Cause Claim for Noncooperation

Even here, none of this applies to CalFresh. The good cause process exists because CalWORKs forces the cooperation question in the first place. If you are only on CalFresh, there is nothing to be excused from.

If Child Support Does Get Collected, How It Affects Your CalFresh

CalFresh counts child support received as household income, whether it comes directly from the other parent or as a pass-through payment from the LCSA. More support means a smaller CalFresh allotment, since benefits are calculated from income after certain deductions.

CalWORKs families should know one specific wrinkle. California passes through up to $100 per month to a family with one child and up to $200 per month to a family with two or more children when support is collected.4Santa Clara County Social Services Agency. Child Support – CalWORKs That pass-through does not reduce the cash grant, but it does count as income for CalFresh.8San Francisco Human Services Agency. Opening a Case on Your Own

If you want a child support order and you are not on CalWORKs, you do not need any benefit program to start one. California law requires every LCSA to provide child support services to anyone who requests them, whether or not they receive public assistance.9California Legislative Information. California Family Code 17400 Either parent or a legal guardian can enroll through the California Department of Child Support Services. The agency locates the other parent, establishes paternity, and pursues a court order. There is no cost, and because you are not on cash aid, you keep everything that gets collected.
