Do I Need a Business License in Nevada: Costs, Exemptions, and Renewal

If you are starting or running a for-profit business in Nevada, you almost certainly need a business license — in fact, you likely need two. The Secretary of State issues a State Business License that every entity doing business in Nevada must hold, and nearly every city and county adds its own local license on top. The state fee is $200 a year for most entities and $500 for corporations, with narrow exemptions for nonprofits and very small home-based operations.

Who Has to Get the State Business License

Nevada law requires a State Business License before you conduct any business in the state.1Nevada Legislature. Nevada Revised Statutes 76.100 – State Business License Required; Application and Fee for License; Activities Constituting Conduct of Business “Conducting business” means any activity pursued for profit, whether you sell products, provide services, or solicit customers. The license covers the entity itself rather than a location, so one license works statewide.

The rule applies across entity types: LLCs, corporations, limited partnerships, sole proprietors, and general partnerships all fall under it. Sole proprietors and general partnerships sometimes assume they are off the hook because they never filed formation documents. They are not. The Secretary of State’s office specifically requires them to obtain either a State Business License or a Notice of Exemption before doing business.2Nevada Secretary of State. Who Is Exempt

Two groups can skip the license. Nonprofit organizations that qualify as tax-exempt under 26 U.S.C. § 501(c) do not need one.1Nevada Legislature. Nevada Revised Statutes 76.100 – State Business License Required; Application and Fee for License; Activities Constituting Conduct of Business

The second exemption is for very small home-based businesses. A person who operates a business from home and whose net earnings do not exceed 66⅔ percent of the average annual wage (calculated under NRS Chapter 612 and rounded to the nearest hundred dollars) falls outside the statutory definition of conducting business for licensing purposes.3Nevada Legislature. Nevada Revised Statutes Chapter 76 – State Business Licenses The wage figure changes yearly, so check the Secretary of State’s current threshold before assuming you qualify. If you do, you file a Notice of Exemption instead of paying the fee.

What the State License Costs

The annual fee depends on your entity type. Corporations pay $500. All other entity types — LLCs, partnerships, sole proprietors — pay $200.4Nevada Secretary of State. State Business License – FAQ

Those figures cover the license alone. If your entity is formed under NRS Title 7 (which includes LLCs and corporations), you also owe a separate fee for filing your Initial List of Officers or Members, due at the same time. The business license fee and the list fee are independent charges, and you need to budget for both.

Miss the renewal and a $100 late penalty attaches on top of the annual fee. If the business stays in default for a full year, the entity moves to revoked status and loses its legal authority to operate in Nevada.4Nevada Secretary of State. State Business License – FAQ Reinstating a revoked entity costs more time and money than paying on time, and the lapse becomes part of the public record.

You Will Also Need a Local License

The State Business License does not replace city or county licensing. Nearly every local jurisdiction in Nevada requires its own license based on where you physically operate or deliver services. In Clark County, a general business license application carries a one-time $45 application fee plus the license fee itself, which varies by activity type.5Clark County, NV. A Step-By-Step Guide to a General License If your address sits inside an incorporated city like Las Vegas, Henderson, or North Las Vegas, you file with that city rather than the county.

Zoning matters at this stage. Before signing a lease or converting a room at home into an office, confirm that the zoning for the location permits your business activity. The City of Las Vegas, for example, requires applicants to verify proper zoning and compliance before the license application moves forward.6City of Las Vegas. Does Your Field Require a Professional License Too?

Some occupations need a credential from a state regulatory board before you can practice, independent of both the Secretary of State and local licensing offices. Doctors, CPAs, real estate agents, and general contractors all fall into this category.

A general contractor, for example, must apply through the Nevada State Contractors Board, which evaluates applicants through written examinations, background checks, and financial-responsibility reviews.7Nevada State Contractors Board. How to Become a Licensed Contractor Contractors must also secure a surety bond set by the Board at anywhere from $1,000 to $500,000, depending on the license type, monetary limit, and the applicant’s track record.8Nevada State Contractors Board. If your field is regulated, the State Business License does not cover professional practice. You need all three layers running at once: state license, local license, and professional credential.

Tax Registrations That Often Get Missed

A business license is not a tax registration, and Nevada’s lack of a state income tax leads some owners to stop looking too soon. Two obligations trip people up.

Sales and Use Tax Permit

If you sell or lease tangible personal property or provide a taxable service in Nevada, you must register for a Sales/Use Tax Permit through the Nevada Department of Taxation. The permit costs $15 per location, and the seller’s permit must be posted at your place of business.9Nevada Department of Taxation. Register a Business FAQs You then collect sales tax from customers and remit it on the required schedule. Making taxable sales without this permit creates liability that compounds quickly.

Commerce Tax

Any business entity whose Nevada gross revenue exceeds $4 million in a taxable year owes Commerce Tax.10Nevada Legislature. Nevada Revised Statutes Chapter 363C – Commerce Tax The tax applies only to revenue above the $4 million threshold, and the rate depends on your industry category, ranging from about 0.051 percent for mining to 0.331 percent for rail transportation, with most service and retail businesses in between. The return is due 45 days after the fiscal year ends on June 30, which typically means a mid-August deadline.11Nevada Department of Taxation. Commerce Tax Most small businesses never reach the threshold, but if your revenue is climbing, this is the one to watch.

Federal EIN

Partnerships, LLCs, corporations, and any business with employees must obtain an Employer Identification Number from the IRS.12Internal Revenue Service. Employer Identification Number Sole proprietors without employees can use their Social Security Number, but most still get an EIN because banks, vendors, and state forms ask for it. The application is free and takes a few minutes on the IRS website.

Renewing Your License Every Year

The State Business License is annual. For entities formed under NRS Title 7, the renewal is due alongside your Annual List of Officers or Members, which falls on the last day of the anniversary month of your entity’s formation. The $200 or $500 license fee applies again each year, on top of the separate annual list fee.4Nevada Secretary of State. State Business License – FAQ

Local licenses run on their own calendars, which vary by jurisdiction. Some cities renew on a calendar-year basis; others use the anniversary of your original application. Keep a reminder for each. The state does send a 90-day advance notice before the filing deadline, but relying on it alone is risky. An outdated mailing address means you will not receive the notice, and the deadline will not wait.
