Florida Cannabis License Requirements: Eligibility, Fees, and Bond

To sell cannabis commercially in Florida you need a Medical Marijuana Treatment Center (MMTC) license, and the Florida cannabis license requirements are built to keep the applicant pool small: a 30-year Florida nursery registration, five consecutive years of Florida business registration, a $146,000 non-refundable application fee, a $5 million performance bond once approved, Level 2 background screening on every owner and manager, and a winning score in one of the state’s infrequent application windows.1Online Sunshine. Florida Statutes 381.986 – Medical Use of Marijuana The state issues no other type of commercial cannabis license, and the program remains medical-only after voters rejected recreational Amendment 3 in November 2024.

One License, One Business Model

Florida uses a strict vertical integration model under Section 381.986. A licensed MMTC must cultivate, process, transport, and dispense marijuana as a single entity.1Online Sunshine. Florida Statutes 381.986 – Medical Use of Marijuana There are no cultivation-only licenses, no processing permits, and no standalone dispensary licenses. If you want any role in the commercial supply chain, you must build and operate the whole chain.

One narrow exception exists. An MMTC licensed under the original 2014 Compassionate Use framework may contract with a single entity to handle cultivation, processing, transportation, and dispensing.1Online Sunshine. Florida Statutes 381.986 – Medical Use of Marijuana Everyone else owns the full operation.

The Office of Medical Marijuana Use (OMMU) within the Florida Department of Health administers the program, licenses MMTCs, certifies testing laboratories, and runs the patient registry.2Florida Department of Health. Office of Medical Marijuana Use – Home

Who Can Actually Apply

Three statutory requirements eliminate the vast majority of interested parties before the application window ever opens.

First, the applicant entity must have been registered to do business in Florida for at least five consecutive years. Certified documentation from the Florida Department of State or Department of Revenue has to prove the registration history.3Florida Department of Health. Application for Medical Marijuana Treatment Center Registration Standing up a new company to apply is not an option.

Second, the applicant must hold a valid certificate of registration from the Florida Department of Agriculture and Consumer Services for the cultivation of more than 400,000 plants, and must have operated as a registered nursery in the state for at least 30 continuous years.1Online Sunshine. Florida Statutes 381.986 – Medical Use of Marijuana This single rule explains why so many Florida MMTC licenses sit with legacy agricultural nurseries. New entrants typically acquire or partner with one.

Third, the applicant must show through audited financial statements the capacity to build and sustain a vertically integrated operation covering cultivation, processing, transportation, and retail.

Level 2 Background Screening for Every Principal

Every owner, officer, board member, and manager connected to the application must pass Level 2 background screening under Florida Statute 435.04, which involves fingerprinting and a nationwide FBI criminal history review.4Online Sunshine. Florida Statutes 435.04 – Level 2 Screening Standards

The disqualifying offenses include murder, manslaughter, kidnapping, sexual battery, human trafficking, felony assault and battery, arson, robbery, felony drug offenses, fraud, and abuse or neglect of children or elderly adults. Attempt, solicitation, or conspiracy counts the same as the offense itself.4Online Sunshine. Florida Statutes 435.04 – Level 2 Screening Standards Out-of-state convictions count if the offense is substantially similar to a Florida disqualifying offense, measured by elements rather than the other state’s label.

A person fails screening with an open case awaiting disposition, a guilty verdict, a guilty or no-contest plea, or a juvenile adjudication of delinquency for any listed offense. Sealed or expunged adult records can still disqualify. One failing individual anywhere in the ownership or management chart can sink the entire application.

Application Fee and Performance Bond

A non-refundable application fee of $146,000 must accompany every submission.5Cornell Law Institute. Florida Administrative Code 64ER22-9 – Application for MMTC Licensure You pay it whether you win a license or not.

If approved, the applicant must post a $5 million performance bond from a surety company rated in one of the top three categories by a nationally recognized rating service. Once the MMTC is serving at least 1,000 qualified patients, the bond requirement drops to $2 million.1Online Sunshine. Florida Statutes 381.986 – Medical Use of Marijuana The statute also allows an irrevocable letter of credit or a cash deposit with the Department of Health in place of a surety bond. The bond guarantees compliance; if the MMTC fails to meet statutory requirements, the state can claim it.

