Fishers Fireworks Ordinance: Hours, Locations, and Fines

The Fishers fireworks ordinance allows consumer fireworks only during three short windows each year, built around Independence Day and New Year’s Eve. Every other day is off-limits, and a first violation costs $150.

Legal Dates and Hours

Fishers does not have a general evening window for fireworks. Consumer fireworks are banned every day of the year except these periods:

  • June 29 through July 3 and July 5 through July 9: 5:00 p.m. to two hours after sunset
  • July 4: 10:00 a.m. to midnight
  • December 31 at 10:00 a.m. through January 1 at 1:00 a.m.

If a date is not on that list, you cannot legally set off fireworks in the city. Memorial Day, Labor Day, random summer weekends, birthdays, and weddings are all out.1American Legal Publishing. Fishers Code of Ordinances 99.02 – Use of Consumer Fireworks Within the City

Where You Can Set Them Off

Even during an allowed window, location matters. Indiana law limits consumer fireworks use to your own property, someone else’s property where you have their permission, or a designated special discharge location.2State of Indiana. DHS Fireworks Permits and Use

Public streets, sidewalks, alleys, city parks, and other government property are off-limits for personal displays. So is a neighbor’s yard or a vacant lot without the owner’s explicit consent. If something you launch damages a neighbor’s house or car, you are responsible for the damage regardless of whether you were otherwise following the rules.

Age and Supervision

You must be at least 18 to use or possess consumer fireworks in Indiana unless a responsible adult is present and supervising at the site. The adult has to actually be there, not just somewhere in the house. Officers who find minors handling fireworks without supervision can confiscate the items, and retailers cannot sell to anyone under 18.3Indiana General Assembly. What Counts as a Legal Firework

Consumer fireworks are the products sold at seasonal retail stands: aerial shells, roman candles, fountains, sparklers, smoke devices, and firecrackers that meet federal safety standards.4U.S. Consumer Product Safety Commission (CPSC). Fireworks Business Guidance

Some devices are illegal no matter the date. M-80s, cherry bombs, and silver salutes are banned by name in the Indiana fireworks statute. Anything the federal government prohibits is also prohibited in Indiana. Professional display fireworks (Class 1.3G) require a licensed pyrotechnician and a permit and are not consumer products. Model rockets, toy pistol caps, emergency flares, and firearm ammunition are not classified as fireworks and fall outside the ordinance.3Indiana General Assembly. Fines for Violations

Fishers handles fireworks violations as civil infractions through the Ordinance Violations Bureau:

  • First offense: $150
  • Each subsequent offense: $250

Each day a violation occurs or continues counts as a separate offense. Light fireworks on two unauthorized nights in a row and you can be fined $150 for the first and $250 for the second.5American Legal Publishing. Insurance and Liability

The fine is often the smallest financial risk. The Indiana Department of Insurance has warned residents that many homeowners policies include provisions denying coverage for damage caused by illegal acts. If you set off fireworks outside a permitted window or in a prohibited location and start a fire, your insurer may refuse the claim.7State of Indiana. Department of Insurance Warns Damage from Fireworks May Not Be Covered by Insurance

Even when you are inside the rules, homeowners insurance generally covers only accidental damage, and reckless behavior can void coverage. Damage you cause to a neighbor’s property can lead to a personal liability lawsuit against you regardless of what their own policy pays.

Burn Bans Can Override the Windows

Indiana counties can impose temporary burn bans during dry conditions, and Hamilton County activates them periodically. When a burn ban is in effect, fireworks use may be further restricted or suspended entirely even during an otherwise permitted window. The Indiana Department of Homeland Security maintains a statewide burn ban map, and you should check Hamilton County’s current status before lighting anything.

Reporting a Violation

If a neighbor is setting off fireworks outside a permitted window or in a restricted location, report it to the Fishers Police Department through its online reporting system or non-emergency line rather than 911. A specific address and time helps responding officers act on the complaint.
