El Paso Gun Laws: Permits, Restrictions, and Carry Rights

Gun laws in El Paso are set entirely by Texas and federal law, not by the city. If you are at least 21 and legally eligible to possess a firearm, you can carry a holstered handgun openly or concealed in most public places without any permit or training. A specific list of locations is off-limits, private property owners can post enforceable no-gun signs, and the rules change in a few important ways once you step into a vehicle, a bar, or a federal school zone.

Who Can Carry Without a Permit

Texas House Bill 1927, the Firearm Carry Act of 2021, removed the state license requirement for carrying a handgun in public.1Texas Legislature Online. Texas House Bill 1927 – Firearm Carry Act of 2021 You qualify for permitless carry in El Paso if you are 21 or older and not otherwise prohibited from possessing a firearm. The handgun must be carried in a holster.2State of Texas. Texas Penal Code 46.02 – Unlawful Carrying Weapons

You do not qualify if any of these apply:

  • You are younger than 21.
  • You have been convicted of any felony.
  • You were convicted of assault, deadly conduct, terroristic threat, or certain disorderly conduct offenses within the past five years.
  • You fall into any federal category of person barred from possessing firearms.

Carrying while disqualified is a Class A misdemeanor for most people, and a third-degree felony if you have a prior felony conviction.2State of Texas. Texas Penal Code 46.02 – Unlawful Carrying Weapons

Where Firearms Are Prohibited

Even if you are legal to carry, state law bans firearms from a defined list of sensitive places. The ones that come up most often in El Paso include:3State of Texas. Texas Penal Code 46.03 – Places Weapons Prohibited

  • K-12 school grounds, buildings, and school transportation. Public university campuses allow concealed carry for LTC holders only.
  • Polling places during elections and early voting.
  • Courthouses and offices used by a court.
  • Any business that earns 51% or more of its revenue from on-premises alcohol sales. These post a red “51%” sign.
  • High school, collegiate, or professional sporting events.
  • Racetracks.
  • Secured areas of airports.
  • Correctional and civil commitment facilities.
  • Hospitals and nursing homes.

Carrying in any of these places is a third-degree felony punishable by two to ten years in prison and a fine of up to $10,000.4State of Texas. Texas Penal Code 12.34 – Third Degree Felony Punishment This is where people most often get in trouble. Walking into a downtown El Paso bar with a handgun is a felony, not a misdemeanor. Peace officers and some other categories are exempt from most of these restrictions.5State of Texas. Texas Penal Code 46.15 – Nonapplicability

The Federal School Zone Trap

Federal law makes it a crime to possess a firearm within 1,000 feet of any school. The Gun-Free School Zones Act exempts people who hold a state-issued carry license, but it does not exempt permitless carriers.6Office of the Law Revision Counsel. 18 USC 922 – Unlawful Acts Schools are spread throughout El Paso’s residential and commercial areas, so a person carrying without an LTC can easily cross into a federal school zone without knowing it. That is one of the strongest practical arguments for getting a Texas License to Carry even though the state no longer demands one.

Private Property and Posted Signs

Businesses and property owners in El Paso can ban firearms from their premises, and Texas uses a specific signage system to do it. Ignoring a properly posted sign is a criminal offense, not just grounds for being asked to leave.

The signs must contain specific statutory wording in both English and Spanish, in contrasting colors and block letters at least one inch tall.7State of Texas. Texas Penal Code 30.06 – Trespass by License Holder with a Concealed Handgun A sign that doesn’t meet those requirements may not be enforceable. Violating a valid sign is a Class C misdemeanor with a fine of up to $200. If you are told verbally to leave and refuse, the charge climbs to a Class A misdemeanor. A business trying to ban every carrier has to post more than one sign to cover both licensed and unlicensed carry.

Carrying a Handgun in Your Vehicle

The rules change depending on your age and license status. If you are at least 21 or hold an LTC, you can have a handgun visible inside your vehicle as long as it is in a holster. If you are under 21 and do not have an LTC, the handgun cannot be in plain view at all.2State of Texas. Texas Penal Code 46.02 – Unlawful Carrying Weapons

You cannot carry a handgun in a vehicle at all if you are engaged in criminal activity or are legally prohibited from possessing a firearm. Storing the handgun in a glove box, console, or other concealed spot is a safe default. The holster rule catches people off guard: tossing a loose handgun on the passenger seat can be an offense even for a 21-year-old otherwise legal to carry.

Carrying While Intoxicated

Texas treats carrying a handgun while intoxicated as a separate offense, whether or not you hold a license. The only exceptions are if you are on your own property, inside your own vehicle, or in someone else’s vehicle or on their property with their consent.2State of Texas. Texas Penal Code 46.02 – Unlawful Carrying Weapons Carrying inside a bar is already a felony under the 51% rule, but even at a house party or on a public sidewalk, carrying your handgun while intoxicated is its own criminal offense.

