A failure to yield ticket with an accident in Virginia starts as a traffic infraction carrying a $30 fine, a $51 court processing fee, and four demerit points on your driving record.1Supreme Court of Virginia. Rules of Supreme Court of Virginia Part Three B Traffic Infractions and Uniform Fine Schedule If the officer judged the driving dangerous, the same conduct can be charged as reckless driving, which is a Class 1 misdemeanor with up to 12 months in jail and a $2,500 fine. And whatever you plead to the ticket can be used against you in a civil lawsuit by the other driver.
The Standard Infraction: Fine, Costs, and Points
Most failure-to-yield violations are prepayable at $30 plus $51 in court costs, for a total of $81 if you simply pay the ticket.1Supreme Court of Virginia. Rules of Supreme Court of Virginia Part Three B Traffic Infractions and Uniform Fine Schedule Paying is a conviction. The prepayable amount is a floor; if you go to court and lose, the judge can impose a fine up to $250, the statutory maximum for this class of infraction.2Virginia Code Commission. Virginia Code 46.2-113 – Violations of This Title, Penalties
The Virginia DMV assigns four demerit points for a failure-to-yield conviction, and they stay on your record for three years from the date of the offense.3Virginia Department of Motor Vehicles. Four Point Violations Enough demerit points in a short window can trigger a mandatory driver improvement clinic or license suspension, so the real impact depends on what else is already on your record.
The statute number printed on your summons matters because it identifies what the officer believes you did: failing to yield at an uncontrolled intersection, running a stop or yield sign, turning left into oncoming traffic, or pulling out from a private road.4Virginia Code Commission. When the Charge Becomes Reckless Driving
An accident changes what the officer can charge. Significant property damage, injuries, or driving the officer considered dangerous can push the same conduct up to reckless driving. Two statutes come into play most often. Virginia Code 46.2-863 makes it reckless driving to pull onto a highway from a side road without stopping when oncoming traffic is within 500 feet.8Virginia Code Commission. Virginia Code Title 46.2 Chapter 8 – Article 7 Reckless Driving and Improper Driving For accidents that don’t fit that scenario, officers often use Virginia Code 46.2-852, the general reckless driving statute, which covers driving in a manner that endangers life or property regardless of speed.9Virginia Code Commission. Virginia Code 46.2-852 – Reckless Driving, General Rule

Six Point Violations If you’re charged with reckless driving, this is no longer a ticket to simply mail in. Hire a lawyer.
Improper Driving as a Reduction
Virginia Code 46.2-869 gives judges a safety valve. When the court finds the degree of culpability was slight, it can convict the driver of improper driving instead of reckless driving, and a prosecutor can agree to the same reduction before the court rules.13Virginia Code Commission. Virginia Code 46.2-869 – Improper Driving, Penalty Improper driving is a traffic infraction, not a criminal offense, with a maximum fine of $500. In accident cases where the collision was minor and no one was seriously hurt, this reduction is often the realistic goal.
How a Conviction Follows You Into Civil Court
The ticket is only part of the exposure. The other driver has two years from the date of the accident to file a personal injury lawsuit against you.14Virginia Code Commission. Virginia Code Title 8.01 Chapter 4 – Article 3 Personal Actions Generally
Here is the detail most Virginia drivers don’t know. Under Virginia Code 8.01-418, a guilty plea, a nolo contendere plea, or a guilty finding entered in your absence on the traffic ticket is admissible in the civil case arising from the same accident.15Virginia Code Commission. Virginia Code 8.01-418 – When Plea of Guilty or Nolo Contendere, Finding of Guilt In most states a no-contest plea insulates you from this. Virginia is different. Pleading nolo contendere to the failure-to-yield ticket hands the other driver’s attorney documentary proof of fault.
Virginia also follows contributory negligence, one of the strictest fault rules in the country. If you were the one hit but a jury finds you even partially at fault, you recover nothing. A failure-to-yield conviction on your record makes it easy for the other side to argue you contributed to the crash. For drivers who were ticketed but believe the other driver also shared fault, fighting the ticket in traffic court has consequences well beyond the $81.
Insurance, Employment, and CDL Fallout
A failure-to-yield conviction combined with an at-fault accident is one of the worst pairings for your insurance rates. Insurers see both the moving violation and the collision, and most will raise premiums at renewal. Expect the increase to persist for three to five years depending on the carrier.
A reckless driving conviction hits harder. Some rental car companies check DMV records and will refuse to rent to anyone with a reckless driving conviction within the past 48 months, or with two or more accidents within 36 months.16Budget Rent a Car. Driver’s License Requirements If your job requires driving a company vehicle, a reckless driving conviction can jeopardize your employment.
Commercial drivers face the steepest consequences. Under federal rules, a serious traffic violation can trigger CDL disqualification: 60 days for two serious violations within three years, and 120 days for three or more. Failure to yield can qualify as a serious traffic violation, so CDL holders should treat even a standard infraction as high stakes.
What to Do Before Your Court Date
Start by gathering the paperwork. The crash report (Form FR-300P) filed by the responding officer with the DMV is the single most important document. It contains the officer’s narrative, a diagram of vehicle positions, and witness information. The DMV keeps crash reports for at least 36 months, and you can request a copy for a fee set by the Commissioner.17Virginia Code Commission. Virginia Code Title 46.2 Chapter 3 – Licensure of Drivers Read the narrative carefully. The report sometimes differs from what the officer told you at the scene or from what actually happened.
Request a certified copy of your Virginia driving record from the DMV online portal.18Virginia Department of Motor Vehicles. Request a Copy of Your Driver or Vehicle Record The court will look at your history, and a clean record works in your favor, especially if you’re asking for a reduction from reckless driving to improper driving.
Confirm the statute, the officer’s name, and the court location and date directly from the summons. Virginia law requires courts to accept a nolo contendere plea in traffic infraction cases.19Virginia Code Commission. Virginia Code 19.2-254.1 – Procedure in Traffic Infraction Cases As noted above, it will not protect you civilly. The only ways to keep the ticket out of a later lawsuit are a dismissal or a not-guilty finding.
Dashcam Footage
Dashcam video can be powerful evidence. Bring the footage on a USB drive and be ready to explain when the camera was installed, that it was recording at the time of the accident, and that the footage has not been edited. Video cuts both ways: if it shows you distracted or driving aggressively, it will hurt you. Watch it honestly before deciding to offer it.
At the Hearing
Virginia General District Court traffic dockets move fast. The officer who issued the citation testifies first, describing the scene and explaining the basis for the charge. The judge then gives you the chance to respond, present evidence, and point out inconsistencies in the crash report. Keep it focused and factual. Judges hear dozens of these cases in a morning.
If you’re found guilty of a traffic infraction, you pay the fine and $51 in court costs that day. Court costs for a reckless driving misdemeanor are $61. Failing to appear adds a $35 fee on top of the rest.20Virginia Code Commission. Virginia Code 16.1-69.48:1 – Fixed Fee for Misdemeanors, Traffic Infractions and Other Violations in District Court Unpaid amounts can lead to DMV license suspension.
If you’re convicted and believe the ruling was wrong, you have the right to appeal to the Circuit Court for a completely new trial. The notice of appeal must be filed within 10 days of the General District Court ruling. For a simple infraction, weigh the time and expense of an appeal against the fine and the four demerit points before pursuing it. For reckless driving, the appeal is usually worth serious consideration.
