Filing a Petition to Confirm Arbitration Award in California

To turn a California arbitration award into something a sheriff can enforce, you file a petition in superior court asking a judge to confirm the award and enter it as a judgment. Filing a petition to confirm an arbitration award in California is a short, document-driven process: wait at least 10 days after the signed award is served, prepare Form ADR-106 with the arbitration agreement and award attached, pay the $435 filing fee, and serve every other party to the arbitration. Once the judge signs the judgment, the award carries the same force as a trial verdict and unlocks wage garnishments, bank levies, and property liens.

Documents You Need Before You Start

California law requires three things in every petition to confirm: a copy of the arbitration agreement (or a description of it), the names of the arbitrators, and a copy of the signed award with any written opinion.1California Legislative Information. California Code of Civil Procedure 1285.4 Pull these together before you touch any forms.

The main form is the Petition to Confirm, Correct, or Vacate Contractual Arbitration Award, Form ADR-106.2California Courts. Petition to Confirm, Correct, or Vacate Contractual Arbitration Award You list yourself as petitioner, name every other arbitration party as respondent, check the box asking the court to confirm, and attach the agreement and award as exhibits.

Prepare a proposed judgment for the judge to sign as well. It restates the award’s terms and spells out the relief you are owed. Many clerks also want a Civil Case Cover Sheet (Form CM-010). Local rules vary, so check your county court’s website before you file.

Where to File and What It Costs

File in the superior court for the county where the arbitration hearing was held.3California Legislative Information. California Code of Civil Procedure 1292.2 If the hearing was split across counties or held out of state, file where the agreement was to be performed or where it was made. If none of those apply, file in any county where a party lives or does business.4California Legislative Information. California Code of Civil Procedure 1292

The statewide filing fee for an unlimited civil case is $435 as of January 1, 2026. Riverside and San Francisco counties add a courthouse construction surcharge that pushes the total to $450.5Judicial Council of California. Statewide Civil Fee Schedule Effective January 1, 2026 You can file in person, by mail, or through the court’s e-filing system.

If the fee is a hardship, submit Form FW-001 with your petition to request a waiver. You qualify automatically if you receive Medi-Cal, CalFresh, SSI, or CalWORKs, and you can also qualify by showing your income is too low to cover basic needs plus court costs.6Judicial Council of California. The Deadlines That Shape Your Timing

Four deadlines control this process, and the gap between two of them creates the single most important timing decision you’ll make.

Here is where strategy enters. If 100 days pass from the date the award was served and the losing side has not filed a petition to vacate or correct, they lose the right to challenge the award on those grounds. Waiting until day 101 to file your confirmation petition turns the hearing into a near-formality. If you file earlier, the other side can still raise vacate or correct arguments as a response to your petition, so most petitioners who are not pressed for time let the clock run.

Serving the Other Party

Once filed, you must serve the petition, the notice of hearing, and all supporting papers on every respondent. How you serve depends on the arbitration agreement and whether the respondent has already appeared.

If the arbitration agreement specifies a service method, follow it. If the agreement is silent and the respondent has not previously appeared or been served, serve the petition the way you’d serve a summons: typically personal delivery by a registered process server or any adult who is not a party.10California Legislative Information. California Code CCP 1290.4 If the respondent is outside California, you can serve by registered or certified mail, but the court cannot hear the petition until at least 30 days after that mailing.

If the respondent has already appeared or was previously served under those rules, later service can go by regular mail. Whichever method you use, the person who makes service completes a Proof of Service and files it with the court.

What the Other Side Can Argue

California courts give arbitration awards a strong presumption in favor of confirmation. A judge cannot second-guess the arbitrator’s reasoning or overturn an award just because it looks wrong. To defeat confirmation, the respondent has to fit the award into a narrow statutory category.

Grounds to Vacate

A court must throw out the award if it finds any of the following:11California Legislative Information. California Code of Civil Procedure 1286.2

  • The award was obtained through corruption, fraud, or other improper means.
  • One or more arbitrators were corrupt, or a neutral arbitrator’s misconduct substantially harmed a party’s rights.
  • The arbitrators exceeded the scope of what the parties submitted, and the error cannot be corrected without changing the outcome.
  • The arbitrators refused to postpone the hearing despite good cause, refused to hear material evidence, or otherwise conducted the proceeding in a way that substantially prejudiced a party.
  • An arbitrator failed to disclose a known ground for disqualification or refused to step aside after a timely demand.

Grounds to Correct

If the problem is minor, the court can correct the award and confirm the corrected version rather than toss it. Correction fits obvious math errors, mistaken descriptions of a person or property, formatting defects, and situations where the arbitrators exceeded their powers but the fix doesn’t change the merits.12California Legislative Information. California Code of Civil Procedure CCP 1286.6

Successful challenges are uncommon. Courts apply these grounds strictly, and if your 100-day window has run without a challenge filed, the confirmation hearing is usually brief. Some courts don’t require anyone to appear at all.

The Hearing and Entry of Judgment

After the petition is filed and served, the court schedules a hearing. The judge’s review is procedural, not a replay of the arbitration. The court confirms that a valid arbitration agreement existed, the award was properly issued, and all parties were correctly served. With no opposition and clean paperwork, some courts handle confirmation on the papers.

If the judge grants the petition, the court signs and enters a judgment mirroring the arbitration award. That entry converts the private award into an enforceable court order with the same force as a verdict after trial.

Enforcing the Judgment and Collecting Interest

Once judgment is entered, you have the full civil enforcement toolkit. You can get a Writ of Execution (Form EJ-130) from the clerk, which directs the sheriff to levy bank accounts, garnish wages, or seize personal property.13California Courts Self Help Guide. Writ of Execution EJ-130 You can also record an Abstract of Judgment to place a lien on the debtor’s real property.

Interest starts accruing from the date the judgment is entered. The standard rate is 10 percent per year on the unpaid balance.14California Legislative Information. California Code of Civil Procedure 685.010 A lower 5 percent rate applies to two categories of judgments entered on or after January 1, 2023: medical expense judgments under $200,000 and personal debt judgments under $50,000. On a $100,000 commercial award, the standard rate adds $10,000 a year in interest, which gives the losing side a strong reason to pay quickly rather than sit on the debt.

One Note on Taxes

Confirming the award doesn’t change how it’s taxed. The IRS treats arbitration awards and court judgments the same way, and whether the money is taxable depends on what the payment was meant to replace, not on the court process that enforced it.15Internal Revenue Service. Tax Implications of Settlements and Judgments If your award mixes damage types, ask the arbitrator to itemize before the award is final, since a lump-sum figure can be treated as fully taxable.
