Exenatide Class Action in Kentucky: Why the Byetta Suits Failed

There is no exenatide class action in Kentucky to join. Kentucky residents who alleged that Byetta (exenatide) caused pancreatic or thyroid cancer filed individual lawsuits that were consolidated with thousands of similar claims nationwide into a federal multidistrict litigation, In re Incretin-Based Therapies Products Liability Litigation (MDL No. 2452), in the Southern District of California. The courts dismissed those claims, the Ninth Circuit affirmed in March 2022, and the MDL officially closed on November 9, 2022.1GovInfo. Why Patients Sued Over Byetta

Byetta is an injectable Type 2 diabetes drug the FDA approved in 2005. It belongs to a class called GLP-1 receptor agonists. In 2007 the FDA added a pancreatitis warning to the label and strengthened it over the following two years to cover fatal and nonfatal hemorrhagic or necrotizing pancreatitis.2National Library of Medicine. Exenatide Therapy and the Risk of Pancreatitis and Pancreatic Cancer In March 2013 the FDA announced a broader investigation into whether incretin mimetics as a class might raise the risk of pancreatitis and pancreatic cancer.3RAPS. Class of Diabetes Drugs Associated With Pancreatitis That announcement helped drive the wave of lawsuits that followed.

Plaintiffs alleged failure to warn, design defect, negligence, breach of warranty, and fraud. The core claim was that manufacturers should have warned patients about a possible pancreatic cancer risk.

How a Kentucky Case Actually Moved Through the Courts

A Kentucky plaintiff’s case did not stay in Kentucky. Daniel Curtis, a 53-year-old resident of Sterling, Kentucky, alleged he took Byetta from May 2007 to January 2009 and was diagnosed with thyroid cancer in October 2012. His complaint, Daniel Curtis v. Amylin Pharmaceuticals LLC, et al. (Case No. 3:13-cv-02424), was filed in 2013 in the U.S. District Court for the Southern District of California as part of the consolidated proceedings.4Top Class Actions. His case was one of more than 7,000 individual lawsuits filed against the manufacturers over the years.5FindLaw. Byetta Lawsuit Information Although people often called it a “class action,” the exenatide litigation was a mass tort. Each plaintiff kept a separate suit, and the cases were grouped only for pretrial proceedings in front of Judge Anthony J. Battaglia after the U.S. Judicial Panel on Multidistrict Litigation created the MDL in August 2013.6U.S. Judicial Panel on Multidistrict Litigation. Why the Lawsuits Failed

On March 9, 2021, Judge Battaglia issued an omnibus order that ended the litigation on two independent grounds.

The first was federal preemption. The court concluded that the FDA had “specifically considered pancreatic cancer risk” repeatedly and had maintained that the evidence of a causal link was “indeterminate.” Because the regulatory record showed the FDA would not have approved a pancreatic cancer warning, the manufacturers could not be held liable under state law for failing to add one.7GovInfo. The second was expert evidence. The court applied the Daubert reliability standard and excluded all seven of the plaintiffs’ challenged expert witnesses, finding problems ranging from selective data and cherry-picked results to reliance on information supplied by plaintiffs’ counsel rather than independent scientific review.8Expert Institute. Judge Grants Defendants Motion for Summary Judgment in Diabetes Drug MDL Without a qualified expert to testify that the drugs caused pancreatic cancer, plaintiffs could not establish general causation.

Plaintiffs appealed. On March 28, 2022, the Ninth Circuit affirmed, holding that the plaintiffs’ general causation expert had failed to adequately explain the methodology and had not accounted for multiple studies published between 2015 and 2019 finding no causal link. The court described the expert’s conclusions as “subjective beliefs or unsupported speculation.”1GovInfo. In re Incretin-Based Therapies Products Liability Litigation, Ninth Circuit Mandate

Where Things Stand Now

In June 2022, the Plaintiffs’ Steering Committee agreed not to seek further appellate review. Judge Battaglia then dismissed the remaining cases, and the MDL closed on November 9, 2022.1GovInfo. The science has continued to line up with the court’s conclusion. A 2024 study published in JAMA that analyzed more than 543,000 patients who used GLP-1 drugs over seven years found no increased incidence of pancreatic cancer.9Drugwatch. Byetta itself is no longer on the market. AstraZeneca notified the FDA in August 2024 that it was permanently discontinuing the drug,11FDA. Discontinuation of Bydureon BCise and Byetta AstraZeneca did not publicly state why, and the file does not tie the discontinuation to the litigation, which had ended two years earlier.

What This Means If You Took Byetta in Kentucky

If you are a Kentucky resident who took Byetta and later developed pancreatic cancer, there is no open class action, no open MDL, and no settlement program described in the available record. The courts rejected the central causation theory and the Ninth Circuit affirmed that rejection. Any individual claim at this point would face the same preemption ruling and the same scientific record the plaintiffs could not overcome. If you believe you were harmed, a product liability attorney licensed in Kentucky can tell you whether any avenue remains open given the closed MDL and the applicable statute of limitations.
