Florida Business Tax Exemptions: Manufacturers, Nonprofits, and Credits

Florida business tax exemptions start with a structural advantage: the state has no personal income tax, so sole proprietorships, partnerships, S-corporations, and most LLCs owe nothing on business profits at the state level. C-corporations face a 5.5% corporate income tax but get the first $50,000 of net income subtracted before the tax is calculated. On top of that, Florida offers sales tax exemptions for manufacturers, farmers, nonprofits, and research operations, plus a $25,000 exemption on business personal property at the county level. What you qualify for depends on how your business is organized and what you buy; what you actually keep depends on filing the right certificate before you buy it.

Who Owes State Income Tax and Who Doesn’t

Pass-through entities don’t pay Florida income tax. Sole proprietorships, general partnerships, S-corporations, and LLCs taxed as partnerships push their profits to the owners’ personal returns, and Florida has no personal income tax waiting there to collect.

C-corporations are the exception. If your business is a C-corp or taxed as one, Florida imposes a 5.5% corporate income tax on net income earned in or attributable to the state. The first $50,000 of that net income is subtracted before the rate applies, so a C-corp with $50,000 or less in Florida net income effectively owes zero.1Florida Department of Revenue. The filing requirement is broader than the payment requirement. Every corporation doing business in Florida, earning income in the state, or existing under Florida law must file a Florida Corporate Income/Franchise Tax Return (Form F-1120) each year, even if the entity is tax-exempt or expects to owe nothing. Tax-exempt nonprofits only need to file when they report unrelated business taxable income to the IRS.2Legal Information Institute. Sales Tax Exemptions for Manufacturers

Florida’s general sales tax rate is 6%, with counties free to add a discretionary surtax. Manufacturers can strip the tax off most of their major purchases.

Raw Materials and Components

Materials that physically become part of a finished product intended for resale are exempt. Florida taxes only the final consumer sale, so a furniture maker’s lumber or a food processor’s ingredients aren’t taxed as long as they leave the plant inside the product being sold.

Industrial Machinery and Equipment

Industrial machinery and equipment used at a fixed Florida location to manufacture products for sale are fully exempt from sales tax. The business’s primary activity at that location must fall within NAICS codes 31, 32, or 33, or codes 112511 (aquaculture) or 423930 (recyclable material wholesalers).3Online Sunshine. Florida Statutes 212.08 – Sales, Rental, Use, Consumption, Distribution, and Storage Tax; Specified Exemptions

You claim this one of two ways. Give the seller a signed exemption certificate at the time of purchase, or submit Form DR-1214 to the Department of Revenue to receive a Temporary Tax Exemption Permit. The permit route is useful for new or expanding operations that want the department’s formal approval on record before writing a large check.4Florida Department of Revenue. Form DR-1214 – Application for Temporary Tax Exemption Permit

Electricity and Steam

Electricity and steam used to run manufacturing machinery are exempt, but the amount depends on how much of the facility’s power actually goes to production. If 75% or more of the electricity or steam at the location powers qualifying machinery, the exemption covers 100% of the electricity or steam charges at that site. Between 50% and 74%, you get a 50% exemption. Below 50%, nothing.3Online Sunshine. Florida Statutes 212.08 – Sales, Rental, Use, Consumption, Distribution, and Storage Tax; Specified Exemptions

Research and Development Equipment

Machinery and equipment used primarily for research and development are exempt from sales tax. “Primarily” means at least 50% of the equipment’s use is dedicated to R&D. If a machine serves both production and research, track usage carefully; the burden is on you to show R&D is the majority use.5Florida Department of Revenue. Agricultural and Aquaculture Exemptions

Farms, ranches, and aquaculture operations get some of the broadest sales tax relief Florida offers. Power farm equipment and irrigation equipment, along with replacement parts and repairs, are fully exempt when used in agricultural production.6Legal Information Institute. Florida Administrative Code R 12AER23-4 – Exemption for Power Farm Equipment

Additional categories qualify:

  • Field, garden, and flower seeds used in cultivation.
  • Fertilizers (including peat, topsoil, compost, and manure), insecticides, fungicides, pesticides, and weed killers used on crops, groves, or commercial nurseries.
  • Feed for livestock, where “livestock” is defined broadly enough to cover aquaculture products such as fish, shrimp, crabs, mollusks, alligators, and turtles.
  • Diesel, kerosene, and liquefied petroleum gas used exclusively in tractors and farm equipment on the farm.
  • Electricity used for production, packing, or processing of agricultural products on a farm or in a packinghouse.

