Failure to Comply in Colorado: Contempt, Liens, and Enforcement

Failure to comply in Colorado — with a court order, a civil judgment, or a directive from a state agency — can bring fines, interest, wage garnishment, property liens, asset seizures, license consequences, contempt findings, and in some cases new criminal charges. How hard the response lands depends on what you ignored and whether a judge or regulator believes you did it on purpose.

Ignoring a Criminal Court Order

Skipping court while out on bond for a felony is itself a class 6 felony if you knowingly did it to avoid prosecution. The exposure is up to 18 months in prison and a fine as high as $100,000.1Justia. Colorado Code 18-8-212 – Violation of Bail Bond Conditions2Justia. Colorado Code 18-1.3-401 – Felonies Classified – Presumptive Penalties Failing to appear for a hearing where victims or witnesses have already shown up is a class 2 misdemeanor, whether the underlying case is a felony or a misdemeanor.

A probation violation is handled separately from the original charge. A judge who finds you violated the terms can extend supervision, add conditions such as community service or treatment, raise your fines, or revoke probation altogether and impose the original jail or prison sentence.

Violating a protection order is a class 2 misdemeanor on a first offense and a class 1 misdemeanor if you have a prior for the same thing, the order rested on stalking allegations, or the parties were in an intimate relationship. Peace officers must arrest you, or seek a warrant, whenever they have probable cause to believe you violated a provision of a protection order that was properly served on you.3Justia. Not Paying a Civil Judgment

Once a court enters a money judgment against you, paying it is not optional. A creditor who does not get voluntary payment can pursue wage garnishment, record liens against your property, and levy your bank accounts. Ignoring court-ordered child support or spousal maintenance can push you into contempt, where a judge can jail you until payments resume. Persistent nonpayment of child support can be referred to the Colorado Department of Human Services, which can intercept your tax refunds and move to suspend professional licenses.4Colorado Judicial Branch. The debt also grows while you wait. When no contract sets a different rate, Colorado’s statutory interest is 8% per year, compounded annually, running from the date the money was due until the judgment is paid.5Justia. Colorado Code 5-12-102 – Statutory Interest – Definition On a $50,000 judgment, that is roughly $4,000 the first year, and the compounding accelerates from there.

A district court judgment stays enforceable for 20 years. County court judgments are good for six. In both cases the creditor can revive the judgment before it expires and effectively reset the clock. A judgment lien recorded against real estate also runs six years and can be revived and re-recorded.6FindLaw. Colorado Code 13-52-102 – Judgments – Lien on Real Estate – Duration

Ignoring a State Agency

Agencies run their own enforcement tracks, and silence rarely makes anything smaller.

Taxes

If you ignore a Colorado Department of Revenue notice about unpaid taxes, the department can file liens, garnish wages, seize bank accounts, and refer the debt to a third-party collector.7Colorado Department of Revenue. Collections Where the department finds willful evasion, the matter turns criminal. Tax evasion is a class 6 felony: up to 18 months in prison and up to $100,000 in fines for an individual, $500,000 for a corporation. Willfully failing to file a return or pay a required tax is a misdemeanor carrying up to one year in jail and a $50,000 fine.8Justia. Colorado Code 39-21-118 – Criminal Penalties

Driver’s License

Ignoring a Division of Motor Vehicles notice about a suspension can lengthen the suspension and raise reinstatement fees. Point-based suspension kicks in at 12 or more points in 12 months, or 18 or more in 24 months. Drivers under 18 can be suspended at just six points.9Justia. Colorado Code 42-2-127 – Authority to Suspend License – to Deny License – Type of Conviction – Points

Professional Licenses and Workers’ Compensation

The Colorado Department of Regulatory Agencies can deny, suspend, or revoke a professional license when a regulator finds conduct that constitutes grounds for discipline under the relevant practice act.10Justia. Colorado Code 12-20-404 – Disciplinary Actions – Regulator Powers

Employers without the required workers’ compensation insurance face daily fines of up to $250 for a first violation and $250 to $500 per day after that. Fines can be assessed retroactively for up to three years before the employer was notified.11Justia. Colorado Code 8-43-409 – Defaulting Employer

How Enforcement Actually Reaches You

Wage garnishment, liens, and asset seizures are the mechanics behind most of what is above, and they often run at the same time.

