The Erie, PA sales tax rate is a flat 6%, the same as Pennsylvania’s statewide rate, with no county or city surcharge added on top. That keeps Erie below Philadelphia at 8% and Allegheny County at 7%, and it means the math is the same whether you shop in the City of Erie, Millcreek Township, Harborcreek, or anywhere else in the county: price times 0.06.1Department of Revenue. The entire 6% is a state tax collected under the Pennsylvania Tax Reform Code of 1971. Erie County does not layer anything on top.2Department of Revenue. Sales, Use and Hotel Occupancy Tax
What You Pay Tax On
Pennsylvania taxes most tangible personal property at 6%, which covers electronics, appliances, furniture, and the bulk of what sits on store shelves.3Pennsylvania Code and Bulletin. 61 Pa Code Chapter 31 – Imposition Digital products get the same treatment under Act 84 of 2016: downloaded music, e-books, apps, games, streaming subscriptions, and canned software are all taxable.4Department of Revenue. Services are a mixed picture. Building maintenance and cleaning services are taxable at the full 6%, though repair work on structures permanently attached to real estate is not.5Pennsylvania Code and Bulletin. 61 Pa Code 60.1 – Building Maintenance or Building Cleaning Services Lobbying services are taxable. Custom computer programming is not. Most everyday personal services fall outside the tax.
Groceries vs. Prepared Food
Grocery shopping in Erie is largely tax-free. Raw produce, meat, dairy, bread, canned goods, and frozen foods you’d cook at home are exempt. Pennsylvania also exempts candy and gum, which is unusual compared with most states.2Department of Revenue. Sales, Use and Hotel Occupancy Tax
Everything flips the moment food is prepared for immediate consumption. Hot food, sandwiches, salad bar items, pizza by the slice, and anything from a restaurant or deli counter all carry the 6% tax. Soft drinks are taxable no matter where you buy them. A brewed cup of coffee from a café is taxable; a bag of coffee beans from the same shop is not.6Legal Information Institute. 61 Pa Code 60.7 – Sale and Preparation of Food and Beverages The line hinges on whether the item is ready to eat, not where it’s sold. Purchases made with SNAP or WIC benefits are exempt regardless of what’s in the cart.
What’s Exempt
Beyond unprepared groceries, several big categories carry no sales tax in Erie:
- Most clothing and footwear, including everyday shirts, pants, coats, dresses, sneakers, and ordinary shoes. The exemption does not cover formal day or evening wear, fur items, or sporting goods and athletic clothing. Ski boots, golf shoes, baseball cleats, and bowling shoes are taxable; regular sneakers are not.7Pennsylvania Code and Bulletin. 61 Pa Code Chapter 53 – Apparel and Footwear Exemptions
- Prescription and over-the-counter medicines.8Legal Information Institute. 61 Pa Code 52.1 – Purchases of Medicines, Medical Supplies and Equipment
- Prosthetics and therapeutic devices designed for a specific person, along with medical supplies consumed during treatment.
- Residential heating fuels: oil, natural gas, electricity, coal, and firewood used to heat your home.
- Required educational textbooks.
The clothing rule trips people up more than any other. A winter jacket from a department store is exempt. A ski jacket from a sporting goods store is taxable. The distinction isn’t price or store type, it’s whether the item is designed primarily for athletic or formal use.
Buying a Car
Vehicles are taxed at the same 6%, but the mechanism is different. Pennsylvania calculates the tax on the vehicle’s fair market value rather than just the purchase price, which matters most in private and family sales. If you buy a relative’s car for $500 and it books at $12,000, the Department of Revenue can assess tax on the $12,000 figure.9Commonwealth of Pennsylvania. Buying or Selling a Vehicle
You don’t pay this at a register. It’s collected through PennDOT at title transfer, using Form MV-4ST, available only from authorized PennDOT agents. Dealerships handle the paperwork as part of the sale; private buyers manage it themselves at a tag agency.
Online and Out-of-State Purchases
Most online purchases already include the 6% at checkout. Out-of-state businesses that make at least $100,000 in annual gross sales into Pennsylvania must register and collect the tax, and marketplace facilitators such as Amazon, eBay, and Etsy collect it on behalf of their third-party sellers once they cross that threshold.10Commonwealth of Pennsylvania. Online Retailers
When a seller doesn’t collect Pennsylvania tax, you owe use tax at the same 6% rate yourself.11Pennsylvania Department of Revenue. Use Tax This mainly catches purchases from smaller online shops, out-of-state craft fairs, and catalog orders. You can report and pay use tax two ways: file anytime through the myPATH portal, or report it annually on your PA-40 state income tax return.12Commonwealth of Pennsylvania. Use Tax for Individuals The annual PA-40 method cannot be used for motor vehicles, boats, ATVs, snowmobiles, or items imported through U.S. Customs; those require separate filing through myPATH. If the Department of Revenue gets information about untaxed purchases, it will assess the tax plus penalty and interest.
If You Sell in Erie
Any business making taxable sales in Pennsylvania must obtain a Sales, Use, and Hotel Occupancy Tax License before its first taxable sale. There is no fee. Registration runs through the myPATH portal, and the Department of Revenue assigns a filing frequency, either monthly, quarterly, or semi-annually, based on how much tax you collect.2Department of Revenue.
