The fine for not changing your Florida driver’s license address is $30, a flat statutory penalty for missing the 30-day deadline after you move.1The Florida Legislature. Florida Statutes 322.19 – Change of Address, Name, or Citizenship Status2Florida Senate. Florida Code Title XXIII Chapter 318 Section 318-18 – Amount of Penalties Mandatory court costs and county surcharges get added on top, so the amount you actually hand to the clerk runs higher than $30, though the exact total depends on where you live. That ticket is the small problem. The bigger one is what happens when citations, court summons, and other legal notices keep going to an address you no longer check.
The 30-Day Deadline
Florida gives you 30 calendar days from the move itself to get a replacement license showing your new address.1The Florida Legislature. Florida Statutes 322.19 – Change of Address, Name, or Citizenship Status The clock starts when you change your residence, not when you finish unpacking. The violation is classified as a nonmoving traffic infraction, so no points land on your driving record and nothing goes on a criminal record.
One narrow exception: if you hold a valid student ID from a Florida educational institution, the law presumes you have not changed your legal residence, so the update requirement does not apply while you are enrolled.1The Florida Legislature. Florida Statutes 322.19 – Change of Address, Name, or Citizenship Status
Your vehicle registration carries the same 30-day deadline. Florida requires written notice to the Department of Highway Safety and Motor Vehicles of any registration address change within 30 days, including your plate number and vehicle identification number.3The Florida Legislature. Florida Statutes 320.02 – Registration Required; Application for Registration People remember the license and forget the registration. The DHSMV expects both.4Florida Department of Highway Safety and Motor Vehicles. Name and Address Changes
A change-of-address filed with the U.S. Postal Service does not satisfy the requirement. Mail forwarding keeps letters arriving for a while, but it updates nothing in the state’s records. The DHSMV and law enforcement rely on your license and registration, not USPS forwarding, to reach you.
How to Update Your Address
Florida offers two ways to change your license address: online through the MyDMV Portal, or in person at a tax collector’s office or DHSMV location.4Florida Department of Highway Safety and Motor Vehicles. Name and Address Changes Mail is not an option. Online updates require your Florida driver’s license number and the last four digits of your Social Security number.
A replacement license with your new address costs $25.5Florida Senate. Florida Statutes 322.21 – License Fees You will need two documents showing your Florida residential address. A utility bill dated within the last 60 days, a lease or mortgage statement, or a recent bank or credit card statement all qualify.6Florida Department of Highway Safety and Motor Vehicles. What to Bring – U.S. Citizen If your current license is REAL ID-compliant (the gold star in the upper right corner), you may need to bring additional identity documents like a birth certificate or passport when updating in person.7Florida Department of Highway Safety and Motor Vehicles. What to Bring
The address on the card has to be a physical Florida residential address. A P.O. box does not work for the residence line, though you can list a separate mailing address with the DHSMV if your mail goes somewhere else.
How a Missed Address Update Turns Into a License Suspension
An outdated address does not suspend your license on its own. The suspension comes from what the address change is quietly blocking: delivery of a citation, a court summons, or a notice to appear.
When a traffic citation or court order goes unanswered, the clerk of court notifies the DHSMV, which issues what is commonly called a D-6 suspension.8Florida Senate. Florida Code 322-245 – Failure to Comply with Citation or Order to Appear The suspension takes effect 20 days after the order is mailed. Once it is active, you cannot legally drive until you resolve every outstanding obligation with the court, pay a $60 reinstatement fee to the DHSMV, and present proof of compliance at a driver licensing office.9Florida Department of Highway Safety and Motor Vehicles. Clearing Court Suspensions A delinquency fee of up to $25 may also be assessed by the clerk of court.10The Florida Legislature. Florida Statutes 322.245 – Failure to Comply with Citation or Order to Appear
The sequence is predictable. You move, you skip the license update, a routine ticket gets mailed to your old place, you never respond, and weeks later your license is suspended without your knowing. Most people find out at their next traffic stop.
Driving on a Suspended License You Didn’t Know About
Florida treats driving on a suspended license very differently depending on whether you knew about the suspension. If you genuinely did not know, it is handled as a moving violation in traffic court, not as a criminal charge.11Florida Senate. Florida Code Title XXIII Chapter 322 Section 322-34 – Driving While License Suspended, Revoked, Canceled, or Disqualified That is the usual scenario with an address-related suspension, because the reason you missed the notice is that it went to the wrong address.
If you knew or should have known, the penalties climb:
- A first knowing offense is a second-degree misdemeanor, carrying up to 60 days in jail and a fine up to $500.12The Florida Legislature. Florida Statutes 775.082 – Penalties; Applicability of Sentencing Structures; Mandatory Minimum Sentences for Certain Reoffenders Previously Released from Prison
- A second knowing offense remains a misdemeanor under the same framework, with the court now aware of a pattern.
- A third or subsequent conviction, or certain aggravating circumstances, becomes a third-degree felony, punishable by up to five years in prison and a fine up to $5,000, with a mandatory minimum of 10 days in jail on a third or subsequent conviction.11Florida Senate. Florida Code Title XXIII Chapter 322 Section 322-34 – Driving While License Suspended, Revoked, Canceled, or Disqualified
The law presumes you knew about the suspension if DHSMV records show the suspension order was mailed to you, even to an old address you never updated. That presumption is rebuttable, so you can argue you genuinely lacked knowledge, but the burden shifts to you. A judge may not be sympathetic to a driver who failed to keep their own address current.
What It Can Do to Your Auto Insurance
Your car insurance policy lists a garaging address where the vehicle is primarily kept. If your license, registration, and policy are not aligned after a move, the mismatch can create problems. Insurers price risk based on address, and a discrepancy can slow or complicate a claim after an accident. In worse cases, an insurer may argue an inaccurate address amounts to a material misrepresentation on your application. Keeping all three records consistent removes an easy reason for a carrier to push back.
Clearing a Suspension and Getting Back on the Road
If you discover your license has been suspended over an unanswered citation, the fix involves several steps and several fees:
- Resolve the underlying citation with the clerk of court in the county that issued it. You will owe the original fine plus any late fees or collection costs.
- Pay the delinquency fee, up to $25, charged by the clerk of court.10The Florida Legislature. Florida Statutes 322.245 – Failure to Comply with Citation or Order to Appear
- Pay the $60 reinstatement fee to the DHSMV.9Florida Department of Highway Safety and Motor Vehicles. Clearing Court Suspensions
- Update your address and pay the $25 for a replacement license.5Florida Senate. Florida Statutes 322.21 – License Fees
- Bring the court’s certification of compliance to a DHSMV or tax collector office.
If multiple citations piled up while your address was wrong, each one has to be resolved separately, and each can carry its own delinquency fee. Someone who moved and forgot about their license for six months may discover two or three outstanding citations they never knew existed. Untangling it all can run several hundred dollars, all tracing back to a $25 address update that was skipped.