For ordinary debts, Colorado caps garnishment at 20% of your disposable earnings for the workweek, or the amount by which your earnings exceed 40 times the state or federal minimum wage, whichever leaves you with more pay. That is tighter than the 25% federal ceiling. Child support garnishment runs on different rules: up to 50% of disposable earnings if you support another spouse or child, and up to 60% if you do not. Both figures rise by five percentage points when the support order is more than 12 weeks overdue.12Justia. Colorado Code 13-54-104 – Restrictions on Garnishment and Levy

A creditor who records a transcript of a judgment in the county where you own real estate creates a lien that blocks you from selling or refinancing until the debt is cleared. The Department of Revenue can file liens for unpaid tax debts the same way.7Colorado Department of Revenue. Collections When softer collection efforts fail, the department can freeze bank accounts, garnish wages, and confiscate property such as vehicles or real estate to recover unpaid taxes.13FindLaw. Colorado Code 39-21-114 – Methods of Enforcing Collection Courts can authorize comparable seizures to satisfy civil judgments through writs of execution.

What Creditors Cannot Take

Colorado shields certain property even when a valid judgment exists. The main exemptions against writs of execution and attachment include:

  • Motor vehicles up to $15,000 in aggregate value across two vehicles or bicycles, or up to $25,000 if you or a dependent is elderly or disabled.
  • Household goods up to $6,000 in value.
  • Clothing up to $2,000 per person for you and each dependent.
  • Jewelry and watches up to $2,500 per person.
  • Tools of your trade up to $60,000 for your primary occupation, or $20,000 for a secondary one.
  • Up to $2,500 across all depository accounts in your name.
  • Life insurance cash value up to $250,000 if the policy has been in force for at least 48 consecutive months.

These figures come from the current exemption statute.14Justia. Colorado Code 13-54-102 – Property Exempt

Contempt of Court

When someone willfully ignores a court order, the opposing party or the court itself can start contempt proceedings under Colorado Rule of Civil Procedure 107. Colorado recognizes two kinds, and the difference matters.

Remedial contempt is built to force compliance. If a judge finds you can follow the order and are choosing not to, you can be fined or jailed until you do. The detention ends the moment you comply. Courts can also assess attorney fees and costs against the noncompliant party.

Punitive contempt works like a criminal sentence. It punishes conduct the court finds offensive to its authority. The maximum jail sentence is six months unless you are offered a jury trial. A punitive sentence cannot be suspended based on future compliance, and probation is not available.

When the Order You Ignored Is a Parenting Plan

Interference with court-ordered parenting time has its own statutory track. Either parent can file a verified motion, and the court must act within 35 days by denying the motion, scheduling a hearing, or sending the parties to mediation.15Justia. Colorado Code 14-10-129.5 – Disputes Concerning Parenting Time

If the court finds a violation, the available remedies are broad: makeup parenting time of the same type and duration that was denied, modification of the parenting plan, a bond guaranteeing future compliance, an order to pay for parenting education or family counseling, or a finding of contempt. The violating parent typically pays the costs of these proceedings. Makeup time generally has to happen within six months, or within one year for holidays that cannot be replicated sooner.15Justia. Colorado Code 14-10-129.5 – Disputes Concerning Parenting Time

Clearing the Record Later

A failure-to-appear conviction or a contempt finding can show up on background checks for years. Colorado’s record-sealing laws, broadened by the Clean Slate Act, let many people seal records after they finish their sentences and wait the required time:

  • Petty offenses: one year after final disposition or release from supervision.
  • Misdemeanors: three years after final disposition or release from supervision.
  • Felonies: five years after final disposition or release from supervision.

You cannot have been charged with or convicted of another criminal offense during the waiting period. Some records seal automatically under Clean Slate without a petition. Serious offenses are permanently excluded, including class 1 through 3 felonies, level 1 drug felonies, sex offenses, crimes of violence, felony domestic violence, and felony violations of protection orders.16Colorado General Assembly.
