If you’re hurt on the job in California, you can collect State Disability Insurance from the EDD while your workers’ comp claim is pending, denied, or paying less than your SDI rate, but you can’t receive full benefits from both programs for the same days. SDI acts as a financial bridge when the workers’ comp insurance carrier is still investigating or has refused to pay, and the EDD later recovers what it paid once workers’ comp comes through. Weekly SDI ranges from $50 to $1,765 and can last up to 52 weeks per claim.1Employment Development Department. Disability Insurance Benefits
When SDI Fills the Gap
Workers’ comp is paid by your employer’s insurance carrier for on-the-job injuries. SDI is funded by payroll deductions and covers you when illness or injury keeps you from working, regardless of cause. The two programs overlap when a work injury is in dispute, and California law coordinates them so you get the higher of the two amounts but not both stacked on top of each other.
Three situations commonly bring SDI into a workers’ comp case:
- The carrier has issued a delay letter. California gives the insurance carrier up to 90 days to accept or deny your claim. SDI can cover you during that investigation window.2Division of Workers’ Compensation. Answers to Frequently Asked Questions About Workers’ Compensation for Employees
- The carrier has denied the claim. You can file for SDI independently; the EDD only needs a doctor’s confirmation that you can’t work, not the carrier’s agreement that the injury is work-related.
- Workers’ comp is paying, but less than your SDI rate. The EDD pays the difference so you receive the higher amount.3Employment Development Department. Workers’ Compensation and Disability Benefits
The rule behind this is Unemployment Insurance Code Section 2629, which treats workers’ comp temporary disability as “other benefits” and bars SDI eligibility for days you’ve already been paid those benefits at or above your SDI rate. When they’re lower, you’re entitled to SDI reduced by what you’ve received.4California Legislative Information. California Unemployment Insurance Code 2629
For high earners, the two maximums are nearly identical. Workers’ comp temporary disability in 2026 pays two-thirds of pre-tax wages up to about $1,764 per week, and SDI tops out at $1,765. If you’re already getting full workers’ comp temporary disability at the maximum, there’s usually no SDI to add on top.
Qualifying for SDI While Your Workers’ Comp Case Is Open
Three requirements have to be met:
- A physical or mental condition prevents you from doing your regular work.
- You earned at least $300 in wages subject to SDI deductions during your base period, which covers roughly 5 to 18 months before your claim starts.5Employment Development Department. Disability Insurance – Eligibility FAQs
- A licensed health professional certifies your disability.
Your weekly SDI amount is based on your highest-earning quarter in the base period and generally replaces about 60 to 70 percent of those wages, up to the $1,765 cap.6Employment Development Department. Disability Insurance Benefit Payment Amounts Benefits can run up to 52 weeks on a single claim.
Filing Your SDI Claim

Part A is yours. Along with your Social Security number, contact information, and last employer, you’ll need details about the workers’ comp case: the name of the insurance carrier, its mailing address, any case number, and the claims adjuster’s contact information. Pull those together before you start. Record the exact date your disability began and the last day you worked; discrepancies in those dates slow processing.
Part B is the medical certification. Your doctor completes and submits it directly to the EDD, confirming that your condition keeps you from your regular job and estimating a return-to-work date. Your doctor has 49 days from the start of your disability to get this to the EDD. Miss that deadline and your claim can be disqualified entirely.9Employment Development Department. Waiting Period and Payment Timing
SDI has an unpaid seven-day waiting period counted in calendar days from the start of your disability. Day eight is your first payable day.9Employment Development Department. Disability Insurance – Benefits and Payments FAQs Claims tangled up with a workers’ comp dispute can take longer, since the EDD may need to verify where the carrier’s investigation stands.
You’ll get a Notice of Computation showing your weekly and maximum benefit amounts. If the EDD contacts you by phone or mail about the workers’ comp claim or wants additional medical records, respond quickly. Ignored requests pause payments or close claims.
The EDD Lien on Your Workers’ Comp Case
The EDD doesn’t eat the cost when SDI turns out to have been covering a compensable work injury. Labor Code Section 4903(f) lets the EDD file a lien against your workers’ comp case to recover disability benefits it paid during the period of uncertainty.11California Legislative Information. California Code, Labor Code – LAB 4903 – Liens
The lien is filed with the Workers’ Compensation Appeals Board. Once it’s on file, the workers’ comp judge has to notify the EDD before approving a settlement or issuing a decision so the lien amount can be updated through the current date.12Department of Industrial Relations. California Code of Regulations Title 8 10899 – Unemployment Compensation Disability Liens The figures the EDD lists are presumed accurate, so if you think the number is wrong, you’ll have to prove it.
When your case resolves through a Compromise and Release or a Findings and Award, the lien is paid out of the settlement proceeds before you receive your share. The EDD often negotiates its lien down to help a settlement close, especially when the total is modest. Once the lien is paid, the EDD has no further right to recover against that injury period.
If Your SDI Claim Is Denied
You have 30 days from the date on the denial notice to appeal. The appeal goes to the California Unemployment Insurance Appeals Board at the address printed on the notice. The EDD Appeal Form included with the denial is the preferred method, but a written letter with your name, address, Social Security number, and reason for appealing works as well.13California Unemployment Insurance Appeals Board. Know Your Rights and Responsibilities Before You Appeal
CUIAB then schedules a hearing before an Administrative Law Judge, with at least 10 days’ notice. You can bring witnesses and medical records. If the ALJ rules against you, a further 30-day deadline applies to appeal to the full Board. Missed deadlines are one of the most common reasons appeals get dismissed, so mark both dates the moment a notice arrives.
Avoiding Overpayments and Fraud Penalties
Collecting SDI and full workers’ comp temporary disability for the same days creates an overpayment, even when the overlap is just a timing accident. You’ll owe the money back. If the EDD finds you deliberately withheld information, the overpayment is treated as fraud, which adds a 30 percent penalty on top of what you owe and can disqualify you from future benefits for up to 23 weeks.14Employment Development Department. Benefit Overpayments FAQs
Protect yourself by reporting any workers’ comp payments to the EDD as soon as you receive them. If you’re getting partial temporary disability, report the exact weekly amount so the EDD can calculate the right difference payment. When a workers’ comp claim is accepted after SDI has already been paying, the lien handles the reconciliation. The trouble starts when checks arrive from both systems and nobody is told. It will not sort itself out on its own.
