Driving without registration in Colorado is a class B traffic infraction, and the fine climbs the longer you’ve been expired: about $43 in the first month, $62 once you cross 30 days, and $93 at 60 days or more. That citation is only the first bill. When you finally renew, the DMV adds a $25-per-month late fee (capped at $100) plus back-owed registration taxes for the entire lapsed period. New residents who miss the 90-day deadline face a separate $500 civil penalty on top of everything else.
How the Fine Escalates
Driving with expired tags violates C.R.S. 42-3-114, a class B traffic infraction.1Colorado.Public.Law. CRS 42-3-114 – Expiration Colorado uses a specific penalty schedule for this offense that grows with how far past your renewal date you are:2FindLaw. Colorado Code 42-4-1701 – Traffic Offenses and Infractions Classified – Penalties – Penalty and Surcharge Schedule
- 1 to 29 days expired: $35 penalty plus $8 surcharge, for $43 total
- 30 to 59 days expired: $50 penalty plus $12 surcharge, for $62 total
- 60 or more days expired: $75 penalty plus $18 surcharge, for $93 total
If the citation ends up before a judge and a judgment is entered against you, a $16 docket fee is added.3Justia. Colorado Code 42-4-1710 – Penalty Assessment Notice – Failure to Pay or Appear – Judgment A different penalty applies to a vehicle that was never registered at all after purchase: a flat $50 penalty plus a $16 surcharge under C.R.S. 42-3-103.2FindLaw. The 60-day mark matters. After buying a vehicle in Colorado, you have 60 days to register it.4Justia. Colorado Code 42-3-103 – Registration Required – Exemptions – Rules Registration then runs on a 12-month cycle, expiring on the last day of the renewal month.
The Second Bill Waiting at the DMV
People often pay the traffic ticket and think they’re done. They aren’t. When you actually go to renew an overdue registration, Colorado charges a separate administrative late fee of $25 for each month or partial month past expiration, capped at $100.5Department of Revenue – Motor Vehicle. The late fee isn’t the whole DMV bill either. You also owe back-calculated registration taxes and fees covering the entire period the vehicle should have been registered.6FindLaw. Colorado Code 42-3-112 – Late Registration Fee Six months of lapse means the full $100 late fee plus six months of prorated taxes and fees, all due at the counter before you can register.
If You Ignore the Ticket
An officer writing you up for expired registration issues a penalty assessment notice. You can pay the penalty and surcharge, or you can appear in court on the specified date to contest it. Do neither and the court enters a default judgment for the full penalty, surcharge, and the $16 docket fee.3Justia. Colorado Code 42-4-1710 – Penalty Assessment Notice – Failure to Pay or Appear – Judgment
Colorado law specifically prohibits a bench warrant for failure to appear on a traffic infraction like this one.3Justia. Colorado Code 42-4-1710 – Penalty Assessment Notice – Failure to Pay or Appear – Judgment That doesn’t make ignoring it harmless. Unpaid judgments go to collections, and the Colorado Department of Revenue can block future registration or driver’s license renewals until the balance is cleared.
If you contest the citation, showing up with proof that your registration was current at the time of the stop, or that you’ve since renewed, gives the judge grounds to dismiss or reduce the charge. Some county courts require proof of renewal before they’ll consider any reduction.
When the Car Gets Towed
Expired registration alone doesn’t automatically get your vehicle impounded, but it gives officers wide discretion, and that discretion tilts against you the longer you’ve been expired. A stop that also turns up no insurance, no proof of ownership, or other violations often ends with a tow truck. Impound and daily storage fees add up fast, and impound lots typically require valid registration and insurance before releasing the vehicle.
If a towed vehicle goes unclaimed, it can be treated as abandoned. Colorado allows the sale of an abandoned vehicle at a public or private sale no earlier than 30 days after notice is mailed to the registered owner.7Justia. Colorado Code 42-4-2104 – Appraisal of Abandoned Motor Vehicles – Sale Wait too long and you lose the car.
New Residents: The $500 Trap
Moving to Colorado starts a 90-day clock to register any vehicle you brought with you.8Department of Revenue – Motor Vehicle. Registration Requirements Miss it and the penalties stack in a way most newcomers don’t expect. The failure to register is a petty offense under C.R.S. 42-6-140,9Justia. Colorado Code 42-6-140 – Registration Upon Becoming Resident and on top of the criminal fine, the municipality or county where you should have registered can assess a $500 civil penalty.10Justia. Colorado Code 42-6-139 – Penalties for Failure to Register
You’ll also owe the $25-per-month late fee and back-calculated registration taxes for the whole period you were required to be registered.6FindLaw. Colorado Code 42-3-112 – Late Registration Fee Out-of-state plates don’t buy you time here, even if the other state’s registration is still current. Colorado treats you as needing Colorado plates the day you become a resident.
Fake or Altered Tags Are a Different Offense
Expired registration is a civil infraction. Fictitious, stolen, canceled, or altered plates and stickers are not. Under C.R.S. 42-3-121, knowingly displaying any of those, or making a false statement on a registration application, is a class 2 misdemeanor traffic offense.11Justia. Colorado Code 42-3-121 – Violation of Registration Provisions – Penalty The standard penalty schedule sets that at $75 plus a $24 surcharge,2FindLaw. Colorado Code 42-4-1701 – Traffic Offenses and Infractions Classified – Penalties – Penalty and Surcharge Schedule but the misdemeanor classification opens the door to jail time and a criminal record. Intent to deceive is what separates the two categories.
What It Can Do to Your Insurance
Many auto policies condition coverage on the vehicle being legally registered. If your registration is expired when you have an accident and file a claim, your insurer may argue the vehicle wasn’t in compliance with state law and deny the claim, whether it’s collision, liability, or comprehensive.
Even without a denial, a citation for expired registration flags you as a higher-risk driver at renewal, and premiums often rise. Colorado already requires proof of insurance to register a vehicle; the practical reverse is that keeping registration current helps keep the insurance itself enforceable when something goes wrong.
