Iowa has no estate tax, and as of January 1, 2025, it no longer has an inheritance tax either. The state eliminated its estate tax in 2005, and a four-year phase-out finished off the inheritance tax at the start of 2025. If you’re inheriting from someone who dies in 2026, Iowa itself collects nothing. The only death tax left in the picture is the federal estate tax, and it only reaches estates above $15 million. Older estates are a different story: if the person died before January 1, 2025, Iowa’s inheritance tax rules still apply to that estate in full.
The Federal Estate Tax Can Still Reach Large Estates
For deaths in 2026, a federal estate tax return is only required once the estate exceeds $15 million. That exemption was set by the One, Big, Beautiful Bill Act, signed July 4, 2025, which amended the basic exclusion amount under Section 2010(c)(3) of the Internal Revenue Code.1Internal Revenue Service. What’s New – Estate and Gift Tax Amounts above the exemption are taxed at rates up to 40%.
Married couples can effectively double the shelter through portability. When the first spouse dies, the survivor can elect to absorb any unused portion of the deceased spouse’s $15 million exemption, protecting up to $30 million combined. The election requires filing Form 706 for the first spouse’s estate, even when no tax is owed.1Internal Revenue Service. What’s New – Estate and Gift Tax Skipping that filing forfeits the unused exemption permanently.
Older Estates: Iowa Inheritance Tax for Deaths Before January 1, 2025
The repeal is not retroactive. If you’re administering an estate for someone who died before January 1, 2025, you still file Form IA 706 and pay any inheritance tax owed, and you still file supplemental or amended returns when the facts change.2Iowa Department of Revenue. The return and payment are both due by the last day of the ninth month after the decedent’s death.3Iowa Legislature. Iowa Code 450.94 – Return, Determination, Appeal Late filing adds a 10% penalty on the tax due; late payment adds another 5%.4Justia Law. Iowa Code 421.27 – Penalties

The beneficiary, not the estate, is personally responsible for paying the tax on their share.6Department of Revenue. Introduction to Iowa Inheritance Tax
Who Owed the Inheritance Tax and Who Didn’t
Iowa’s inheritance tax was built around the beneficiary’s relationship to the decedent. Close family paid nothing. Others paid on a tiered schedule.
Fully Exempt
A surviving spouse, lineal ascendants (parents, grandparents), lineal descendants (children, grandchildren), and stepchildren and their descendants owed zero inheritance tax no matter how much they received.7Iowa Legislature. Iowa Code 450.9 – Individual Exemptions Qualified charitable, religious, and educational organizations under IRC Section 170(c) or 2055 were also fully exempt,8Iowa Administrative Code. 701 IAC 86.2 – Inheritance Tax Returns and Payment of Tax along with public libraries, hospitals, humane societies, and municipalities.
Taxed Beneficiaries
Non-exempt beneficiaries fell into four schedules with these base rates:9Iowa Legislature. Iowa Code 450.10 – Rate of Tax
- Schedule B (siblings, half-siblings, sons-in-law, daughters-in-law): 5% on the first $12,500 up to 10% on amounts over $150,000, with no exemption.
- Schedule C (aunts, uncles, nieces, nephews, cousins, friends, and other individuals): 10% on the first $50,000 up to 15% on amounts over $100,000, with no exemption.
- Schedule D (for-profit entities and non-qualifying organizations): a flat 15%.
- Schedule E (out-of-state charitable organizations): a flat 10%.
Those were the pre-phase-out rates. A 20% rate reduction was layered on each year from 2021 through 2024, so the actual rate owed depends on the year of death.10Iowa Legislature. Iowa Tax Rate Changes – Fiscal Topics A 2024 death, for example, owed only 20% of the base rate; by 2025, the tax was gone.
Life insurance proceeds paid directly to a named beneficiary and annuities from an employer pension or retirement plan were excluded from the gross estate, though they still had to be reported on the return.
Why Old Inheritance Tax Liens Still Show Up on Iowa Real Estate
Iowa’s inheritance tax attached automatically as a lien on all property in a decedent’s estate from the moment of death. No recording was needed for the lien to be valid, and it took priority over any mortgage or sale that happened afterward.11Justia Law. Iowa Code 450.7 – Lien of Tax
The lien runs for ten years from the date of death.11Justia Law. Iowa Code 450.7 – Lien of Tax So an estate from 2018 that was never properly wrapped up carries a lien on the Iowa real estate until 2028. Title companies catch this, and it can stall a sale or refinance. Clearing the lien means filing the inheritance tax return and either paying what’s owed or showing that no tax is due. Once the Department of Revenue has full payment or confirms no liability, it issues an inheritance tax clearance that releases the property.6Department of Revenue. Introduction to Iowa Inheritance Tax
For deferred estates involving remainder or future interests, a beneficiary can pay the tax early based on the present value of the interest and remove the lien before the interest vests.12Justia Law. Iowa Code 450.52 – Deferred Estates, Removal of Lien
For deaths on or after January 1, 2025, the inheritance tax chapter no longer applies, so no lien attaches in the first place. Property inherited from someone who dies in 2026 or later passes free of any Iowa inheritance tax lien.
