A domestic partnership in Maine is a state registration that gives an unmarried couple living together many of the same state-level rights as a married couple: inheritance, medical decision-making, funeral authority, and protection from abuse. Both partners must have lived together in Maine for at least 12 months before registering, and the filing fee is $50. The registry is kept by the Maine Center for Disease Control and Prevention’s Data, Research and Vital Statistics office in Augusta, which holds the permanent record of each partnership.1Maine Center for Disease Control & Prevention. Who Can Register
Maine sets a short list of requirements, and both people have to meet all of them. Each partner must be a mentally competent adult. Neither can be married or already registered as someone else’s domestic partner. The two of you cannot be related in any way that would prevent you from legally marrying each other. And each of you must be the sole domestic partner of the other and intend to stay that way.2Maine Legislature. Maine Code Title 22 Section 2710 – Domestic Partner Registry
The requirement that trips people up most often is residency. Both partners must have been “legally domiciled together in this State” for at least 12 months before filing the declaration. It is not enough for one partner to live in Maine, and it is not enough for the two of you to have lived together elsewhere for a year and then moved. The clock runs on shared Maine residency.2Maine Legislature. Maine Code Title 22 Section 2710 – Domestic Partner Registry
What Rights Registration Gives You
Maine treats registered domestic partners like spouses across the areas of state law where legal standing matters most in a crisis: probate, guardianships, conservatorships, inheritance, and protection from abuse.1Maine Center for Disease Control & Prevention. Marriage and Domestic Partnership
Inheritance If Your Partner Dies Without a Will
Maine’s probate code includes surviving registered domestic partners in its definition of “heirs,” so you take under intestate succession the way a surviving spouse would rather than being treated as a legal stranger to the estate.3Maine State Legislature. Maine Code Title 18-A Section 1-201 – General Definitions The size of your share depends on whether your partner left descendants or surviving parents, following the same formulas the code applies to spouses.
Medical Decisions and Hospital Visitation
Registered partners can visit each other in healthcare facilities and make medical decisions when the other partner cannot. These rights work the same way they do for married spouses. A signed health care power of attorney kept with your registration is still worth having, because it removes any argument at a facility unfamiliar with Maine’s partnership law.
Funeral Arrangements
When a registered partner dies, the surviving partner has legal authority to direct funeral arrangements and the final disposition of remains.4Maine State Legislature. Maine Code Title 22 Section 2843-A Without that standing, those decisions would default to the deceased partner’s blood relatives.
Protection From Abuse
Registered partners can seek a protection-from-abuse order through the Maine courts on the same basis as a spouse. The registration itself establishes the qualifying relationship, so there is no separate showing of a dating or household connection to make.

Where a Maine Partnership Does Not Reach
Registration carries real weight inside Maine. Federal agencies and other states are a different story, and the gaps are worth understanding before you rely on the status.
Federal Taxes
The IRS does not treat registered domestic partners as married. You each file your federal return as single, or as head of household if you qualify through a dependent child. Having your partner as a dependent is not by itself enough for head-of-household status, because a domestic partner is not one of the relatives the IRS recognizes for that filing status.7Internal Revenue Service. You may be able to claim your partner as a qualifying relative dependent, but only if your partner’s gross income falls below the annual IRS threshold and you provide more than half of your partner’s total support. If your household runs on shared funds, neither of you can claim the other, because each partner is treated as providing half of their own support.7Internal Revenue Service. Transfers between married spouses are unlimited for gift tax purposes. Transfers between domestic partners are not. Anything above the annual gift tax exclusion counts against your lifetime exemption, which matters most when you add a partner to a deed, transfer a home, or make a large cash gift.8Internal Revenue Service. Frequently Asked Questions on Gift Taxes
If your employer covers your partner on your health plan, the IRS treats the employer’s contribution to the partner’s premium as imputed income to you unless your partner qualifies as your tax dependent. That amount is taxed and shows up on your W-2, so family coverage effectively costs a domestic partner employee more than it costs a married one.
Social Security
This is the one place where the news is better. Because Maine gives surviving domestic partners spouse-equivalent inheritance rights, the Social Security Administration has concluded that a registered Maine partner can qualify as a “spouse” for certain Title II benefits, including spouse’s insurance benefits and the lump-sum death payment. SSA reaches this result through the part of the Social Security Act that looks to state inheritance law.9Social Security Administration. POMS PR 05005.022 – Maine Approval still depends on the facts of your case, but Maine partners have a stronger claim than partners in states without equivalent inheritance protections.
Family and Medical Leave
Federal FMLA does not cover domestic partners. The statute defines “spouse” by reference to the state where a marriage took place and specifically excludes people in civil unions and domestic partnerships.10U.S. Department of Labor. Fact Sheet #28L: Leave under the Family and Medical Leave Act When You and Your Spouse Work for the Same Employer You cannot take federally protected leave to care for a seriously ill partner unless your employer extends that benefit on its own. Check your company’s leave policy.
Immigration
USCIS does not treat a domestic partnership as a marriage for immigration. The agency’s policy manual lists domestic partnerships as an example of a relationship that does not qualify a partner for a marriage-based green card or visa. Sponsoring a partner for immigration requires a legal marriage.11U.S. Citizenship and Immigration Services. Volume 6 – Immigrants, Part B – Family-Based Immigrants, Chapter 6 – Spouses
COBRA After a Breakup
Federal COBRA guarantees continuation health coverage for a spouse or former spouse after a qualifying event like divorce. Domestic partners are not on the list of eligible dependents.12U.S. Department of Labor. COBRA Continuation Coverage If your partnership ends and you were on your partner’s employer plan, you have no federal right to continue it. Some employers offer COBRA-like continuation voluntarily; confirm before you count on it.
Other States
No federal law requires other states to honor a Maine domestic partnership. The Full Faith and Credit Clause has not been read to extend to domestic partnerships the way Obergefell v. Hodges extended it to same-sex marriages.13Constitution Annotated. Full Faith and Credit Clause Your partnership may not be recognized if you move, travel, or need medical care out of state. Carrying your certified declaration together with a health care power of attorney and current estate documents is the practical workaround.
Children and Second-Parent Adoption
Maine allows second-parent adoption for domestic partners. One partner can legally adopt the other partner’s biological child without the biological parent giving up any rights. After the adoption, the child has two legal parents with equal standing, which includes custody rights and child support obligations.
That legal relationship survives the end of the partnership. If you later separate, the adoptive parent keeps the same custody rights and support obligations as the biological parent. One limit worth knowing: Maine, like most states, caps a child at two legal parents, so a partner cannot become a third legal parent while two biological parents already hold that status.
Ending a Domestic Partnership
The partnership ends automatically if the couple gets married, because the marriage replaces it. If the couple separates without marrying, either partner can file a Notice of Termination of Domestic Partnership with the Maine CDC vital records office. The filing partner must send a copy to the other partner by certified mail.2Maine Legislature. Maine Code Title 22 Section 2710 – Domestic Partner Registry
Termination takes effect 60 days after the state receives the notice. During that window, both partners still hold all the rights and obligations of registered partners. Use the 60 days to update beneficiary designations on insurance and retirement accounts, revise health care directives, and separate out shared financial arrangements. Maine’s partnership statute does not include a divorce-style property-division process, so partners who disagree about shared assets may need to resolve those disputes through civil litigation or mediation rather than family court.2Maine Legislature. Maine Code Title 22 Section 2710 – Domestic Partner Registry
If you were on your partner’s employer health plan, remember that federal COBRA does not apply to you. Line up marketplace coverage or another plan before the termination date so you are not left uninsured.
