Failure to Use Due Care in Florida: Fines, Points, and Insurance

A failure to use due care ticket in Florida is a noncriminal moving violation issued under the state’s careless driving and special hazards statutes. The base fine is $60, but mandatory court costs and surcharges push the actual bill to roughly $120 before any county add-ons. A conviction also puts three points on your license (four if the citation came out of a crash), and insurers typically treat it as a rateable moving violation for the next three to five years. You have 30 days to respond.

What the Citation Actually Means

Two statutes work together here. The careless driving law requires every driver to operate in a careful and prudent manner, accounting for road width, grade, curves, traffic, and all other circumstances, so as not to endanger anyone’s life or property.1Florida Senate. Florida Code 316.1925 – Careless Driving The special hazards statute adds that even when you’re under the posted speed limit, you still have to slow down at intersections, curves, hill crests, and narrow roads, and whenever pedestrians, weather, or other conditions create extra risk.2Florida Senate. Florida Code 316.185 – Special Hazards

The operative phrase in both is the duty “to use due care.” That’s a judgment standard rather than a numeric one. An officer doesn’t need to clock you at a specific speed or catch you running a specific signal. They decide whether your driving was reasonable given everything happening around you. That subjectivity is what makes these citations common, and it’s also what makes them more contestable than most traffic tickets.

One boundary worth drawing: this is not reckless driving. Reckless driving requires willful or wanton disregard for safety and is a criminal offense carrying possible jail time.3Justia. Florida Code 316.192 – Reckless Driving A failure to use due care citation is a civil infraction. No jail. No criminal record. The threshold is ordinary carelessness or inattention.

What It Costs

The statutory base fine for a moving violation that doesn’t require a court appearance is $60. Nobody actually pays $60. Mandatory court costs, an administrative fee, the Article V assessment, and a radio system surcharge stack on top, bringing the minimum to about $120.50 before any county-specific fees.4The Florida Legislature. Florida Code 318.18 – Amount of Penalties Some counties add their own charges, so your final total can run higher.

A conviction also adds three points to your Florida driving record. If the citation was issued in connection with a crash, that goes up to four. Points accumulate against suspension thresholds: 12 points within 12 months brings a suspension of up to 30 days, 18 points within 18 months means up to three months, and 24 points within 36 months results in a suspension of up to one year.5Florida Senate. Florida Code 322.27 – Authority of Department to Suspend or Revoke License

If you contest the citation at a hearing and lose, the hearing official can impose a civil penalty of up to $500, or up to $1,000 if the violation happened in a school zone or construction zone.6Justia. Florida Code 318.14 – Noncriminal Traffic Infractions; Exception; Procedures That’s a real factor to weigh before requesting a hearing.

Your 30-Day Window

You have 30 days from the date of the citation to respond. Within that window, you can pay the civil penalty (which counts as admitting the infraction), enter a payment plan with the clerk of court, elect traffic school, or request a hearing to contest the ticket.6Justia. Florida Code 318.14 – Noncriminal Traffic Infractions; Exception; Procedures

Miss the deadline and the problem gets much larger, much faster. The clerk notifies the Department of Highway Safety and Motor Vehicles, which issues a license suspension that takes effect 20 days after it’s mailed. Reinstatement requires paying all outstanding fines plus a $60 reinstatement fee, and the suspension stays on your record for seven years. Forgetting the ticket, moving, or missing the mail does not stop any of this. You can still request a hearing within 180 days of the violation date even after a non-compliance suspension, but you’ll have to clear the suspension through the clerk.7Justia. Florida Code 318.15 – Failure to Comply With Civil Penalty or to Appear; Penalty

Keeping the Points Off With Traffic School

Florida lets eligible drivers elect a Basic Driver Improvement course instead of taking the points. When you elect it, the court withholds adjudication, your base fine is reduced by 18%, and no points are added to your record.6Justia. Florida Code 318.14 – Noncriminal Traffic Infractions; Exception; Procedures You still pay the surcharges. The point avoidance is what matters, because points drive insurance premiums and count toward suspension thresholds.

