A domestic partnership in Texas is not a legal status under state law. Texas has never created a statewide registry, and no state statute gives domestic partners the rights that come automatically with marriage. A few counties and cities accept filings, and some employers recognize partners for benefits, but those arrangements are narrow and local. If you want legal protection for your relationship in Texas, you build it yourself through wills, powers of attorney, and written agreements, or you qualify for an informal marriage.
What a Texas Domestic Partnership Actually Is
The Texas Family Code defines “civil union” as any status other than marriage that is intended as a marriage alternative and grants spouse-like protections, and it declares such arrangements contrary to state public policy.1State of Texas. Texas Family Code FAM 6.204 – Recognition of Same-Sex Marriage or Civil Union No state agency processes domestic partnership filings, and no state law extends community property, automatic inheritance, or spousal privilege to domestic partners.
What exists in Texas are local registries and employer-specific affidavits. Travis County has accepted domestic partnership filings since 1993 and the County Clerk maintains a registry with a sample Declaration of Domestic Partnership that couples can adapt.2Travis County Clerk. A partnership recorded in Travis County creates no enforceable rights in a neighboring county, and even within the filing jurisdiction, the record functions mainly as proof you can hand to an insurer or employer. Whether a private employer offers partner benefits at all is voluntary; Texas imposes no statewide requirement to cover domestic partners.
How to Register and What It Costs
In Travis County, both partners generally appear in person at the County Clerk’s office with proof of identity and age such as a driver’s license, passport, birth certificate, state-issued ID, visa, or military identification. Filing fees are $25 for the first page and $4 for each additional page.2Travis County Clerk. Common requirements across local registries and employer affidavits:
- Both partners are at least 18 years old.
- Shared primary residence, often for a minimum period. Plano, for example, requires six continuous months.4City of Plano. Application for Domestic Partnership Benefit Coverage Form
- Neither partner is married to someone else or registered in another domestic partnership.
- The partners are not closely related.
Once recorded, the clerk returns a copy you can give to insurers or other institutions.
What a Domestic Partnership Does Not Give You
This is the part that catches couples off guard. Registering does not change what happens when someone dies, is hospitalized, or files a tax return.
Inheritance. If your partner dies without a will, Texas intestate succession sends their separate property to a surviving spouse, children, parents, or siblings.5State of Texas. Texas Estates Code EST 201.002 – Separate Estate of an Intestate Community property follows a similar spouse-and-children structure.6State of Texas. Texas Estates Code EST 201.003 – Community Estate of an Intestate A domestic partner is not in the line at all. Without a will, a surviving partner can lose the home they shared.
Property acquired together. Texas community property rules protect married couples by default. Domestic partners get no such presumption. If you buy a car together, pool money in a joint account, or help pay your partner’s mortgage, Texas law does not automatically recognize your financial interest.
Taxes. You file as single individuals federally. A domestic partner alone does not qualify you for head-of-household status.7Internal Revenue Service. Publication 501, Dependents, Standard Deduction, and Filing Information
Hospital access. Texas does not grant visitation rights based on partner status. During a declared disaster involving an infectious disease, hospitals must allow at least one visitor, but access is tied to whether the visitor is authorized to receive health information, holds a medical power of attorney, or is recognized as the patient’s surrogate under hospital policy.8State of Texas. Texas Health and Safety Code HSC 241.012 – In-Person Hospital Visitation During Period of Disaster Outside a declared disaster, individual hospitals set their own policies.
The Tax Hit on Partner Benefits
Employer-provided health insurance for a legal spouse is excluded from the employee’s taxable income. Coverage for a domestic partner is not. If your employer adds your partner to your plan, the fair market value of the employer’s contribution toward your partner’s coverage is taxable income to you, subject to income tax and payroll taxes.
There is one way out. Your partner’s coverage becomes tax-free if they qualify as your tax dependent. Under the Internal Revenue Code, a partner can be a “qualifying relative” dependent if they live with you the entire year, you provide more than half of their financial support, and their gross income falls below the exemption threshold.9Office of the Law Revision Counsel. 26 USC 152 – Dependent Defined
Gift tax is the other surprise. Married spouses transfer unlimited assets to each other gift-tax-free. Domestic partners cannot. In 2026, the annual gift tax exclusion is $19,000 per recipient.10Internal Revenue Service. Gifts and Inheritances 1 Larger transfers between partners that aren’t medical or educational expenses require a gift tax return. Most people won’t owe actual gift tax because of the lifetime exemption, but the reporting is still required.
