Expired Registration in Illinois: Penalties, Renewal, and Defenses

An expired registration in Illinois costs you a $20 late fee once you’re more than 30 days past the expiration date, and driving on expired plates can bring a traffic citation, impoundment, and, if the registration was suspended for unpaid fees, a business-offense fine of $500 to $1,000.1Illinois General Assembly. 625 ILCS 5 Illinois Vehicle Code – Section 3-701 The Secretary of State handles renewal online, by mail, or in person, and the standard passenger fee is $151.2Illinois Secretary of State. What Happens If You Get Pulled Over

Illinois law prohibits operating any vehicle on a public road without current, valid registration under 625 ILCS 5/3-701.1Illinois General Assembly. 625 ILCS 5 Illinois Vehicle Code – Section 3-701 If an officer stops you with expired plates, you’ll receive a citation. The fine depends on the circumstances and the court.

The charge escalates when the registration has been formally suspended for nonpayment of required fees. That version is a business offense carrying a fine between $500 and $1,000, with steeper penalties for repeat offenders. A vehicle with no valid registration can also be impounded on the spot, and towing and daily storage fees get added to whatever you already owe.

An expired-registration citation is a non-moving violation, so it won’t put points on your driving record. Insurance companies can still see it, though, and a pattern of registration offenses can push premiums up over time, especially alongside other infractions.

The Late Fee for Renewing After the Expiration Date

Even if you never leave the driveway, renewing more than 30 days past the expiration date triggers a $20 late fee on top of the $151 registration cost. Let it go long enough and the Secretary of State may require you to purchase a new registration rather than simply renewing, which costs more again. Renewing promptly is always the cheapest route back to compliance.

How to Renew Right Now

The Secretary of State mails renewal notices about six weeks before expiration, and that notice contains the registration ID and PIN you’ll need. If you still have it, pull it out. If you don’t, the online system can usually locate your record from your plate and VIN.

Emissions Testing in Chicago and Metro-East St. Louis

Vehicles registered in the Chicago metro area and the Metro-East St. Louis region must pass an emissions inspection before renewal. The requirement covers most gasoline-powered vehicles from model year 1996 and newer once they reach four years of age.5Illinois Environmental Protection Agency. Vehicle Emissions Testing Program Outside those areas, no test is required. Inspection fees run between $10 and $50, and results go to the Secretary of State electronically, so you don’t need to deliver paperwork yourself.

Defenses If You’ve Already Been Cited

A citation doesn’t automatically mean paying the full penalty. The most direct defense is showing the vehicle wasn’t driven during the lapse. If the car sat in a garage or storage facility the whole time, documentation such as a storage receipt or a dated photo log can support that. The statute targets vehicles operating on public roads, not vehicles sitting unused on private property.

Showing that you renewed the registration before your court date also helps. Judges often reduce or dismiss fines when the underlying problem has been fixed, particularly for a first offense. Saying you didn’t know the registration had expired rarely works on its own, since the state sends renewal notices well in advance.

Temporary Permits While You Wait on Paperwork

If you’ve just bought a vehicle or are waiting on title paperwork, the Secretary of State can issue a temporary registration permit so you can drive legally in the meantime.6Illinois General Assembly. 625 ILCS 5/3-407 – Temporary Permit or Registration Pending Registration The permit lasts up to 90 days from issuance, though the Secretary of State can shorten or extend that window.7Illinois General Assembly. 92 Ill Adm Code 1010.420 – Temporary Permit Pending Registration in Illinois You’ll need proof of ownership and proof of insurance, and the fee is lower than full registration. Once the permit lapses, you’re in the same position as anyone else with expired registration, so treat the 90 days as a hard deadline.

New to Illinois With Out-of-State Plates

If your Illinois registration hasn’t expired because you never had one, the rules are different. New residents have 30 days after establishing residency to apply for an Illinois title and register the vehicle, assuming it was properly registered in another state.8Illinois Secretary of State. New Residents – How Do I? Bring the original out-of-state title, proof of Illinois residency, proof of insurance meeting Illinois minimums, and a completed vehicle transaction application to a Secretary of State facility. Emissions testing applies on the same terms as for existing residents. Missing the 30-day window exposes you to fines, so it belongs on the calendar.
