Flavored vapes in New Jersey cannot legally be sold at retail. The ban, signed by Governor Phil Murphy on January 21, 2020 and effective April 20, 2020, covers every characterizing flavor other than tobacco, including menthol, mint, fruit, candy, and dessert. Retailers who sell banned products face civil penalties under the New Jersey Consumer Fraud Act of up to $10,000 for a first violation and $20,000 for each additional one, and the Attorney General’s office has been actively enforcing those rules since 2024.
What the Ban Actually Covers
New Jersey’s flavor ban, enacted through P.L. 2019, Chapter 425, prohibits the sale of any vapor product with a taste or aroma other than tobacco. There are no carve-outs for menthol or mint, which sets New Jersey apart from states that exempt those categories.
Every type of device is covered: pre-filled cartridges, disposable units, and refillable e-liquids. If it delivers nicotine through vapor and tastes like anything other than tobacco, selling it in New Jersey is illegal. The only vapor products excluded are those approved by the FDA as drug-delivery devices, such as certain prescription nicotine inhalers.
Synthetic nicotine is in. Since April 2022, federal law defines “tobacco product” to include nicotine from any source, including lab-made synthetic nicotine, and New Jersey’s ban applies to those products on the same terms as tobacco-derived vapes.
One point of confusion worth clearing up: menthol remains legal in combustible cigarettes at the federal level. The FDA proposed a menthol cigarette ban in 2022, but the Trump administration withdrew that proposed rule in January 2025. New Jersey’s ban goes further than federal policy by covering menthol in vapor products regardless of what happens with combustible tobacco.
Buying Flavored Vapes as an Adult
You must be at least 21 to buy any vaping product in New Jersey, flavored or not. Under N.J. Stat. 2C:33-13.1, anyone under 21 is prohibited from purchasing or possessing electronic smoking devices.1Justia. New Jersey Revised Statutes 2C-33-13.1 Enforcement against minors typically involves fines or educational program referrals rather than criminal charges.
If you are an adult and bring flavored vapes into New Jersey for personal use from an out-of-state source, you are not committing a crime by possessing them. Bringing them in to resell or distribute commercially is a different matter and triggers Consumer Fraud Act enforcement against the seller.
Online ordering is harder than it looks. The U.S. Postal Service is barred from delivering vaping products to consumers under the PACT Act, with only a narrow exception for licensed-business-to-licensed-business shipments that requires PS Form 4615-E and strict shipping methods.2Postal Explorer. 473 Mailability Exceptions UPS and FedEx have imposed their own similar bans on consumer vape shipments.3Bureau of Alcohol, Tobacco, Firearms and Explosives. What a Retailer Faces for Selling Flavored Products
The primary enforcement tool is the New Jersey Consumer Fraud Act (N.J.S.A. 56:8-2 et seq.). Selling or offering to sell a vapor product with any characterizing flavor other than tobacco is treated as an unlawful practice under the CFA, with civil penalties up to $10,000 for a first violation and $20,000 for each subsequent one.5New Jersey Division of Consumer Affairs. New Jersey Consumer Fraud Act No criminal conviction is required. The Attorney General can also seek injunctive relief to force a non-compliant business to close, and the CFA allows the state to recover investigation costs and obtain restitution.

Inspectors from the Division of Consumer Affairs and the Department of Health can show up unannounced, review inventory and sales records, and seize banned products on the spot. Confiscated flavored inventory is destroyed, and the retailer receives no compensation. For a shop carrying significant flavored stock, the loss can run into thousands of dollars before any fine is calculated.
Persistent violations can also cost a retailer its state license to sell vapor products. That means no legal sales of any vapes, not just the flavored ones. Operating without a valid license brings additional penalties and potential criminal prosecution for unauthorized distribution.
How New Jersey Is Enforcing the Ban
Enforcement has grown sharply. In June 2024, the Division of Consumer Affairs launched a targeted investigation into unlawful sales of flavored vapor products. Through undercover purchases and in-store inspections, investigators identified smoke shops, convenience stores, and gift retailers across five counties selling banned products, many near schools, parks, or shore-town boardwalks.6New Jersey Division of Consumer Affairs. In early 2025, the Division sent warning letters to nearly 11,000 New Jersey businesses reminding them that selling flavored vapor products violates the Consumer Fraud Act, and spelling out the $10,000 and $20,000 penalty tiers.7New Jersey Office of Attorney General. The Federal Layer Most People Miss
Even tobacco-flavored vapes carry a federal catch that applies alongside New Jersey’s rules. Every vaping product sold in the United States must have FDA authorization through a Premarket Tobacco Product Application (PMTA). As of early 2026, the FDA has authorized only 41 e-cigarette products, all tobacco-flavored.8U.S. Food and Drug Administration. E-Cigarettes, Vapes and Other ENDS Authorized by the FDA Every flavored disposable on the market lacks FDA authorization and is technically illegal to sell under federal law, regardless of what any state allows. The FDA has been issuing warning letters to online retailers selling unauthorized flavored disposables, with enforcement accelerating through 2024 and 2025.9U.S. Food and Drug Administration. Advisory and Enforcement Actions Against Industry for Unauthorized Tobacco Products For a New Jersey retailer, that means a flavored disposable violates both state and federal law at once.
Licensing and Taxes on the Products That Remain Legal
For tobacco-flavored products, which can still be sold, a retailer needs a license from the Division of Taxation under N.J. Stat. 54:40B-3.3. The fee is $50 per location, every location needs its own license, and licenses expire March 31 each year and must be renewed annually.10Justia. New Jersey Revised Statutes 54-40B-3.3 The license must be displayed, and sales records must be kept available for state review.
Excise taxes apply at two rates, effective August 1, 2025. Liquid nicotine is taxed at $0.30 per fluid milliliter. Container e-liquid (pre-filled cartridges and pods) is taxed at 30% of the listed retail price.11New Jersey Department of the Treasury. Tax Increase on Cigarette, Tobacco, and Vapor Products These are on top of standard sales tax and are the retailer’s responsibility to collect and remit.
Age verification is required for every customer who appears under 30. Acceptable ID includes a New Jersey driver’s license, an MVC or county clerk non-driver photo ID, a military ID, a passport, or a comparable photo ID from another state or the federal government. If the ID is missing or expired, the sale must be declined, and the check is required every time, even for repeat customers.
