If you had no income during the year, you generally do not need to file California state taxes with no income to report. The Franchise Tax Board sets income thresholds based on your filing status, age, and dependents, and someone with zero earnings sits well below all of them. That said, a handful of specific situations can still create a filing obligation, and in many cases filing voluntarily is the only way to collect money the state is holding for you.
When the FTB Actually Requires a Return
The FTB applies two tests each year: one based on California gross income and one based on California adjusted gross income (AGI). You have to file if either number crosses the threshold for your filing status, age, and number of dependents.1Franchise Tax Board. Residents – Filing Requirements
For a single filer under 65 with no dependents, the 2025 gross income threshold is $22,941 and the AGI threshold is $18,353. The numbers rise with age, additional dependents, and joint filing. Zero income clears every version of this test, so if that’s your whole picture, the FTB does not require a return from you.
Situations That Trigger a Filing Even With No Income
A few circumstances pull you back into a filing obligation regardless of what you earned.
You Owe Use Tax
If you bought goods from an out-of-state or online seller and no California sales tax was collected, you likely owe use tax on items you use, store, or consume in California. The California income tax return is the standard place to report and pay it.2California Department of Tax and Fee Administration. California Use Tax, Good for You. Good for California
You Received Advance Premium Tax Credit Payments
If you or anyone in your household received advance payments of the health insurance premium tax credit through Covered California, you have to file a federal return to reconcile those payments on Form 8962, even if your income otherwise wouldn’t require it. If the advance payments exceeded the credit you actually qualified for, you’ll owe the difference.3Internal Revenue Service. Premium Tax Credit: Claiming the Credit and Reconciling Advance Credit Payments California requires a state return whenever you’re required to file federally, so this federal trigger pulls a California return along with it.4Franchise Tax Board. You Had HSA Activity
California does not conform to the federal rules for health savings accounts. Contributions you deducted federally have to be added back as California income, and distributions used for non-medical expenses are taxable in California.5Franchise Tax Board. 2025 Form 540 Booklet This adjustment alone can push someone who appears to have no California income above the filing threshold.
You Had California-Source Income as a Part-Year Resident or Nonresident
If you moved into or out of the state during the year, or you live elsewhere and received income from a California source such as rental property, the FTB generally expects a return. Even a small amount of California-source income can create the obligation.4Franchise Tax Board. Do You Need to File?
Why Filing Anyway Often Pays
For many people with no or low income, the practical question isn’t whether a return is required but whether skipping it leaves money with the state. Often, it does.
Refund of Withheld Taxes
If you worked at all, your employer almost certainly withheld California income tax from your paychecks. Filing a return is the only way to get that money back. This is the single most common reason low-income Californians file voluntarily.4Franchise Tax Board. Do You Need to File?
California Earned Income Tax Credit
CalEITC is refundable, meaning it pays out even if you owe zero state tax. For the 2025 tax year, you qualify if you earned between $1 and $32,900. The credit ranges from a maximum of $302 with no qualifying children to $3,756 with three or more qualifying children.6Franchise Tax Board. Eligibility and Credit Information You have to file and claim it to receive it. Note the floor: a filer with truly $0 in earned income does not qualify.
Young Child and Foster Youth Tax Credits
Two more refundable credits stack on CalEITC. The Young Child Tax Credit provides up to $1,189 if you qualify for CalEITC and have a child under six. The Foster Youth Tax Credit offers the same amount to current and former foster youth ages 18 to 25 who qualify for CalEITC and were in California foster care at age 13 or older.6Franchise Tax Board. Federal Credits
Filing the California return typically goes alongside a federal return, which has its own refundable credits. The federal Earned Income Tax Credit for tax year 2026 reaches up to $8,231 for filers with three or more qualifying children.7Internal Revenue Service. What Happens if You Should File and Don’t
California’s late filing penalty is 5% of the unpaid tax per month, capped at 25%. If your balance due is $540 or less, a minimum penalty of $135 or 100% of the tax due (whichever is less) applies instead.8Franchise Tax Board. Common Penalties and Fees When you owe nothing, the percentage-based penalty is zero, so there’s no sting from the standard late filing penalty alone.
The real risk shows up when the FTB believes you had unreported income. It can issue a Request for Tax Return and then a formal Demand for Tax Return. Ignoring the demand triggers a 25% penalty on whatever amount the FTB assesses, and interest accrues the whole time you’re trying to prove the assessment wrong.8Franchise Tax Board. Common Penalties and Fees If you genuinely had no income, responding to any FTB notice quickly keeps the situation from escalating.
Deadlines if You Decide to File
California returns for the 2025 tax year are due April 15, 2026. The state automatically extends your filing deadline to October 15, 2026 with no application needed, though any tax owed is still due April 15.9Franchise Tax Board. How to File Without Paying for Software
The FTB’s CalFile tool lets you e-file your state return directly at no cost. Your AGI has to be above $0 and within program limits, and you must take the standard deduction.11Franchise Tax Board.
