Does Florida Have Tax on Food? Groceries, Restaurants, and SNAP

Florida does have a tax on food, but only on some of it. The state’s 6% sales tax, plus any county surtax, applies to prepared meals, hot food, ready-to-eat items, soft drinks, and alcohol. The Test That Decides Whether Food Is Taxed

Florida’s sales tax statute exempts “food products for human consumption” as the general rule, then carves out specific taxable categories.1Florida Legislature. Is it sold in a form meant to be eaten right away? If either answer is yes, expect to pay tax. If the food is raw, chilled, or packaged for you to prepare at home, expect no tax.

The state rate is 6%, and most counties add a discretionary surtax that can run from 0.5% up to 3% in 2026.2Florida Department of Revenue. Grocery Food That Is Tax-Free

Unprepared food bought at a grocery store, supermarket, or convenience store for home preparation is exempt. The Florida Department of Revenue’s grocery list covers bread and flour products, cereal, milk and dairy, eggs, fresh produce, uncooked meat and poultry, canned goods, and frozen foods.3Florida Department of Revenue. Juice and water need a closer look. Natural fruit and vegetable juices that are 100% juice are exempt. Anything labeled as an “ade,” “cocktail,” “drink,” or “beverage” is treated as a taxable soft drink, even when it contains real juice.3Florida Department of Revenue. Food That Gets Taxed

The exemption drops away as soon as food is prepared or heated for immediate eating. The main taxable categories:

There is one useful nuance. Food that was prepared off the seller’s premises and sold in its original sealed container stays exempt, and so does food that has only been sliced into smaller portions. A pre-packaged salad made at a separate facility and sold sealed at a grocery store can qualify for the exemption; a salad assembled behind the deli counter does not.1Florida Legislature. Bakeries and the Seating Rule

Once a bakery has tables, chairs, or other eating facilities, the treatment splits. Items eaten on the premises are taxable. Baked goods you buy to take home stay exempt, so long as they aren’t hot from the oven.1Florida Legislature. Restaurants, Food Trucks, and Catering

Meals from restaurants, food trucks, and lunch counters are taxable across the board, and Florida’s statute does not distinguish between eating in and taking food home when the business ordinarily sells food for immediate consumption.5Florida Department of Revenue. Catering works the same way, with an extra wrinkle for the invoice. Service charges, setup fees, minimum charges, and corkage fees added by a caterer or restaurant are all included in the taxable sales price.5Florida Department of Revenue. A narrow exception exists for restaurants that run a separate grocery department with its own records. Tax-exempt grocery items sold from that department can be sold without collecting tax.5Florida Department of Revenue. Groceries Paid For With SNAP

If you pay with SNAP benefits, no sales tax applies to the SNAP-funded portion of the purchase, even for items that would ordinarily be taxable. Federal rules prohibit any state from collecting a sales tax, excise tax, or fee on eligible food bought with SNAP.8eCFR. 7 CFR 272.1 – General Terms and Conditions When a purchase is split between SNAP and cash, only the cash portion can be taxed.

Delivery Fees on Grocery Orders

Delivery doesn’t change how the food is taxed. Exempt groceries stay exempt whether you carry them out yourself or have them dropped at your door. The fee is where it varies. Florida generally taxes delivery charges when they’re part of the sale of a taxable item, but a separately stated delivery charge that you could avoid by picking up the order yourself is not subject to tax.9Florida Department of Revenue.
