California firefighter benefits center on a CalPERS safety pension with early retirement ages, full salary for up to a year of recovery from a job-related injury under Labor Code Section 4850, workers’ compensation presumptions that treat cancer, heart disease, PTSD, and other conditions as job-caused unless the employer proves otherwise, and continued health coverage and survivor payments that reach beyond the career itself. The exact package depends on who employs you — a city, a county, a district, or Cal Fire — but the statutory protections below apply across the state.
Your Pension
Most California firefighters belong to CalPERS and are classified as Safety Members, a status reserved for hazardous public work. Your monthly retirement allowance is a benefit factor (a percentage tied to the age you retire) multiplied by your years of service, multiplied by your final compensation. Los Angeles and San Francisco run their own independent retirement systems with comparable safety-member structures.
If You Were Hired Before January 1, 2013
Classic members retire under whichever formula their employer contracted for. Common safety formulas include 3% at 50, 3% at 55, 2.5% at 55, and 2% at 50.1CalPERS. Benefit Factor Charts A 3% at 50 formula means every year of service earns 3% of your final compensation once you reach 50, so 25 years at that age produces 75% of final pay.
If You Were Hired On or After January 1, 2013
The Public Employees’ Pension Reform Act limits new safety members to one of three formulas: 2% at 57, 2.5% at 57, or 2.7% at 57.2CalPERS. New Pension Contracts The most generous PEPRA option still falls short of the old 3% at 50.
PEPRA also caps the salary that counts toward your pension. For 2026 the pensionable compensation limit is $191,679 for members who do not pay into Social Security and $159,733 for those who do.3CalPERS. 2026 Compensation Limits for Classic and PEPRA Members Earnings above the cap are excluded from the calculation. Full Salary While Recovering From a Job Injury
This is the benefit that most sharply separates firefighters from other workers. Under Labor Code Section 4850, a full-time city, county, or district firefighter disabled by a job-related injury or illness receives full salary — not two-thirds temporary disability — for up to one year.5California Legislative Information. California Code LAB 4850 You do not burn sick leave or vacation. There is no minimum service requirement. The payments end when you return to duty, hit the one-year ceiling, or move onto a disability pension, whichever comes first.
Section 4850 does not cover department employees whose principal duties are clerical or mechanical. San Francisco firefighters are also excluded by the statute, though the city provides an equivalent benefit of its own.
Illnesses the Law Presumes Came From the Job
In a normal workers’ compensation claim the worker has to prove the job caused the condition. For firefighters, the burden flips: the employer has to prove it didn’t. This matters most for diseases that build up over years of exposure.
Cancer
Labor Code Section 3212.1 presumes that any cancer, including leukemia, developing during your service arose from the job, as long as you can show exposure to a known carcinogen on duty.6California Legislative Information. California Code LAB 3212.1 The employer can only rebut the presumption by identifying the primary cancer site and showing the carcinogen you were exposed to is not reasonably linked to it. After you leave the department, the presumption extends three months for every year of service, up to 120 months. Temporary disability payments for firefighter cancer claims run up to 240 weeks, more than double the 104-week cap that applies to most injuries.7TrackBill. Heart Trouble, Pneumonia, and Hernia
Labor Code Section 3212 presumes that heart trouble, pneumonia, and hernias developing during active service are work-related, for volunteer, partly paid, and fully paid firefighters alike.8California Legislative Information. California Code Labor Code LAB 3212 After separation the presumption extends three months per year of service, up to 60 months.
Post-Traumatic Stress Disorder
Labor Code Section 3212.15 treats a PTSD diagnosis under the current DSM as presumptively job-related for active firefighting members. You need six months of service for the presumption to attach, unless the PTSD was triggered by a sudden and extraordinary on-duty event. The post-service extension runs three months per year of service, capped at 60 months.9California Legislative Information. California Code LAB 3212.15
Other Covered Conditions
The Labor Code also builds presumptions for tuberculosis, bloodborne infectious diseases such as hepatitis and HIV, and MRSA skin infections. Each has its own service requirement, but all follow the same pattern: presumed job-related, employer bears the burden to prove otherwise.

