In California, whether you’re an exempt or non-exempt employee controls whether you get overtime, mandatory meal breaks, and paid rest periods. For 2026, exempt status requires two things at once: a salary of at least $70,304 per year and spending more than half your working time on specific executive, administrative, or professional duties. Miss either piece and you’re non-exempt, no matter what your title says or how your employer classifies you on paper.
The 2026 Salary Floor
California Labor Code Section 515(a) sets the exempt salary minimum at twice the state minimum wage for full-time work, which is a 40-hour week or 2,080 hours per year.1California Legislative Information. California Code LAB 515 – Exemptions From Overtime With the state minimum wage rising to $16.90 per hour on January 1, 2026, the exempt threshold becomes $33.80 per hour, or $70,304 per year.2California Department of Industrial Relations. California’s Minimum Wage Set to Increase to $16.90 Per Hour
The salary has to be fixed and predetermined. Your employer can’t reduce it because a week was slow or your output was low. If pay dips below $70,304 on an annualized basis, the exemption fails and non-exempt protections apply retroactively to the point of underpayment.
The Duties Test
Clearing the salary bar is only half the test. California also requires that you be “primarily engaged” in exempt work, which the Labor Code defines as more than one-half of your worktime.1California Legislative Information. California Code LAB 515 – Exemptions From Overtime A restaurant manager earning $75,000 who spends 60% of each shift ringing up customers and stocking shelves fails the test, even if the management work is the most important part of the role.
The qualifying duties fall into three categories, drawn from the Industrial Welfare Commission’s Wage Orders.
Executive
Executive exempt work centers on managing a recognized department or business unit. You must direct at least two full-time employees and either have authority to hire and fire or have your recommendations on those decisions carry real weight.3Department of Industrial Relations. Wage Order 5-2001 – Public Housekeeping Industry The role also requires regular use of independent judgment. If every decision runs through your boss, the exemption doesn’t hold.
Administrative
Administrative exempt work is non-manual and tied to management policies or general business operations, performed under only general supervision.3Department of Industrial Relations. Wage Order 5-2001 – Public Housekeeping Industry HR directors, finance managers, and operations leads who shape how the company runs tend to fit; employees who follow scripts or standardized procedures generally don’t, because the exemption turns on independent judgment.
Professional
The professional category covers two groups. Licensed professionals hold a California state license in law, medicine, dentistry, optometry, architecture, engineering, teaching, or accounting. Learned and artistic professionals do mainly intellectual or creative work whose output can’t be standardized to a set time period.3Department of Industrial Relations. Wage Order 5-2001 – Public Housekeeping Industry A designer creating original campaigns may qualify; one resizing templates generally won’t.
Two Categories That Follow Different Rules
Computer professionals and outside salespeople operate under their own tests, and the thresholds don’t match the standard white-collar rules.
Software engineers, systems analysts, and programmers can be exempt at an elevated pay threshold that adjusts annually with the California Consumer Price Index. For 2026, the minimum is $58.85 per hour, or $122,573.13 per year on a salary basis.4Department of Industrial Relations. Overtime Exemption for Computer Software Employees The work must be intellectual or creative and involve systems analysis, software design, or program development. People who primarily operate, maintain, or repair hardware don’t qualify, and neither do trainees still developing their skills.5California Legislative Information. California Code LAB 515.5 – Computer Software Employee Exemption A job title alone never controls; being called a “software engineer” doesn’t make you exempt if the actual work doesn’t match.
Outside salespeople are the one exempt category with no minimum salary. The test is where and how you work: you must customarily and regularly spend more than half your working time away from the employer’s premises selling or taking orders.6Department of Industrial Relations. Industrial Welfare Commission Order No. 8-80 An even split between office work and field sales falls on the non-exempt side.
What Non-Exempt Status Gets You
If you’re non-exempt, California’s overtime rules are among the strongest in the country. Any work beyond eight hours in a day or 40 hours in a week pays time-and-a-half. Past 12 hours in a single day, the rate doubles. On the seventh consecutive day in a workweek, the first eight hours pay time-and-a-half and anything after pays double time.7California Legislative Information. California Code LAB 510 – Overtime Compensation The daily trigger is what catches many employers off guard, since most states only count weekly hours.
Non-exempt employees are also entitled to meal and rest breaks:
- A 30-minute unpaid meal period before the end of the fifth hour of work. If the total shift is six hours or less, you and your employer can mutually agree to skip it.
- A second 30-minute unpaid meal period if the shift runs past 10 hours. This one can be waived by mutual agreement only if the shift stays under 12 hours and the first meal wasn’t waived.8California Legislative Information. California Code LAB 512 – Meal Periods
- A 10-minute paid rest period for every four hours worked or major fraction of four hours.9Department of Industrial Relations. Rest Periods and Lactation Accommodation
When an employer fails to provide a required break, you’re owed one extra hour of pay at your regular rate for each workday the violation happens.10California Legislative Information. California Code Labor Code LAB 226.7 – Employer Failure to Provide Meal or Rest or Recovery Period California courts treat those payments as wages rather than penalties, which gives them a longer statute of limitations and can trigger waiting time penalties if they’re unpaid at separation.
If You’ve Been Misclassified
Misclassification isn’t a paperwork issue. When an employer calls someone exempt who should be non-exempt, every unpaid overtime hour, missed break, and skipped premium turns into a financial liability that builds over time.
A misclassified employee can recover:
- Up to three years of unpaid overtime at the time-and-a-half or double-time rate, plus one hour of premium pay for each workday a meal or rest break was missed.11Department of Industrial Relations. How to File a Wage Claim
- Waiting time penalties if you’ve left the company and those wages aren’t settled. Your daily pay rate keeps accruing as a penalty for up to 30 days.12California Legislative Information. California Code LAB 203 – Waiting Time Penalties
- Reasonable attorney’s fees if you prevail, which lowers the barrier to bringing a claim.
- Reimbursement for necessary work expenses that were never covered, such as cell phone bills, mileage, or home office costs, plus interest.13California Legislative Information. California Code Labor Code LAB 2802 – Employer Indemnification of Employee Expenditures
How to File a Claim
The most direct route is a wage claim with the California Labor Commissioner’s Office, also called the Division of Labor Standards Enforcement. Claims can be filed online, by email, by mail, or in person.11Department of Industrial Relations. How to File a Wage Claim After filing, the office investigates and schedules a settlement conference. If that doesn’t resolve things, the case moves to a formal hearing where an officer reviews evidence and issues a decision. You don’t need a lawyer to file, though one helps when the amounts are large or the facts are complex.
Timing matters. The statute of limitations for unpaid overtime, missed meal and rest breaks, and minimum wage violations is three years from the date of each violation.11Department of Industrial Relations. How to File a Wage Claim Older violations drop off as time passes. If you suspect you’ve been misclassified, start tracking your actual hours and the tasks that fill each day. That record is especially valuable for the duties test, where the question is whether you really spend more than half your time on exempt work.1California Legislative Information.
