Eastern District of Virginia Local Rules and Procedures

If you are practicing in the Eastern District of Virginia local rules framework, the rules you most need to know are the ones that move faster or demand more than the Federal Rules of Civil Procedure: compressed scheduling, strict page and formatting limits, a 30-day deadline to set motions for hearing, a captioned statement of undisputed facts on summary judgment, a disfavored sealing process, and a hard local-counsel requirement for anyone admitted pro hac vice.1United States District Court Eastern District of Virginia. Local Rules for the United States District Court Eastern District of Virginia Miss one of these and a filing can be struck, a motion deemed withdrawn, or a fact deemed admitted.

The Rocket Docket Pace

Cases move. Under Local Civil Rule 16(B), the scheduling order must be entered no later than 60 days after the defendant’s first appearance or 90 days after service of the complaint, and that order sets firm deadlines for discovery, the final pretrial conference, and often the trial date itself.1United States District Court Eastern District of Virginia. Local Rules for the United States District Court Eastern District of Virginia In 2023, the median time from civil filing to trial was roughly 16.4 months.

Extensions require good cause, and falling behind on discovery is not good cause. Attorneys used to more forgiving scheduling in other districts find that out quickly.

Document Formatting and Page Limits

Local Civil Rule 7(F)(3) sets the formatting standards for every brief filed in the court. Documents use 12-point Roman-style font (or 10-pitch Courier), one-inch margins on all sides, and double spacing throughout. Long quotations and footnotes may be single-spaced. Every filing opens with a caption identifying the court, the parties, and the assigned case number.2United States District Court Eastern District of Virginia. Local Civil Rule 7

Opening and responsive briefs are capped at 30 double-spaced pages, excluding affidavits and supporting exhibits. Reply briefs are capped at 20 pages. Going over requires leave of court in advance, and a 35-page brief filed without permission can be struck.2United States District Court Eastern District of Virginia. Local Civil Rule 7

Local Civil Rule 11 requires that every filing show the attorney’s or self-represented party’s typed name, address, and telephone number, and every filing needs a certificate of service confirming that the other parties received a copy. The court publishes standardized templates for these components.

Motion Deadlines and the 30-Day Hearing Trap

Local Civil Rule 7 compresses the motion schedule below the federal defaults. Once a motion is filed, the opposing party has 14 calendar days to file a response, and the moving party has six calendar days after that to file a reply.2United States District Court Eastern District of Virginia. Local Civil Rule 7 Service by mail does not add days under Federal Rule 6(d).

The trap: unless the court orders otherwise, a motion is deemed withdrawn if the filer does not set it for hearing (or arrange to submit it without a hearing) within 30 days of filing.2United States District Court Eastern District of Virginia. Local Civil Rule 7 No warning goes out. File a motion, forget to schedule the hearing, and a month later it is gone.

Discovery and Expert Disclosure Timing

Local Civil Rule 26 lets the court require the Rule 16(b) scheduling conference as few as 21 days after the parties hold their Federal Rule 26(f) planning conference, and it allows the court to excuse a written discovery plan and take an oral report at the scheduling conference instead.1United States District Court Eastern District of Virginia. Local Rules for the United States District Court Eastern District of Virginia Discovery timelines are often set within weeks of filing.

Expert disclosures are staggered. Plaintiff’s expert disclosures are due no later than 60 days before the earlier of the discovery cutoff or the final pretrial conference. Defendant’s disclosures are due 30 days after plaintiff’s. Plaintiff then has 15 days to serve any rebuttal expert material.1United States District Court Eastern District of Virginia. Local Rules for the United States District Court Eastern District of Virginia Missing an expert deadline is one of the fastest ways to lose a case here, because extensions are rare and excluded experts rarely come back in.

Discovery motions require a Federal Rule 37 good-faith conference first, certified in the motion itself.3Legal Information Institute. Summary Judgment: The Captioned Facts Requirement

Local Civil Rule 56(B) adds a formatting requirement that catches attorneys from other districts off guard. The moving party’s brief must include a specifically labeled section listing every material fact the party contends is undisputed, each tied to a record citation. The opposing brief must include a similarly labeled section identifying which of those facts are genuinely disputed, again with record citations.1United States District Court Eastern District of Virginia. If the opposing party does not controvert a listed fact in the required section, the court may deem the fact admitted. Burying factual disputes inside the argument section instead of the captioned section can lose the motion on a technicality even when a real dispute exists.

Filing Under Seal

Local Civil Rule 5 treats motions to seal as disfavored. Agreement among the parties, or a “confidential” designation during discovery, does not justify sealing.1United States District Court Eastern District of Virginia. Local Rules for the United States District Court Eastern District of Virginia

The motion to seal must be filed at the same time as the material to be sealed. It must be accompanied by a non-confidential memorandum explaining what is sealed and why, and by a proposed order reciting the legal findings required to justify sealing. Redactions must be narrow; blanket sealing of entire briefs is rarely granted. Where only part of a document needs protection, an unsealed, redacted version has to be filed in the public record alongside the sealed original.1United States District Court Eastern District of Virginia. Electronic Filing and Fees

Nearly all civil filings go through the court’s CM/ECF system, which requires a PACER account, a web browser, and PDF software.4United States District Court Eastern District of Virginia. Fees go through Pay.gov. A new civil action costs $405, which includes a $55 administrative fee. A notice of appeal costs $605.5United States District Court Eastern District of Virginia. Attorney Admission and Local Counsel

Local Civil Rule 83.1 governs admission. Any active Virginia State Bar member in good standing is eligible. Admission requires a written application, endorsement by two current bar members vouching for the applicant’s character, presentation by a sponsoring attorney in open court, taking the oath, and a $100 admission fee.6United States District Court Eastern District of Virginia. Attorney Admission Application

Attorneys who are not Virginia State Bar members can apply for pro hac vice admission in a specific case. The application takes the form of a written motion by a member of the court’s bar, with a $75 fee per attorney, per case.5United States District Court Eastern District of Virginia. Court Fees Pro hac vice admission is subject to a reciprocity requirement: the home district court must extend the same privilege to this court’s bar members.7United States District Court for the Eastern District of Virginia. Local Civil Rule 83.1 Attorneys and Pro Se Parties

Pro hac vice admission does not let an out-of-state attorney operate alone. Local counsel admitted to this court must accompany the pro hac vice attorney at every hearing, pretrial matter, and trial, and must co-sign every filing. The obligation cannot be delegated or avoided without leave of court, and the local attorney who signs a filing is personally accountable; the court can deal with that attorney alone on any matter in the case.7United States District Court for the Eastern District of Virginia.
