The Fioricet schedule in California is: not scheduled. Regular Fioricet — the combination of butalbital, acetaminophen, and caffeine — is not a controlled substance under California or federal law, even though butalbital by itself is a Schedule III barbiturate. It is still a prescription-only medication, and California treats it as a “dangerous drug,” so it is regulated, just not through the controlled substance system.
Why Fioricet Is Exempt
Butalbital on its own sits on federal Schedule III. The DEA has a process under 21 CFR 1308.32 for exempting specific drug formulations when the non-controlled ingredients are believed to reduce the abuse risk of the controlled one.1eCFR. 21 CFR 1308.32 – Exempted Prescription Products Fioricet’s mix of 50 mg butalbital, 300 mg acetaminophen, and 40 mg caffeine qualified, and the formulation appears on the DEA’s Table of Exempted Prescription Products.2Drug Enforcement Administration. California follows the federal approach. The state has not separately added Fioricet to any schedule under the California Uniform Controlled Substances Act, so its exempt status carries through at the state level. What California does say is that Fioricet is a “dangerous drug” under Business and Professions Code 4022, a category that covers any medication bearing the “Rx only” label.3California Legislative Information. The Versions That Are Controlled
Two related medications are controlled, and they get confused with Fioricet constantly.
Fiorinal contains almost the same ingredients but substitutes aspirin for acetaminophen. That change kept it out of the DEA exemption, and Fiorinal remains a Schedule III controlled substance.4Federal Register. Schedules of Controlled Substances – Exempted Prescription Products
Fioricet with Codeine is also Schedule III. Codeine is itself a controlled narcotic, so adding it to the formulation makes the whole product controlled regardless of the butalbital exemption. The FDA-approved label reflects that classification.5U.S. Food and Drug Administration (AccessData). Fioricet with Codeine Prescribing Information When people say “Fioricet is not controlled,” they mean plain Fioricet. If your prescription says Fiorinal or Fioricet with Codeine, the controlled substance rules apply.
What Rules Still Apply in California
Because plain Fioricet is not controlled, several requirements that attach to Schedule II through V drugs do not apply:
- No CURES reporting. California’s Controlled Substance Utilization Review and Evaluation System tracks Schedule II through V prescriptions only. Pharmacies do not report Fioricet to CURES, and prescribers are not required to check CURES before writing it.6State of California – Department of Justice – Office of the Attorney General. - No security prescription forms. The tamper-resistant forms required by Health and Safety Code 11164 for controlled substances are not required for Fioricet.7Medical Board of California. Prescription Pads
- No mandatory refill limits. Fioricet can be refilled as many times as the prescriber authorizes.
California’s electronic prescribing mandate does still apply. Since January 1, 2022, Assembly Bill 2789 requires most prescriptions sent to a California pharmacy to be transmitted electronically, controlled or not.8California Legislative Information. Penalties for Forging or Sharing a Prescription
Being outside the controlled substance schedules does not put Fioricet outside the criminal code. Forging a prescription for any drug, Fioricet included, violates Business and Professions Code 4324. The statute covers signing another person’s name, creating a fictitious prescription, or altering a real one, and it also reaches possession of drugs obtained that way. It is a wobbler, chargeable as either a misdemeanor or a felony. The misdemeanor carries up to one year in county jail; the felony version carries a longer term served in county jail under California’s realignment.10California Legislative Information. Giving your Fioricet to someone else violates Business and Professions Code 4059, which prohibits furnishing any dangerous drug except on a prescriber’s order.11California Legislative Information. California Business and Professions Code 4059 – Furnishing Dangerous Drugs Health and Safety Code 11352 — the heavier statute for transporting or selling controlled substances — does not apply to Fioricet, because Fioricet is not controlled. The dangerous drug statutes are what prosecutors use.

Traveling Out of State With Fioricet
California’s position is not universal. Several states have overridden the federal exemption and placed Fioricet on their own controlled substance schedules, which means a California patient carrying a legal Fioricet prescription can walk into controlled substance territory by crossing a state line. States that regulate Fioricet more strictly include Georgia, Illinois, Maryland, New Mexico, Rhode Island, Utah, and West Virginia. State drug schedules change, so verify before you travel.
Keep Fioricet in its original pharmacy-labeled container and carry a copy of your prescription or a written statement from your prescriber. U.S. Customs and Border Protection recommends the same practice for prescription medications generally.13U.S. Customs and Border Protection. Traveling with Medication to the United States If you travel often to a state that treats Fioricet as controlled, ask your doctor whether your prescription and documentation meet that state’s rules.
Risks the Exempt Status Can Hide
Fioricet’s uncontrolled status can read as “low risk.” Two hazards are worth knowing.
Acetaminophen liver damage comes first. The FDA has linked acetaminophen to acute liver failure, in some cases requiring transplant or causing death, usually at daily intakes above 4,000 mg or when multiple acetaminophen products are stacked.5U.S. Food and Drug Administration (AccessData). Fioricet with Codeine Prescribing Information Each Fioricet tablet carries 300 mg of acetaminophen, so a patient at the maximum prescribed dose who also takes Tylenol or an acetaminophen-containing cold remedy can cross that line without noticing.
Butalbital dependency is the slower risk. Barbiturates can produce physical dependence with regular use, and abrupt discontinuation after extended use can trigger withdrawal. Frequent use can also drive medication-overuse headaches, where the drug treating the headache starts generating it. Because Fioricet is not tracked through CURES, a patient filling prescriptions across multiple providers is harder for any single prescriber to notice.
