Do You Need a Permit to Have a Yard Sale in Texas?

You do not need a state permit to have a yard sale in Texas, but many Texas cities require a local permit before you can put items out on your driveway. Whether a permit applies to you depends on your city’s ordinance, and separately on your HOA rules, how much you sell, and what you’re selling.

City Rules Are Where the Permit Question Gets Answered

Texas leaves yard sale regulation to municipalities, and the answer changes block by block depending on which city line you’re on. Dallas requires an approved permit before a single item goes out for sale.¹ San Antonio runs a structured permit system through its Development Services Department, capped at one sale per quarter.² Houston, which has no traditional zoning, does not require a yard sale permit at all.

Before you print signs, look up your city’s ordinance or call the municipal clerk. That single step tells you whether a permit is required, how much it costs, and how many sales you’re allowed each year.

What a City Permit Usually Involves

Cities that require permits tend to write similar rules, with the numbers shifting from town to town.

Frequency. Saginaw allows two sales per calendar year per address.³ Crowley allows three within any 12-month period.⁴ San Antonio allows up to four, one per quarter.² The caps keep residential blocks from becoming permanent storefronts.

Duration. Most permits cover a maximum of three consecutive days.³

Fees. Richardson charges nothing.⁵ Crowley charges $5.⁴ Saginaw charges $10 and includes three signs.³ San Antonio charges $16.⁶ Crandall waives its $5 fee if you apply online.⁷

Signs. Cities generally forbid attaching sale signs to utility poles, traffic signs, or public property, and some issue standardized signs with the permit. In Crowley the sign itself is the permit, so losing it means operating without one.⁴

Penalties. San Antonio sets fines of up to $50 for the first two violations and up to $500 for each one after that.⁸ The fine is often less painful than a code enforcement officer shutting your sale down at 10 a.m.

How to Apply

Applications ask for your name, the sale address, and the dates and hours. San Antonio also requires a photo ID and, for tenants, proof of residency such as a utility bill.⁶ Many cities take applications online; some still want you at city hall in person.

Once approved, most cities want the permit visible from the street or ready to show a code officer.⁶ San Antonio offers a rain check: if weather ruins your permitted date, you can request one rescheduled permit per calendar year, provided you ask within a week and hold the makeup sale within 30 days.² Ask your city whether it offers the same.

Your HOA Can Say No Even if the City Says Yes

A city permit does not override your homeowners association. Many Texas subdivisions are governed by a Declaration of Covenants, Conditions, and Restrictions that can restrict or ban individual yard sales outright. Texas law protects some homeowner activities from HOA interference, like displaying flags or installing solar panels, but yard sales are not on that list.⁹

Under Texas Property Code Section 202.004, a court can assess civil damages of up to $200 per day for each violation of a valid covenant.⁹ Read your governing documents before you post a sign. Some associations organize community-wide sale weekends as an alternative.

Do You Have to Collect Sales Tax?

Usually not. Texas has an occasional sale exemption that covers most household yard sales, so the 6.25% state sales tax does not apply.¹⁰ You qualify if you meet either of these two tests:¹¹

You sell only one or two taxable items during any rolling 12-month period. Price is irrelevant.
You sell items originally bought for personal or family use, and your total sales stay at or under $3,000 in a calendar year. You can sell any number of individual items under this test.

The personal-use test is the one that fits a typical yard sale clearing out furniture, clothes, and kitchen items. Every item must have been originally purchased for personal use. Inventory you bought specifically to resell does not qualify.¹²

The exemption also does not cover coordinated events like flea markets or arts and crafts shows where you pay a booth fee or commission to a third-party organizer.¹¹

If you go over $3,000 in personal-use sales, start buying items to resell, or hold sales often enough to be considered engaged in business, you need a Texas Sales and Use Tax Permit.¹³ The permit is free and issued through the Comptroller’s eSystems portal, with roughly two to three weeks to receive it. Operating without one when you should have it exposes you to back taxes, penalties, and interest.

What You Should Not Put on the Table

Federal law prohibits offering any recalled consumer product for sale, and that includes yard sales. Section 19 of the Consumer Product Safety Act makes it unlawful.¹⁴ The riskiest categories are children’s products and baby gear. The CPSC also warns against selling broken or wobbly nursery furniture or infant products with missing parts, even absent a formal recall.¹⁵ Search the CPSC recall database at cpsc.gov before you price any crib, car seat, or stroller.

Homemade food is allowed under Texas cottage food law without a separate permit or license, sold directly to consumers at your home. Every item must carry a label with the producer’s name and address, common food allergens, and a statement that the food was made in a home kitchen not inspected by health authorities. Meat, dairy, fish, and any product requiring temperature control for safety are off limits.¹⁶

You Are Responsible for Shopper Safety

When you invite strangers to shop at your home, Texas premises liability law treats them as invitees, since they’re there for a transactional purpose that benefits you. Invitees are owed the highest duty of care: you must take reasonable steps to find and fix hazards, not just warn about ones you already know.

Walk the sale area before you open. Look for extension cords across walkways, uneven pavement, loose steps, and unstable stacks of merchandise. Homeowner’s insurance generally covers injuries to visitors, but call your agent to confirm a yard sale does not trigger any exclusion for commercial activity on residential property. Five minutes on the phone now is cheaper than a claim later.
