Does Severance Pay Affect Unemployment in NY?

Severance pay can delay your New York unemployment benefits, but it usually doesn’t disqualify you. Two things decide whether severance affects your claim at all: when the first payment arrives relative to your last day of work, and how the weekly amount compares to the state’s current $869 maximum weekly benefit rate. Most people who receive severance wait a few extra weeks before benefits begin, then collect normally.

The 30-Day Timing Rule

If your first severance payment arrives more than 30 days after your last day of employment, it has no effect on your unemployment eligibility.1New York State Department of Labor. Dismissal or Severance Pay and Your UI Benefit P825 You can collect benefits for every week you otherwise qualify, no matter how large the package is.

The clock starts on your final day of work, not the day you signed the separation agreement and not the day you filed your claim. Some employers will structure severance to begin on day 31 or later if you raise it during negotiations, so it is worth asking. If the first payment lands inside that 30-day window, the next question is the weekly amount.

The $869 Weekly Threshold

New York raised its maximum weekly unemployment benefit from $504 to $869 effective the week of October 13, 2025, the first increase since 2019.2Department of Labor. What Is the Maximum Benefit Rate? That figure is the dividing line.

If your severance works out to $869 or less per week, you can still collect unemployment for those weeks. If the weekly amount is higher than $869, you are ineligible for benefits during the weeks the severance covers.1New York State Department of Labor. Dismissal or Severance Pay and Your UI Benefit P825 The comparison is simple when the employer pays weekly. A lump sum needs an extra step.

How Lump-Sum Severance Gets Converted to Weeks

When severance comes as a single lump sum, the Department of Labor converts it into weekly amounts to decide which weeks are blocked. If your separation agreement says how many weeks the lump sum is meant to cover, that number controls.3Department of Labor. Dismissal/Severance Pay and Pensions Frequently Asked Questions

If the agreement is silent, the Telephone Claims Center runs the math itself. The department divides the lump sum by your actual gross average weekly pay, or by the average weekly pay from your highest-earning calendar quarter in your base period, depending on which applies.1New York State Department of Labor. Dismissal or Severance Pay and Your UI Benefit P825 The result is how many weeks of pay the lump sum represents.

A quick example. You earned $1,200 a week and received a $6,000 lump sum. The state treats that as five weeks at $1,200. Because $1,200 is more than $869, you are ineligible for unemployment during those five weeks. After the five weeks run out, your benefits begin, subject to the waiting week below.

Asking for a lump sum instead of installments does not change the outcome. The department applies the same analysis either way.3Department of Labor. Dismissal/Severance Pay and Pensions Frequently Asked Questions

What Does Not Count as Severance

Not every dollar in your final paycheck is treated as dismissal pay. New York Labor Law ยง 591 separates severance from other post-employment compensation.4New York State Senate. Accrued vacation pay and holiday pay fall into that separate category. If your final check includes a severance package plus a payout for three unused weeks of vacation, only the severance portion gets measured against the $869 threshold. Keeping these amounts clearly labeled in your separation agreement helps the department process the claim correctly. If your pay stub lumps everything together, ask the employer for an itemized breakdown before you file.

File Now, Even If Severance Is Still Coming

File your initial claim as soon as you lose your job. The filing date establishes your claim, and the Department of Labor will determine when payments should start based on the severance details. Waiting until severance runs out before filing is one of the most common mistakes people make, and it can cost weeks of benefits on the back end.