You claim these by giving the seller a signed purchaser’s exemption certificate. Aquaculture operations can instead present a copy of their Aquaculture Certification from the Florida Department of Agriculture and Consumer Services.7Florida Department of Revenue. Nonprofit Sales Tax Exemption

Qualified charitable, religious, and educational organizations can obtain a Consumer’s Certificate of Exemption (Form DR-14) from the Florida Department of Revenue. Once issued, the certificate lets the organization buy goods and services without paying sales tax, provided the purchase supports its exempt purpose.8Florida Department of Revenue. Apply by submitting Form DR-5 to the Department of Revenue. The certificate must be renewed periodically. Purchases that fall outside the exempt purpose remain taxable, even with a valid certificate on file.

The $25,000 Tangible Personal Property Exemption

Separate from state taxes, Florida counties impose a tangible personal property tax on business assets like furniture, computers, machinery, and fixtures. It’s an annual tax based on the assessed value of those assets as of January 1.

Every business is entitled to exclude the first $25,000 of assessed value. For most small businesses, that eliminates the tax entirely. To claim it, file a Tangible Personal Property Tax Return (Form DR-405) with the county property appraiser by April 1.9Florida Department of Revenue. Tangible Personal Property – Questions and Answers

One detail trips people up. You must file at least one initial return to activate the exemption. After that, if your business property value stays at or below $25,000, the annual filing requirement is waived. If the value later climbs above the threshold, you’re required to file again.10Online Sunshine. Florida Statutes 196.183 – Exemption for Tangible Personal Property

The April 1 deadline matters. Late returns are penalized at 5% of the total tax on the property for each month or partial month the return is late, up to 25%. Failing to file at all brings a 25% penalty. Late filers also lose the $25,000 exemption for that tax year.9Florida Department of Revenue. Tangible Personal Property – Questions and Answers

Corporate Income Tax Credits

Individuals With Unique Abilities Credit

C-corporations can reduce their tax by claiming the Individuals with Unique Abilities Tax Credit for employing workers who have a qualifying disability. The credit is one dollar for each hour the qualified employee works during the tax year, up to 1,000 hours per employee. The employee must have worked for the company for at least six months to qualify. A single business can claim up to $10,000 per year, and the program is authorized for tax years beginning in 2024 through 2026.11Florida Senate. Florida Code 220.1992 – Individuals with Unique Abilities Tax Credit Program

Research and Development Credit

Florida also offers a corporate income tax credit for qualified research and development expenses under Section 220.196. The statewide cap for all businesses combined is $9 million per calendar year, so the credit is competitive and not every applicant receives the full amount requested.12Online Sunshine. Florida Statutes 220.196 – Research and Development Tax Credit The application window for expenses incurred during the 2026 calendar year opens on March 20, 2027, so you apply the year after the expenses occur.13Florida Department of Revenue. Qualified Target Industry Refunds

Businesses in industries Florida has designated as priorities for economic growth may qualify for the Qualified Target Industry (QTI) tax refund program. Rather than exempting a purchase, the program reimburses approved businesses $3,000 per new job created, or $6,000 per job in a rural community or enterprise zone. Per-job bonuses of $1,000 or $2,000 are available for wages significantly above the local average.14Florida Senate. Florida Code 288.106 – Tax Refund Program for Qualified Target Industry Businesses

Target industries are selected based on criteria like high wages, future growth potential, and economic impact. Retail businesses, electric utilities, mining operations, and hospitality companies regulated by the Division of Hotels and Restaurants are specifically excluded.

How to Actually Claim These Exemptions

Every business selling taxable goods or services in Florida must register with the Department of Revenue to obtain a Certificate of Registration. Registration is also needed if your business only buys tax-exempt goods, because the state needs your account on file before it can process exemption applications.

Match the exemption to the right document before the purchase, not after:

  • Inventory bought for resale: a valid Annual Resale Certificate, provided to the supplier at the point of sale.
  • Manufacturing equipment: a signed exemption certificate given directly to the seller, or a Temporary Tax Exemption Permit obtained through Form DR-1214.
  • Agricultural inputs: a signed purchaser’s exemption certificate, or an Aquaculture Certification for aquaculture operations.
  • Nonprofit purchases: a Consumer’s Certificate of Exemption (Form DR-14), obtained by filing Form DR-5.

Keep the paperwork organized. That means copies of every exemption certificate issued or received, invoices showing the exempt transaction, and records showing how exempt property was actually used. Florida law requires businesses subject to state taxes to retain books, records, invoices, and supporting documents for as long as the Department of Revenue can issue an assessment. Under Section 213.35, that period is tied to the statute of limitations on assessments, which generally runs three years but extends if a return is fraudulent or was never filed.15Online Sunshine. Florida Statutes 213.35 – Books and Records Five years of records is a common conservative benchmark.

Auditors don’t just check whether you had an exemption. They verify that the purchased items were used for the exempt purpose claimed. A manufacturer who buys equipment tax-free and then uses it entirely for non-manufacturing work will owe back taxes, interest, and potentially penalties. The exemption follows the actual use, not the certificate you held when you bought it.