Temporary Disability After the First Year
Once the Section 4850 year expires, standard workers’ compensation temporary disability takes over at roughly two-thirds of average weekly wage, within state minimums and maximums. Most injuries cap at 104 weeks of payments within a five-year window. Cancer claims and a handful of severe conditions such as chronic lung disease can run to 240 weeks.10California Department of Industrial Relations. Industrial Disability Retirement
If a job-related condition permanently stops you from performing your duties, you can apply for Industrial Disability Retirement through CalPERS. IDR has no minimum age and no minimum service credit, so a firefighter hurt early in their career still qualifies.11CalPERS. Local Safety Disability Retirement Resource Guide The disability must be expected to last at least 12 consecutive months or to result in death.12CalPERS. A Guide to Completing Your CalPERS Disability Retirement Election Application IDR pays a lifetime monthly allowance, and because the condition is work-related, a substantial portion is typically exempt from federal and state income tax.
Health Coverage During Your Career and in Retirement
Active firefighters typically receive medical, dental, and vision coverage, often through CalPERS health plans. HMO and PPO options are usually available, with the employer paying a set contribution toward the premium and any balance coming out of your paycheck.
Retiree health coverage is one of the most valuable pieces of the package, especially if you retire before Medicare eligibility at 65. What the employer pays toward retiree premiums depends on your years of service and the memorandum of understanding your union negotiated. Some agencies pick up the full premium after 20 or 25 years; others phase it in.
Overtime
Firefighter schedules don’t line up with a 40-hour week, and federal law adjusts accordingly. Section 7(k) of the Fair Labor Standards Act lets public agencies use a work period of 7 to 28 consecutive days. Over a 28-day work period, overtime starts after 212 hours; over a 14-day period, after 106 hours.13U.S. Department of Labor. Fact Sheet 8 – Law Enforcement and Fire Protection Employees Under the Fair Labor Standards Act Many departments negotiate lower premium-pay thresholds through their MOUs.
What Your Family Gets If You Die on the Job
A line-of-duty death triggers several overlapping programs at the state and federal level.
Continued Health Coverage
Labor Code Section 4856 requires the employer to keep providing health benefits to a surviving spouse on the same terms as before the death. Coverage continues indefinitely unless the spouse elects a lump-sum survivor benefit. Minor dependents stay on the surviving spouse’s plan, or if there is no surviving spouse, remain covered until age 26.14California Legislative Information. California Code LAB 4856
CalPERS Special Death Benefit
For a job-related death, CalPERS pays the surviving spouse, registered domestic partner, or unmarried children under 22 a monthly allowance equal to half of the member’s average monthly salary over the last 12 or 36 months, regardless of age or service at death. If the death resulted from a violent act, the benefit can rise to 75% of average salary depending on the number of surviving children.15CalPERS. Benefits Payable
Workers’ Compensation Death Benefit
Separately, workers’ compensation pays a lump sum scaled to the number of dependents. For three or more total dependents and injuries on or after January 1, 2006, the maximum is $320,000.16California Legislative Information. California Code LAB 4702
Federal Public Safety Officers’ Benefits
Survivors may also qualify for a federal tax-free lump sum under the Public Safety Officers’ Benefits Act. For fiscal year 2026 the death benefit is $461,656. PSOB also funds education benefits of up to $1,574 per month for eligible dependents in higher education.17Bureau of Justice Assistance. Benefits by Year

$3,000 Health Premium Exclusion (HELPS)
Retired public safety officers can exclude up to $3,000 per year from gross income for health or long-term care insurance premiums paid by direct deduction from their pension distributions.18Office of the Law Revision Counsel. 26 USC 402 – Taxability of Beneficiary of Employees Trust If both spouses are retired public safety officers, the combined exclusion doubles to $6,000. Paying premiums outside that automatic deduction disqualifies the exclusion, so set the deduction up through your retirement system.
Social Security Fairness Act
Many California firefighters don’t pay into Social Security, which once created problems through the Windfall Elimination Provision and the Government Pension Offset. The Social Security Fairness Act, signed January 5, 2025, repealed both the WEP and the GPO for benefits payable from January 2024 forward. If you were already receiving reduced benefits, Social Security should adjust them automatically as long as it has your current address and direct deposit on file. If you never applied for spousal or survivor benefits because the GPO would have erased them, you may need to file now; the survivor application isn’t online, so call Social Security at 1-800-772-1213.19Social Security Administration.
