Utah does charge sales tax on services, but only on a short list of them written into state law. If a service isn’t on that list, no sales tax applies. The taxed categories include repairs to personal property, assisted cleaning and laundry, telecommunications, remotely accessed prewritten software, admissions to entertainment and recreation, and short-term lodging. Professional services, personal services performed on people, and work on real property stay off the list and off the tax.1Utah Legislature. Utah Code 59-12-103
The Rule: Taxable Only If Listed
Utah’s statute, Utah Code 59-12-103, works by exception. The legislature named the services it wanted to tax, and anything outside that list is exempt by default.2Cornell Law School. Utah Admin Code R865-19S-2 – Nature of Tax Pursuant to Utah Code Ann Section 59-12-103 This is the opposite of states that start from a presumption that services are taxable. The upside for Utah buyers and sellers is clarity: you can read the list. The downside is that small differences in how a service is delivered, or what it acts upon, can flip the answer entirely.
The clearest test comes from asking what the service works on. Work on tangible personal property is usually taxable. Work on a person, on real estate, or on pure information usually isn’t.
Services Utah Taxes
Repair and Renovation of Personal Property
Labor to repair or renovate tangible personal property is taxable, even when no parts are replaced.1Utah Legislature. Utah Code 59-12-103 A laptop repair, a jewelry resizing, a transmission rebuild: tax applies to the full service charge. Fabrication labor that produces a finished product is also taxable, including casting, machining, drilling, and assembly.3Utah Office of Administrative Rules. Utah Admin Code R865-19S-51 – Fabrication Labor
Services performed on animals belong in this category. Utah classifies animals as tangible personal property, so pet grooming and veterinary procedures are taxable the same way a repair would be.4Utah State Tax Commission. Advisory Opinion 95-088 – Taxability of Pet Grooming Services
Assisted Cleaning, Laundry, and Dry Cleaning
Cleaning or washing of tangible personal property is taxable when someone else does the work. A full-service car wash with attendants is taxable; a self-service bay where you handle the sprayer isn’t, because the statute targets “assisted” cleaning. Drop-off laundry and dry cleaning are separately listed as taxable.1Utah Legislature. Utah Code 59-12-103
Telecommunications
Telecommunications services that originate and terminate within Utah are taxable, covering landline, mobile, and VoIP calls along with ancillary services like voicemail and call waiting.1Utah Legislature. Utah Code 59-12-103 Prepaid calling cards are taxable if they can be used for in-state calls; cards restricted to interstate or international calls can be sold without sales tax.5Utah State Tax Commission. Publication 62 – Utah Sales Tax Info for Telecom Service Providers Separate statutory 911 and radio network fees also apply, but those are not sales tax.
Remotely Accessed Prewritten Software
Software accessed over the internet is taxable in Utah when it’s prewritten. That includes SaaS, platform-as-a-service, infrastructure-as-a-service, and other cloud computing applications.6Utah State Tax Commission. Publication 64 – Sales Tax Information for Computer Service Providers The tax follows where the software is used, not where the seller’s servers sit. A Utah business subscribing to a cloud accounting platform pays tax at its local rate. A multi-state buyer allocates the purchase across locations using a reasonable and consistent method.
Custom software is the exception. If software is designed and developed to a particular buyer’s specifications, the license fees are not taxable.7Multistate Tax Commission. Utah Digital Definition and Analysis A standard product configured through dropdown settings is still prewritten. A ground-up build is custom. Modifications to prewritten products land in between and depend on scope.
Admissions and User Fees
Admission and user fees for entertainment, recreation, and cultural activities are taxable. The statute’s list runs long: movies, concerts, sporting events, amusement parks, ski lifts, golf courses, bowling lanes, swimming pools, river runs, horseback rides, boat tours, and essentially any other paid recreational activity.1Utah Legislature. Utah Code 59-12-103 Even a single amusement ride ticket counts.8Cornell Law School. Utah Admin Code R865-19S-34 – Admission to Places of Amusement If you charge people to participate or watch, treat it as taxable unless a specific exemption in Section 59-12-104 applies.
Short-Term Lodging
Room charges at hotels, motels, tourist homes, and trailer courts are taxable under the same statute, along with related services.1Utah Legislature. Utah Code 59-12-103 Long-term residential rentals are not included.
Services Utah Does Not Tax
Professional and Consulting Services
Legal, accounting, consulting, architectural, engineering, and medical services aren’t taxable in Utah, so long as the work isn’t being performed on tangible personal property. The Tax Commission has stated directly that consulting charges aren’t subject to sales tax, and that documents produced during a consulting engagement (marketing plans, financial statements, and similar deliverables) are incidental to the service and also nontaxable.9Utah State Tax Commission. Advisory Opinion 96-008 – Taxability of Consulting Services
Ask what the service acts on. An accountant preparing your return works on information, not property, so no tax. A consultant who happens to repair your office equipment during the same visit would owe tax on the repair portion.
