How the Rate Gets Calculated

Tax-exempt organizations such as qualifying nonprofits and government agencies can register their status through eBay’s buyer exemption system by uploading a valid exemption certificate. What Sellers Still Have to Do
eBay collecting the tax doesn’t free California sellers from every obligation. Anyone making three or more sales of tangible personal property in a 12-month period generally needs a California seller’s permit, whether the sales happen online, at a flea market, or in a shop.9California Department of Tax and Fee Administration. If you also sell on other platforms, through your own website, or at in-person events, eBay’s collection covers only what actually goes through eBay. Sales anywhere else are yours to handle: collecting the right rate, filing, and remitting.
Income Tax Reporting Is a Separate Issue
Sales tax and income tax are different obligations, and eBay’s role in one doesn’t affect the other. eBay’s payment processor issues a Form 1099-K when your account exceeds $20,000 in gross payments and more than 200 transactions in a calendar year. Getting a 1099-K doesn’t automatically mean you owe income tax on the whole amount. Selling used personal items at a loss usually doesn’t create taxable income, though you still report the 1099-K on your return and explain the difference.
