Dry Counties in North Carolina: Laws, Exceptions, and Going Wet

Graham County, in the far western mountains, is the only one of the dry counties in North Carolina where every category of alcohol sale remains prohibited countywide.1NC ABC Commission. Legal Sales Areas and Early Sunday Sales Information – Graham County Everywhere else in the state, at least some form of alcohol sale has been approved at the county or city level. North Carolina does not set a single statewide rule. Each county and each city decides for itself, through voter referendums, which types of alcohol may be sold within its borders. A county can ban sales in its unincorporated areas while a town inside it runs ABC stores and serves cocktails.

Which Counties Are Actually Dry

Of North Carolina’s 100 counties, Graham is the only one that has not approved any category of alcohol sale.1NC ABC Commission. Legal Sales Areas and Early Sunday Sales Information – Graham County A handful of other counties have approved beer and wine but turned down ABC stores and mixed drinks, which is what people usually mean when they call a place “moist.” The term is informal. State law does not define “wet,” “dry,” or “moist” at all. A jurisdiction’s status is simply the sum of the elections it has held and what voters decided.

The county figure also understates how much alcohol is actually available. When a county rejects a type of sale, cities inside that county can hold their own elections and approve it locally.2North Carolina General Assembly. North Carolina General Statutes 18B-600 – Types of ABC Elections A town of a few hundred people inside a dry county can vote to allow beer sales within its city limits, creating a legal pocket surrounded by prohibition. These municipal islands are common. If you live in a dry area, the nearest town is often at least partially wet.

Statewide, 168 local ABC boards operate more than 430 liquor stores, which gives a sense of how limited the fully dry footprint has become.

What “Dry” Actually Covers

Being dry is not a single thing. North Carolina recognizes four separate alcohol elections, and voters decide each one independently:2North Carolina General Assembly. North Carolina General Statutes 18B-600 – Types of ABC Elections

  • Malt beverages, meaning beer, ale, and lager
  • Unfortified wine
  • ABC store liquor
  • Mixed beverages, meaning drinks containing liquor served by the glass at bars and restaurants

A community can approve any combination. Beer at the grocery store but no bar service. Wine in restaurants but not at convenience stores. A liquor store without cocktail service. Whatever propositions receive a majority “for” vote take effect, and the ABC Commission issues only the permits that match. A beer vote cannot be stretched into a liquor license.

Exceptions That Allow Sales Anyway

Even in jurisdictions that have never passed any alcohol election, state law carves out narrow exemptions for specific kinds of hospitality businesses. Tourism ABC establishments, recreation districts, sports clubs, and hotels along certain scenic corridors such as the Blue Ridge Parkway can qualify for permits to sell alcohol regardless of local dry status. That is why you can sometimes order wine with dinner at a mountain resort in a county that otherwise bans sales.

The exemptions are limited and come with conditions. A sports club must charge membership fees and maintain actual recreational facilities. A tourism ABC establishment has to meet criteria tied to lodging, dining, and visitor capacity. These paths exist for qualifying businesses with the right permits from the ABC Commission. They are not loopholes a resident can use to buy a bottle at a regular store.

Buying, Carrying, and Possessing Alcohol in a Dry County

North Carolina’s default rule is strict. Manufacturing, selling, transporting, or possessing alcohol is illegal unless state law specifically authorizes it, and violating that rule is a Class 1 misdemeanor carrying up to 120 days in jail.3North Carolina General Assembly. North Carolina General Statutes 18B-102 – Manufacture, Sale, Etc., Forbidden Except as Expressly Authorized A court can also order the seizure of the alcohol itself and any equipment involved. The same misdemeanor classification covers permit violations, sales during prohibited hours, and other regulatory breaches throughout the ABC chapter.

In practice, enforcement focuses on commercial activity rather than personal consumption. The 21st Amendment gives states broad authority to regulate alcohol within their borders, including the power to restrict transportation into dry areas.4Constitution Annotated. Twenty-First Amendment – Repeal of Prohibition Adults who legally buy alcohol in a wet jurisdiction are generally not prosecuted for carrying it home through a dry one. Driving a case of beer back through Graham County after a trip is a different situation from stockpiling alcohol in a dry area and reselling it to neighbors.

The safer approach for anyone living in or passing through a dry county is to keep quantities reasonable and avoid anything that looks like distribution. The statutory baseline treats possession without authorization as a violation; the authorization comes from the purchase, permit, and personal-use provisions elsewhere in the ABC law.3North Carolina General Assembly. How a Dry County or City Goes Wet

Changing a jurisdiction’s status takes a local option election.5North Carolina General Assembly. North Carolina General Statutes 18B-601 – Election Procedure Two things can trigger one. The county commission or city council can call for the vote directly, or residents can force it through a petition signed by at least 35% of registered voters in the jurisdiction.6North Carolina State Board of Elections. Petition for Alcoholic Beverage (ABC) Election That is 35% of everyone currently registered, not 35% of a past turnout. The bar is deliberately high.

What Appears on the Ballot

Each type of election has its own propositions, and voters decide each one separately. A malt beverage election can present up to four questions: on-premises and off-premises together, on-premises only, off-premises only, or a limited option that lets hotels and classified restaurants serve beer on-site while other retailers sell it for takeaway.7North Carolina General Assembly. North Carolina General Statutes 18B-602 – Form of Ballots Unfortified wine elections work the same way, with propositions covering on-premises, off-premises, or both.

When a City Inside a Dry County Can Hold Its Own Vote

Cities face population thresholds before they can bypass a county’s rejection. A city can hold a malt beverage or unfortified wine election only if the county already voted on that category and turned it down, and the city has at least 500 residents (or 400 if it previously had 500 or more). An ABC store election requires at least 1,000 registered voters, the county must not already run ABC stores, and at least one other city in the same county must already have one. A mixed beverage election needs at least 500 registered voters, dropping to 200 if another city in the county has already approved mixed drinks.2North Carolina General Assembly. North Carolina General Statutes 18B-600 – Types of ABC Elections These requirements keep very small municipalities from going it alone and make sure there is enough population base to support the regulatory system that comes with legal sales.