Personal Services on People
Haircuts, massages, manicures, personal training, and similar services aren’t taxable because people aren’t tangible personal property. Medical and dental care fits here too. This is the mirror image of the pet grooming rule.
Work on Real Property
Construction, remodeling, plumbing, electrical, and landscaping work on real property doesn’t appear on the taxable services list. Contractors pay sales tax on the materials they buy and build that cost into their price, but the labor they bill the property owner isn’t separately taxed as a service.3Utah Office of Administrative Rules. Utah Admin Code R865-19S-51 – Fabrication Labor A plumber who installs a new water heater pays tax on the water heater at wholesale; your invoice shouldn’t carry a separate sales tax line for the labor.
One wrinkle: tangible personal property attached to a building that stays personal property (a removable security system, a mounted TV) is still subject to sales tax on its retail price.
When One Invoice Mixes Taxable and Nontaxable
If a single invoice combines taxable and nontaxable items without breaking them out, Utah generally taxes the whole bundle. The seller can avoid that result by identifying the nontaxable portion from regular business records, but a lump-sum invoice is fully taxable.1Utah Legislature. Utah Code 59-12-103
Software maintenance contracts have a special rule. An optional contract that bundles taxable and nontaxable components (software updates plus phone support, for example) and doesn’t itemize them is taxed 40% taxable, 60% nontaxable by statute. Separating the components on the invoice avoids that default and lets each piece be taxed on its own merits.
What Rate Applies
Utah’s state sales tax rate is 4.85%, and every location also carries a mandatory 1.25% statewide local add-on collected by the state. The effective minimum anywhere in Utah is 6.10%. Cities and counties add their own taxes on top. As of January 2026, combined rates run from 6.10% up to 9.25%.10Utah State Tax Commission. Sales and Use Tax Rates Effective January 1, 202611Tax Foundation. State and Local Sales Tax Rates, 2026
For taxable services, the rate is set by where the service is performed. For remotely accessed software, it’s set by where the software is used. The Tax Commission updates combined rate tables each quarter, and sellers are responsible for applying the correct local rate.
If You Sell a Taxable Service
Register with the Utah State Tax Commission through its Taxpayer Access Point (TAP) system before collecting any tax. Sales and use taxes are trust fund taxes: the seller holds collected tax for the state and cannot use those funds for anything else.12Utah State Tax Commission. Sales and Use Tax
Filing frequency depends on annual liability:
- Annual liability of $50,000 or less: quarterly returns, due April 30, July 31, October 31, and January 31.
- Annual liability between $50,001 and $96,000: monthly returns, due the last day of the following month.
- Annual liability above $96,000: monthly returns, with mandatory electronic payment.
All returns are filed electronically through TAP. New businesses estimate expected liability when applying, and the Tax Commission sets the filing frequency from that estimate.12Utah State Tax Commission. Sales and Use Tax
Keep records sufficient to determine your tax liability: all sales of tangible personal property and services (taxable and nontaxable), rental and lease receipts, and every exemption claimed with the supporting certificate. The Tax Commission can examine records during business hours without prior notice, and inadequate records can draw additional penalties.13Utah State Tax Commission. Utah Tax Recordkeeping Responsibilities
Out-of-State Sellers
Businesses based outside Utah that sell taxable services into the state must register and collect once they cross $100,000 in gross revenue from Utah sales in the current or previous calendar year. Utah removed its old 200-transaction threshold effective July 1, 2025, so only the dollar threshold remains.14Streamlined Sales Tax. Remote Seller State Guidance Remote SaaS vendors are the typical case. Marketplace facilitators collect on behalf of third-party sellers using their platforms.6Utah State Tax Commission. Publication 64 – Sales Tax Information for Computer Service Providers
When the Seller Doesn’t Collect: Use Tax
If you buy a taxable service and the seller doesn’t charge Utah sales tax, you owe use tax directly to the state at the same rate. This happens most often with out-of-state providers that haven’t registered. Sales tax and use tax are complementary: one or the other applies, never both.12Utah State Tax Commission. Sales and Use Tax Businesses report use tax on the same return as sales tax. Individuals can report it on their Utah income tax return.
Penalties for Non-Compliance
Utah charges 6% annual interest on unpaid sales tax balances for the 2026 calendar year, accruing daily.15Utah State Tax Commission. Penalties and Interest Payments apply first to penalties, then interest, then the underlying tax, so a partial payment may leave your principal untouched. Because collected sales tax is a trust fund obligation, keeping those dollars rather than remitting them carries more serious consequences than ordinary late payment, with specific penalty tiers in Utah Code 59-1-401 and 59-1-402.