Buying a Firearm

Federal law sets the minimum purchase age at 21 for handguns and 18 for rifles and shotguns when buying from a licensed dealer.6Office of the Law Revision Counsel. 18 USC 922 – Unlawful Acts You will present a valid government-issued photo ID and fill out ATF Form 4473, the Firearms Transaction Record.8Bureau of Alcohol, Tobacco, Firearms and Explosives. ATF Form 4473 – Firearms Transaction Record

The dealer then runs your information through the FBI’s National Instant Criminal Background Check System.9Federal Bureau of Investigation. Firearms Checks (NICS) NICS returns one of three responses: proceed, delayed, or denied. A “proceed” lets the sale go through immediately. A “delayed” status means the FBI needs more time, but if no final answer comes back within three business days, the dealer may legally complete the transfer.10Federal Bureau of Investigation. About NICS A denied status blocks the sale, and you can request the reason from the FBI and formally challenge it.11Federal Bureau of Investigation. Requesting Reason for and/or Challenging a NICS-Related Denial

Private Sales

Texas does not require a background check for private sales between individuals who are not licensed dealers. No Form 4473, no NICS check. It is still illegal to sell a firearm to someone you know is a felon, is subject to a protective order, is intoxicated, or is a minor.12State of Texas. Texas Penal Code 46.06 – Unlawful Transfer of Certain Weapons An unlawful transfer is a Class A misdemeanor, or a state jail felony if the weapon is a handgun transferred to a minor.

Straw Purchases

Buying a firearm for someone who is prohibited from buying one themselves is a federal crime. The penalty is up to 15 years in federal prison, and up to 25 years if the firearm is used in a felony, terrorism, or drug trafficking.13Office of the Law Revision Counsel. 18 USC 932 – Straw Purchasing of Firearms El Paso’s position on the U.S.-Mexico border makes straw purchases a particular enforcement priority for federal agents in the area.

Who Cannot Possess a Firearm at All

Federal law lists nine categories of people barred from possessing any firearm or ammunition. The most commonly relevant include anyone convicted of a crime punishable by more than one year in prison, fugitives, anyone subject to a qualifying domestic violence restraining order, anyone convicted of a misdemeanor crime of domestic violence, and anyone who is an unlawful user of or addicted to a controlled substance.6Office of the Law Revision Counsel. 18 USC 922 – Unlawful Acts That last category currently covers marijuana users regardless of state legalization, though the Supreme Court is considering the constitutionality of that restriction in 2026.

Texas adds its own rule. A person convicted of a felony cannot possess a firearm at all for five years after release from confinement or community supervision, whichever is later. After those five years, possession is allowed only inside the home where the person lives.14State of Texas. Texas Penal Code 46.04 – Unlawful Possession of Firearm Violating that restriction is a third-degree felony carrying two to ten years in prison.4State of Texas. Texas Penal Code 12.34 – Third Degree Felony Punishment

Self-Defense, Castle Doctrine, and No Duty to Retreat

Texas allows the use of deadly force in self-defense when you reasonably believe it is immediately necessary to protect yourself against someone else’s use or attempted use of unlawful deadly force. Deadly force is also justified to prevent murder, robbery, aggravated robbery, sexual assault, aggravated sexual assault, or aggravated kidnapping.15State of Texas. Texas Penal Code 9.32 – Deadly Force in Defense of Person

The castle doctrine creates a legal presumption that your belief was reasonable if someone unlawfully and forcibly enters or tries to enter your occupied home, vehicle, or workplace, or tries to forcibly remove you from one of those places. In those situations you generally do not have to prove you had no other option before using deadly force.15State of Texas. Texas Penal Code 9.32 – Deadly Force in Defense of Person

Texas has no duty to retreat. If you have a right to be where you are, have not provoked the other person, and are not engaged in criminal activity, you do not have to back away before using force. A jury is not even allowed to consider whether you could have retreated when deciding whether your use of force was reasonable.15State of Texas. Texas Penal Code 9.32 – Deadly Force in Defense of Person

Why a License to Carry Still Helps

The LTC is no longer required, but it still offers real benefits for the $40 application fee and four to six hours of training.16State of Texas. Texas Handgun License The federal Gun-Free School Zones Act exempts state license holders but not permitless carriers, so an LTC can keep you clear of federal charges simply for driving past a school.6Office of the Law Revision Counsel. 18 USC 922 – Unlawful Acts More than 35 states honor the Texas LTC through reciprocity, which matters the moment you cross into New Mexico, Arizona, or elsewhere, because Texas permitless carry stops at the state line. An LTC can also serve as an alternative to a NICS check at the counter in some circumstances, speeding up purchases, and it documents that you completed classroom instruction and a range qualification.
