Florida does not have a paid family leave program. No state law requires private employers to give you paid time off for a new baby, your own serious illness, or a family member who needs care. Your federal rights under the Family and Medical Leave Act give you up to 12 weeks of unpaid, job-protected leave if you qualify, and getting paid during that time depends on your own accrued leave, short-term disability insurance, or whatever benefits your employer has chosen to offer.
Why Florida Has No State Program
Florida has never enacted a paid family leave mandate for private-sector workers, and the legislature has blocked local governments from creating one. Under Florida Statute 218.077, cities and counties cannot require private employers to provide employment benefits beyond what state or federal law already mandates, and that preemption is written broadly enough to cover paid sick leave, vacation, and any other form of paid time off.1Online Sunshine. Florida Statutes 218.077 – Wage and Employment Preemption
Attempts to expand paid parental leave even for state workers have repeatedly died in committee without a floor vote.2Florida Senate. SB 220 – Paid Parental Leave If you are waiting for a Florida version of the payroll-funded programs that operate in some other states, there is nothing in motion.
The 2023 Voluntary Insurance Law Does Not Give You Benefits
You may have seen references to a 2023 Florida paid family leave law. Read the fine print before you count on it. The law does not require any employer to buy these policies, and the bill’s own legislative analysis stated plainly that it “does not create a right to paid family leave benefits for employees not otherwise eligible under FMLA.”5Florida Senate. What FMLA Gives You in Florida
The federal Family and Medical Leave Act is the actual floor of leave rights for most Florida workers. It provides eligible employees up to 12 workweeks of unpaid, job-protected leave in a 12-month period.6U.S. Department of Labor. Family and Medical Leave Act Qualifying reasons include the birth or adoption of a child, your own serious health condition, and caring for a spouse, child, or parent with a serious health condition.7U.S. Department of Labor. FMLA Frequently Asked Questions
You qualify if you meet three conditions:
- You have worked for your employer for at least 12 months.
- You have logged at least 1,250 hours during those 12 months.
- You work at a location where your employer has 50 or more employees within 75 miles.
The 50-employee threshold is the one that leaves the most Florida workers out. FMLA applies to private employers that meet it, and to all public agencies and public or private elementary and secondary schools regardless of size.6U.S. Department of Labor. Family and Medical Leave Act If you work for a small business that does not clear 50 employees locally, FMLA does not cover you at all.
The definition of “child” is broader than many people assume. You do not need a biological or legal tie. A grandchild, stepchild, or partner’s child you are raising with day-to-day caregiving responsibilities generally counts, because you stand in the role of a parent.8U.S. Department of Labor. Fact Sheet 28B – Using FMLA Leave When You Are in the Role of a Parent to a Child
Military Family Leave
If you are the spouse, child, parent, or next of kin of a current servicemember or recent veteran with a serious injury or illness, FMLA allows up to 26 workweeks of leave in a single 12-month period. “Recent veteran” means discharged within the past five years.9U.S. Department of Labor. Fact Sheet 28M – Using FMLA Leave Because of a Family Members Military Service This is separate from and larger than the standard 12-week allowance.
Notice to Your Employer
When your leave is foreseeable, such as a planned surgery or an expected due date, give your employer at least 30 days’ advance notice. If 30 days is not possible because circumstances change or there is a medical emergency, notify your employer as soon as practicable.10U.S. Department of Labor. Family and Medical Leave Act Advisor – Timing of Employee Notice An employer can delay the start of your leave if you had time to plan and did not say anything.
Job and Health Insurance Protection
FMLA leave is unpaid, but it is job-protected. Your employer must continue your group health coverage on the same terms as if you were still working, and you keep paying your usual share of the premium.11U.S. Department of Labor. Fact Sheet 28A – Employee Protections Under the Family and Medical Leave Act When your leave ends, you have the right to return to the same position or an equivalent one in pay, benefits, and working conditions.
Retaliation for taking FMLA leave is illegal. That goes beyond firing. Using your leave as a negative factor in a promotion decision, discouraging you from taking it, counting FMLA absences under a no-fault attendance policy, or juggling your schedule to avoid FMLA obligations all violate federal law.12Office of the Law Revision Counsel. 29 USC 2615 – Prohibited Acts If your rights are interfered with, you can file a complaint with the Department of Labor’s Wage and Hour Division or bring a private lawsuit.
How to Get Paid During Your Leave
Since FMLA itself pays nothing, keeping money coming in is the real planning problem. There are three practical sources, and most people combine them.
Accrued paid leave. Federal regulations let you substitute accrued paid leave, including vacation, sick time, or PTO, for unpaid FMLA leave, and your employer can require you to do so. When paid leave runs concurrently with FMLA, you receive your normal paycheck while both balances tick down together.13eCFR. 29 CFR 825.207 – Substitution of Paid Leave Once accrued time runs out, the remaining FMLA weeks are unpaid.
Short-term disability insurance. Florida does not run a state disability insurance program, but many Florida employers offer private short-term disability as a workplace benefit, and you can buy an individual policy on your own. These policies typically replace 40% to 70% of salary for a limited period, from a few weeks to several months. They cover your own medical events, including recovery from surgery, serious illness, and childbirth, but they do not cover time off to care for a family member.
Employer-provided paid leave. Any paid parental or family leave benefit you receive in Florida exists because your employer chose to offer it. Check your employee handbook or benefits portal for:
- PTO or vacation accrual balance, and whether you can use it during FMLA leave
- A paid parental leave policy, the number of paid weeks, and whether it applies equally to birth and non-birth parents
- Whether your employer provides or subsidizes short-term disability coverage, the percentage of salary it replaces, and the benefit period
- Whether your employer has purchased a voluntary paid family leave policy under the 2023 Florida insurance framework
If your employer promises a paid leave benefit in a written policy, it must be applied consistently to all eligible workers in your class.
If You Work for the State of Florida
State government is the one Florida employer with a paid parental leave benefit built into law. Effective December 11, 2023, eligible employees within the State Personnel System receive seven weeks of paid maternity leave for a birth mother’s recovery and two weeks of paid parental leave available to both mothers and fathers following a birth or adoption.14MyBenefits – Florida Department of Management Services. Paid Parental Leave
To qualify, you need at least one year of cumulative service within the State Personnel System during the previous seven years and at least 1,250 hours worked in the 12 months before your leave starts. All parental leave combined, paid and unpaid, cannot exceed six months within the first year after the birth or adoption. The benefit applies only to Career Service, Selected Exempt Service, and Senior Management Service employees.14MyBenefits – Florida Department of Management Services. Paid Parental Leave
Taxes on Paid Leave Benefits
If you do end up receiving paid family leave through an insurance policy or similar benefit, plan for the tax hit. The IRS confirmed in Revenue Ruling 2025-4 that family leave payments count as gross income, whether they come from a state program or a private insurer.15Internal Revenue Service. Revenue Ruling 2025-4 These payments are not treated as wages for Social Security, Medicare, or federal unemployment tax, so no FICA is withheld, but you will owe income tax when you file. If benefits exceed $600 in a year, the payer must issue a Form 1099.
Accrued PTO or sick leave you use during FMLA is handled as normal wages, with income tax, Social Security, and Medicare withheld on your regular paycheck. The planning concern is mostly for benefits paid through a separate insurance policy, where nothing is withheld at the source.
