SNAP Purchases Are Tax-Free
Anything you buy with SNAP benefits (formerly food stamps) is exempt from all sales tax in Alabama, state and local. Federal law requires this: under the Food Security Act of 1985, a state that taxes SNAP transactions loses access to the program. Alabama’s statute acknowledges the exemption exists “in response to the coercive threat of Congress.”6Alabama Legislature. Alabama Code 40-23-4.2 – Food Stamp Purchases Exempt
For split transactions, sales tax applies only to the portion you pay with cash or card, not the portion covered by SNAP.7Food and Nutrition Service. SNAP Retailer Notice – Sales Tax, Fees, and Refunds
Vending Machines, Vitamins, and Farm-Direct Sales
Food sold through vending machines carries a 3% state sales tax rate, separate from both the general 4% and the 2% grocery rate. Alabama Code 40-9-27 – Prescriptions for Vitamins and Dietary Supplements A doctor’s recommendation at the pharmacy counter isn’t enough; the professional must dispense the product directly.