Documents That Fill the Gap
Legal planning is not optional for domestic partners in Texas. Four documents do the heavy lifting.
A Will
A valid will naming your partner as a beneficiary is the only reliable way to pass property to them. Without it, intestate succession ignores the relationship entirely.
Medical Power of Attorney
Texas law lets you name any competent adult as your medical agent through a Medical Power of Attorney, and the statutory form does not require the agent to be a spouse or relative.11State of Texas. Texas Health and Safety Code HSC 166.164 – Form of Medical Power of Attorney It takes effect only when your physician certifies in writing that you cannot make your own health care decisions. One quirk: the statutory form includes an automatic revocation clause if the agent is your spouse and you later divorce. That clause does not apply to a domestic partner, so a breakup will not automatically void a Medical Power of Attorney naming your ex. You have to revoke it yourself.
Statutory Durable Power of Attorney
A Statutory Durable Power of Attorney lets your partner handle banking, bills, and investments on your behalf. The document must be signed by the principal and acknowledged before a notary or other authorized officer. For the authority to survive your incapacity, it must include durability language. Without that clause, the power dies the moment you need it.
Cohabitation Agreement
A written cohabitation agreement is the domestic-partner equivalent of a prenup. Texas requires it to be in writing and signed by the person who would be bound by it; an oral promise to split property is not enforceable. A sound agreement covers how jointly purchased assets would be divided if the relationship ends, who is responsible for shared debts, and what happens to the home if one partner dies or leaves.
Ending a Domestic Partnership
Dissolving a registered partnership is far simpler than divorce because no court is involved. In Travis County, you file a Dissolution of Domestic Partnership form with the County Clerk. Only one partner needs to appear, and the fee matches registration: $25 for the first page and $4 per additional page.12Travis County Clerk. Recording FAQ
The simplicity cuts both ways. With no court oversight, no judge divides property, allocates debts, or orders support. If you and your partner cannot agree on how to separate shared finances, your only option is a civil lawsuit, which is slower and more expensive than a divorce proceeding built for exactly those disputes. A cohabitation agreement, signed while things are good, is the cheapest insurance against that outcome.
Informal Marriage: The Full-Rights Alternative
Texas does recognize one legal relationship that carries the full weight of a ceremonial marriage without a license or ceremony: informal marriage, often called common-law marriage. Under Texas Family Code ยง 2.401, a couple is married if they agree to be married, live together in Texas as spouses, and represent to other people that they are married.13State of Texas. Texas Family Code FAM 2.401 – Proof of Informal Marriage All three elements must exist together. Living together for years is not enough on its own.
Both partners must be at least 18 and neither currently married to someone else.13State of Texas. Texas Family Code FAM 2.401 – Proof of Informal Marriage Couples can lock it in by filing a Declaration of Informal Marriage with the County Clerk on the form prescribed by the bureau of vital statistics, which includes each party’s full name, address, date and place of birth, and a sworn oath covering the three elements.14State of Texas. Texas Family Code Chapter 2 The statutory filing fee is $25.15State of Texas. Texas Local Government Code LGC 118.011 – Fee Schedule
A recorded informal marriage carries the complete set of rights: community property, automatic inheritance, spousal privilege, joint tax filing. It also means ending the relationship requires a formal divorce.
The Two-Year Presumption
If a couple never files a declaration and later disagrees about whether they were married, a clock starts when they separate. If no court proceeding to prove the marriage is filed within two years of the date they stopped living together, Texas law presumes no marriage agreement existed.13State of Texas. Texas Family Code FAM 2.401 – Proof of Informal Marriage The presumption is rebuttable, but the burden sits on the person claiming the marriage was real. Filing the declaration eliminates that fight.
Federal Recognition
A Texas informal marriage counts for federal purposes. The Social Security Administration recognizes common-law marriages from states where they are legal.16Social Security Administration. SSR 61-09 – Validity of Common-Law Marriage A surviving common-law spouse can claim survivor benefits under the same rules as any other spouse. The SSA may ask for statements from both partners and blood relatives plus corroborating evidence like joint mortgage documents, insurance policies, or shared bank accounts. Couples who filed a declaration with their County Clerk have a much easier time proving the marriage when it matters.