The eligibility rules:

If you elect the course and then fail to finish it on time, you’re deemed to have admitted the infraction, adjudication is entered, and the points go on your record anyway.7Justia. Florida Code 318.15 – Failure to Comply With Civil Penalty or to Appear; Penalty

What It Does to Your Insurance

Insurers treat this as a moving violation and rate it accordingly. A single moving violation commonly triggers a premium increase in the 10% to 20% range at renewal, and most carriers keep it as a rating factor for three to five years. The $120 citation can translate to several hundred dollars in added premium before it ages off.

If the citation came out of an at-fault crash, the hit is larger. An insurer may reclassify you as high-risk, which can mean a much steeper premium or nonrenewal. Electing the traffic school course can soften the insurance impact because some carriers rate off the point record rather than the raw citation history, but that depends on the company.

If There Was a Crash

A failure to use due care citation can follow you into civil court. In Florida, a traffic violation serves as prima facie evidence of negligence, which creates a legal presumption that you were negligent and shifts the burden to you to show otherwise.8The Florida Bar. Standard Jury Instructions – Civil Cases – Statute or Ordinance It isn’t an automatic finding of liability. The other side still has to prove the violation actually caused their injuries. But they don’t have to independently prove you drove unreasonably — the citation does that work for them.

Florida uses a modified comparative negligence rule, in effect since 2023. A plaintiff’s recovery is reduced by their share of fault, and if a plaintiff is found more than 50% at fault for their own harm, they recover nothing. This applies to all negligence actions other than medical malpractice.9Justia. Florida Code 768.81 – Comparative Fault If you can show the other party was texting, jaywalking, or otherwise contributing to the crash, you can shrink or eliminate their recovery. The citation remains a headwind, but it isn’t the end of the analysis.

If You Have an Out-of-State License

Driving home and ignoring the ticket is not an option. Florida participates in the Nonresident Violator Compact, which covers most states. If you fail to respond, Florida notifies your home state’s motor vehicle agency, and your home state then moves to suspend your license. The 30-day deadline applies the same way it does to Florida residents. Paying by mail is usually the practical choice if you don’t plan to come back for a hearing.

Fighting the Ticket

Because this violation turns on an officer’s judgment rather than a measurement, there’s more room to challenge it than there is with most traffic citations. The angles that tend to work:

  • Showing your driving was objectively reasonable given the conditions, using dashcam footage, witnesses, or accident reconstruction. This is the strongest line of defense and the one most worth building a case around.
  • Disputing the conditions the officer relied on. If you were cited for failing to adjust for a hazard that wasn’t actually present, weather data, maintenance records, and timestamped photos can undercut the citation.
  • Pointing to the absence of corroborating evidence. When the officer’s observation stands alone, with no witnesses, no video, and no physical evidence, you can argue the citation rests on a single subjective impression.
  • Identifying procedural errors on the citation itself, such as the wrong statute, an incorrect vehicle description, or missing required fields. These defenses are narrow but occasionally succeed when the errors are substantial.

Weigh the upside against the downside. A hearing official who finds against you can impose up to $500 in civil penalties (up to $1,000 in school and construction zones), which is more than the standard fine.6Justia. Florida Code 318.14 – Noncriminal Traffic Infractions; Exception; Procedures For most people with a clean record, electing traffic school is the lower-risk way to protect the driving record.

When a Lawyer Is Worth the Money

For a standalone citation with no crash and no prior violations, traffic school usually handles it. Legal help becomes more valuable when the stakes rise. If you’re close to a point threshold that would trigger a license suspension, an attorney can negotiate with prosecutors or push for a reduced charge. If the citation came alongside an accident and a personal injury claim is possible, challenging the citation’s validity early can limit your civil exposure. Traffic attorneys typically charge flat fees that vary with the complexity of the case and whether a hearing is involved. Measured against three to five years of elevated premiums, representation is often the cheaper outcome, particularly if you already have violations on your record from the past few years.
