Domestic Partnership in Las Vegas: Rights, Filing, and Ending It

A domestic partnership in Nevada is a legally recognized relationship you register with the Secretary of State for a $50 fee, and once registered it gives you the same rights and responsibilities as a married spouse under Nevada law, including community property, inheritance, and healthcare decision-making. Those protections are strong inside the state. They weaken or disappear once federal law or another state’s law comes into play.

Who Can Register

Five eligibility rules apply equally to same-sex and opposite-sex couples. Both partners must:

  • Share a common residence. You need to live together at least part of the time, but it’s fine if only one name is on the lease or deed, and either partner can keep a separate residence as well.
  • Be unmarried and not already in another domestic partnership.
  • Not be related in a way that would prevent you from marrying in Nevada.
  • Be at least 18 years old.
  • Be legally competent to consent.1Nevada Legislature. Nevada Code 122A.100 – Registration: Procedure; Fees; Eligibility; Issuance of Certificate

The common residence rule is more flexible than people assume. If one of you owns a home in Henderson and the other rents in Las Vegas, you qualify as long as you share one of those residences on a regular basis.

How to File the Declaration

Registration uses a one-page Declaration of Domestic Partnership available on the Nevada Secretary of State’s website. Fill in both partners’ full legal names and mailing addresses, then sign in front of a notary. Electronic notarization is accepted.2Nevada Secretary of State. Domestic Partnerships

Mail the original notarized form to the Secretary of State’s Las Vegas office. Fax and email submissions aren’t accepted. The address is:

1 State of Nevada Way, Suite 310
Las Vegas, NV 89119

The fee is $50 and includes a black-and-white or digital certificate. A ceremonial certificate is $15 extra. The office is not currently accepting checks or money orders, so pay by credit card. Standard processing runs four to six business days. If you need it faster, you can schedule an in-person expedite appointment at the Las Vegas office or mail the form there for same-day handling; expedited service adds $100 to the $50 fee. Once approved, you receive a Certificate of Registered Domestic Partnership, which is your official proof of status.2Nevada Secretary of State. Domestic Partnerships

What Rights You Get Under Nevada Law

Registration carries real weight inside the state. Nevada law grants domestic partners the same rights, protections, and responsibilities as married spouses across statutes, administrative rules, court proceedings, and common law.3Nevada Legislature. Nevada Code 122A – Domestic Partnerships In practice:

  • Income earned and property acquired during the partnership belong equally to both of you, with the registration date functioning like a wedding date for property division.
  • If your partner dies without a will, you inherit under the same intestate succession rules that apply to a surviving spouse.
  • You can make medical decisions for an incapacitated partner the same way a spouse could.
  • Your rights and obligations regarding a child of either partner match those of a married parent.
  • After your partner’s death, you hold the same legal standing as a widow or widower.

Public agencies in Nevada cannot treat you differently from a spouse. Where Nevada law would otherwise be unequal because it references federal law, the state fills the gap and treats you as if federal law recognized the partnership.3Nevada Legislature. Nevada Code 122A – Domestic Partnerships

The Health Insurance Carve-Out

One exception is written directly into the statute. Nevada law does not require any employer, public or private, to provide health insurance benefits to a domestic partner. Employers can offer coverage voluntarily, and some do, but your partner’s company has no legal obligation to add you to the plan.4Nevada Legislature. Nevada Code 122A – Domestic Partnerships – Section: NRS 122A.210 If coverage matters to your decision, check with both employers before choosing between a partnership and a marriage.

Where Federal Law Won’t Follow

The widest gap between a domestic partnership and a marriage is federal. The federal government does not treat registered domestic partners as spouses, which has concrete consequences.

Taxes

You cannot file a joint federal return. Each partner files as single, or as head of household if they qualify through other means. You cannot claim head-of-household status based solely on your partner being your dependent. The IRS states that registered domestic partners are not spouses for any federal tax purpose. You also lose the federal estate tax marital deduction. A spouse can inherit unlimited assets federal-tax-free; a surviving domestic partner cannot, which can produce a significant tax bill on larger estates.5Internal Revenue Service. Social Security

The Social Security Administration classifies domestic partnerships as nonmarital legal relationships. Surviving partners may qualify for survivor benefits, since Nevada’s statute does grant the inheritance rights the SSA looks for, but the eligibility analysis is less automatic than for married couples, and the registration date is the starting point for the nine-month duration requirement.

Family and Medical Leave

FMLA does not treat domestic partners as spouses, so you cannot take FMLA-protected leave to care for a partner with a serious health condition. If your employer has its own policy covering partners, that policy governs, but the federal 12-week guarantee does not apply.6U.S. Department of Labor. Immigration

A U.S. citizen cannot sponsor a domestic partner for a green card. Federal immigration law limits family-based petitions to spouses, children, parents, and siblings.7U.S. Citizenship and Immigration Services. Green Card for Immediate Relatives of U.S. Citizen If immigration sponsorship is part of your situation, marriage is the only option that works.

If You Leave Nevada

No federal law requires other states to honor your partnership. Some, like California and New Jersey, have their own registries and will recognize a Nevada partnership. Many others have no framework for it. Your state-level rights to community property, inheritance, and medical decision-making can become unenforceable if you relocate to a state that does not recognize the relationship. Marriage, by contrast, enjoys universal interstate recognition. If there’s any chance you’ll move, talk to an attorney about portability before you register.

How to End a Domestic Partnership

There are two paths out, and the simpler one has strict conditions.

Simplified Termination

If the partnership has been registered for five years or less, you may qualify for an administrative termination through the Secretary of State. All of the following must be true:

  • No minor children were born or adopted during the partnership, no one is pregnant, or you have a written custody and support agreement.
  • There is no community or joint property, or you have a written agreement dividing it and have already transferred any titles or deeds.
  • Both partners waive any right to financial support from the other, or you have a written support agreement.
  • Both partners waive the right to a court proceeding.

Meet those conditions and you file a signed, notarized termination form with the Secretary of State and pay a filing fee.8Nevada Legislature. Nevada Code 122A.300 – General Requirements and Procedures; Requirements and Procedure for Simplified Termination Proceedings; Fees

Court Dissolution

If the partnership has lasted more than five years, or you have children, shared property, or support disputes you cannot settle by agreement, you have to go through Nevada’s court system. The process follows the same procedures as a divorce, with family court jurisdiction and the potential for contested hearings over custody, property, and partner support.8Nevada Legislature.
