Does IHSS Count as Income for Food Stamps in California?

Yes. IHSS wages count as income for food stamps in California: the CalFresh program treats them as earned income, the same as pay from any other job. The upside is that earned income gets a flat 20% deduction before the county calculates your benefit, so only 80 cents of every IHSS dollar actually hits the eligibility math.1eCFR. 7 CFR 273.9 – Income and Deductions

How CalFresh Counts Your IHSS Pay

The California Department of Social Services classifies IHSS payments as earned income because the money is compensation for work, not a government benefit.2Los Angeles County Department of Public Social Services ePolicy. CalFresh Treatment of In-Home Supportive Services Income That classification holds whether you commute to the recipient’s home or live there, and whether or not you’re related to the person you care for.

Earned income is the better bucket to be in. Federal SNAP rules take 20% off gross earnings before anything else happens.1eCFR. 7 CFR 273.9 – Income and Deductions If your IHSS gross is $2,000 a month, the county works with $1,600. Unearned income like SSI or Social Security gets no equivalent deduction, so if you receive both, the IHSS portion is treated more favorably than the rest.

After the earned-income deduction, the county subtracts a standard deduction based on household size, plus any dependent care costs and an excess shelter deduction for rent or mortgage above half of your adjusted income. Your net income after all of this is what sets your actual benefit amount.

The Tax Exclusion Does Not Apply to CalFresh

This trips up a lot of providers. If you live with the person you care for, you can exclude your IHSS wages from federal and state income tax under IRS Notice 2014-7, which treats qualifying Medicaid waiver payments as difficulty-of-care payments under Section 131 of the Internal Revenue Code.3Internal Revenue Service (Taxpayer Advocate Service). None of that changes how CalFresh sees the money. The SOC 2298 exclusion is a federal and state income tax rule; it does not remove the wages from your CalFresh income calculation, and it does not exempt you from Social Security or Medicare taxes either.6California Department of Social Services. Living With the Person You Care For

If you share a home with the IHSS recipient, there’s a separate question that often matters more than the tax one: are you one CalFresh household or two? The rule turns on food, not caregiving. If you buy and prepare meals together, the county combines everyone’s income and expenses into a single household. If you shop and cook separately, you can apply as your own one-person household even at the same address.

The difference can be large. On your own, your IHSS wages (minus the 20%) are measured against the one-person limit. Combined, the recipient’s SSI or Social Security gets added in, which can push the household over the limit or shrink the benefit. When you apply or recertify, tell your eligibility worker clearly how food is purchased and prepared in the home. A short written statement is usually enough; separate grocery receipts don’t hurt.

CalFresh Income Limits for 2026

Your gross monthly income has to fall below a limit that scales with household size. For the federal fiscal year running October 2025 through September 2026:7County of San Diego. Income Limits

  • 1 person: $2,610
  • 2 people: $3,526
  • 3 people: $4,442
  • 4 people: $5,360
  • 5 people: $6,276
  • 6 people: $7,192
  • 7 people: $8,110

California uses modified categorical eligibility for every CalFresh household, so there is no asset test. Savings and vehicles don’t disqualify you. Households with an elderly or disabled member are measured against a higher gross income threshold of 200% of the federal poverty level rather than the standard 130%.

How to Report IHSS Wages

Report your IHSS pay in the employment income section of whatever CalFresh form you’re filing. On the Semi-Annual Report (SAR 7), that’s Question 9, and the instructions name IHSS specifically as an example of employment income.8California Department of Social Services. SAR 7 Eligibility Status Report9California Department of Social Services. SAR 7 Eligibility Status Report Instructions Always use the gross amount from your pay stub, not the net direct deposit figure. CalFresh math starts with gross pay and applies the 20% deduction itself.

You can submit applications, SAR 7 forms, and pay stubs through the BenefitsCal portal at benefitscal.com, which lets you upload documents straight to your case file.10BenefitsCal. Application Process Overview Mailing paper forms to your county office works too, but it’s slower.

What Happens If You Don’t Report It

If the county later finds that you received more CalFresh than you were entitled to because IHSS income was missing or understated, you’ll owe the overpayment back, typically through a monthly reduction in your allotment. If you’re off benefits by then, the state can collect by other means, including federal tax refund intercepts. Intentional misreporting is a separate matter and carries disqualification periods under federal law, starting at one year for a first violation.11Office of the Law Revision Counsel. 7 USC 2015 – Eligibility Disqualifications The safe practice is to report gross IHSS wages every time, even if you believe the income is excluded for some other purpose, and let the eligibility worker apply the right deductions.
