A first DUI in Pennsylvania does not always cost you your license. If your blood alcohol content was in the lowest tier (.08% to .099%) and you have no prior offenses, your driving privileges stay intact. Once your BAC reaches .10% or higher, or the arrest involves drugs or a refused chemical test, you face a 12-month suspension. So the honest answer to whether you lose your license for a first DUI in PA is: it depends almost entirely on your BAC reading and whether you took the test.1Pennsylvania General Assembly. How Your BAC Decides the Suspension
Pennsylvania sorts DUI offenses into three tiers based on the alcohol in your system within two hours of driving. For a first offense, the license consequences break down like this:
- General Impairment, .08% to .099% BAC: no license suspension.
- High BAC, .10% to .159%: 12-month suspension.
- Highest BAC, .16% or above, or any controlled substance DUI: 12-month suspension.
The suspension length is the same at the top two tiers, but the criminal penalties attached to them are not. That distinction matters when a prosecutor decides what to charge and whether to offer you a diversion.2Commonwealth of Pennsylvania. DUI Legislation
What Refusing the Breath or Blood Test Does
Pennsylvania’s implied consent law treats driving on its roads as automatic agreement to a chemical test when an officer has reasonable grounds to believe you are impaired. Refuse that test, and PennDOT imposes a 12-month suspension on its own, regardless of whether you are ever convicted of DUI. It is a civil penalty for the refusal itself.3Pennsylvania General Assembly. Pennsylvania Code 75 1547 – Chemical Testing to Determine Amount of Alcohol or Controlled Substance
Refusing does not help the way people often assume. You draw the same 12-month suspension you would have gotten at the High or Highest BAC tier, prosecutors can still bring DUI charges using other evidence, and you lose access to the shorter suspension terms available through the ARD program. A refusal also triggers an ignition interlock requirement once your license is restored.4Commonwealth of Pennsylvania. Ignition Interlock FAQs
How ARD Can Shrink or Eliminate the Suspension
Accelerated Rehabilitative Disposition is a pre-trial program for first-time DUI offenders. You complete a supervision period of six to 12 months, attend alcohol highway safety school, undergo a drug and alcohol evaluation, pay court costs, and in some cases perform community service.5Pennsylvania Liquor Control Board. DUI Arrest in Pennsylvania In exchange, the suspension drops sharply:
- BAC below .10%: no suspension.
- BAC .10% to .159%: 30 days instead of 12 months.
- BAC .16% or higher, unknown BAC, or drug-related DUI: 60 days instead of 12 months.
Finish ARD successfully and you can petition the court to expunge the arrest, so there is no conviction and, after expungement, no permanent record of the arrest.6Montgomery County, PA. Accelerated Rehabilitative Disposition (ARD) Program ARD is not automatic. The prosecutor decides whether to offer it, eligibility rules vary by county, and the DUI generally cannot have involved an accident causing serious injury. Fail to complete the requirements and you land back on the standard conviction track with full penalties.
The Ignition Interlock Requirement After Restoration
Every first-offense DUI conviction in Pennsylvania also carries a one-year ignition interlock requirement, which begins when your license is restored, not when your suspension starts.2Commonwealth of Pennsylvania. DUI Legislation The device is a breathalyzer wired into your car’s ignition; blow above a preset limit and the vehicle will not start.
Interlocks must be installed on every vehicle you own, operate, or lease. Leasing the device for a year runs around $1,200, covering installation, monthly calibration visits, and removal. When the interlock period ends, your vendor sends PennDOT a Declaration of Compliance confirming no violations in the final two months (30 days for ARD cases) before the restriction comes off.7Commonwealth of Pennsylvania. Driving Legally During the Suspension
You cannot get a standard Occupational Limited License for a DUI-related suspension. PennDOT excludes DUI suspensions from OLL eligibility entirely.8Commonwealth of Pennsylvania. Occupational Limited License FAQs The alternative is the Ignition Interlock Limited License, created by Act 33 of 2016 specifically for drivers suspended for a DUI conviction or a chemical test refusal.7Commonwealth of Pennsylvania. The IILL lets you drive interlock-equipped vehicles during part or all of your suspension. You must have the device installed on every vehicle you plan to drive before applying, then submit Form DL-9108 with the required fees and documentation by certified mail.9Pennsylvania Department of Transportation. Commercial Drivers Face a Separate Federal Hit
If you hold a CDL, a first DUI conviction in Pennsylvania triggers a one-year federal disqualification from operating any commercial motor vehicle, even if you were driving your personal car when arrested. Hauling hazardous materials at the time pushes it to three years. A second DUI-related conviction brings a lifetime CDL disqualification.10eCFR. 49 CFR 383.51 – Disqualification of Drivers These federal consequences stack on top of the state suspension described above. The CDL alcohol threshold is also lower: a BAC of .04% while operating a commercial vehicle is enough.
Getting Your License Back
Restoration is not automatic. About 30 days before your suspension ends, PennDOT mails a restoration requirements letter to the address on file. You can also request the letter online if you want it earlier.11Commonwealth of Pennsylvania. Request a Driver’s License Restoration Requirements Letter
The letter spells out the restoration fee, set by law and adjusted every two years based on the Consumer Price Index, along with anything else you still owe. Pennsylvania does not require SR-22 insurance filings; you need standard liability coverage, but no special high-risk certificate with the state.
If your suspension involved a High or Highest BAC conviction, a controlled substance violation, or a test refusal, the interlock device has to be installed before your driving privileges are fully restored.4Commonwealth of Pennsylvania. Ignition Interlock FAQs Plan for the device staying on your car for a full year after restoration, not during the suspension itself.