Those figures are only the entry ticket. Facility buildout for cultivation and processing, dispensary construction, and professional services push total pre-revenue investment well into the millions.

When You Can Apply and How Licenses Are Awarded

Applications are not accepted on a rolling basis. The OMMU opens batching cycles through rulemaking, with each cycle specifying the application window dates and the number of licenses available that round.5Cornell Law Institute. Florida Administrative Code 64ER22-9 – Application for MMTC Licensure Windows are infrequent and are formally noticed in the Florida Administrative Register. Missing an announcement can mean waiting years.

Florida caps licensure. The statute directed an initial issuance of 10 licenses plus one reserved for a recognized class member of the Pigford v. Glickman federal discrimination settlement. Beyond that, the department must issue four additional MMTC licenses each time the patient registry grows by another 100,000 active qualified patients.1Online Sunshine. Florida Statutes 381.986 – Medical Use of Marijuana With more than 800,000 enrolled patients as of the 2024 election cycle, multiple expansion rounds have triggered. Supply still trails demand.

After the window closes, reviewers score each application on operational plans, financial strength, management experience, and the other criteria in the application form. Only the highest-scoring applications receive approval, and the state issues a formal notice of intent to grant or deny. Applicants who disagree with scoring or process can challenge through an administrative proceeding before an administrative law judge. These challenges are common and can delay final license issuance by months. Serious applicants budget for the possibility from the start.

What Goes in the Application Package

The OMMU publishes its application form and detailed instructions, and the document runs through every operational dimension of the proposed business.6Florida Department of Health. Medical Marijuana Treatment Center License Application Instructions, Requirements, and Forms Core components include:

  • Audited financial statements prepared under Generally Accepted Accounting Principles, with inventory valuation under ASC 330 and proper cost capitalization for cultivation activities that will survive auditor scrutiny.
  • Operational plans describing cultivation, processing, security, and dispensing with enough specificity to show real expertise, including safety protocols, growing methods, and extraction processes.
  • A diversity plan promoting involvement of minority-owned and veteran-owned businesses in ownership, management, and employment. At renewal, the MMTC must document the plan’s effectiveness through workforce representation data, recruitment efforts, and contracts with minority and veteran business enterprises.1Online Sunshine. Florida Statutes 381.986 – Medical Use of Marijuana
  • Property documentation showing ownership or lease of every proposed facility, with technical blueprints meeting local building codes and fire safety regulations.
  • Complete background screening submissions for every individual and entity subject to Level 2 review, with all identifying information required for verification.

Preparing a competitive package typically takes months of coordinated work by attorneys, accountants, agricultural consultants, and security professionals. Treating the documentation as a checklist rather than a scored competition rarely produces a winning application.

What You’re Committing to After Approval

Every MMTC must participate in a state-controlled seed-to-sale tracking system that gives the Department of Health real-time, 24-hour inventory access. The system traces marijuana from planting through harvest, processing, transportation, and final sale, and at minimum must notify the state when plants are planted, harvested, or destroyed and when product is transported, sold, stolen, diverted, or lost. An MMTC may use the state system directly or integrate a proprietary system with it. The state’s tracking vendor is prohibited from any financial interest in an MMTC or testing laboratory.1Online Sunshine. Florida Statutes 381.986 – Medical Use of Marijuana

The Department of Health can impose fines of up to $10,000 per violation, including for filing a report or record the business knows to be false.1Online Sunshine. Florida Statutes 381.986 – Medical Use of Marijuana Serious or repeated violations can trigger suspension or revocation. The department conducts inspections and can take emergency action against conditions it finds to be an immediate threat to public health or safety.

Banking is a practical requirement no applicant should underestimate. Under the Bank Secrecy Act, financial institutions must file Suspicious Activity Reports with FinCEN when serving marijuana-related businesses, and must perform heavy customer due diligence including license verification, review of the license application, requests to state authorities, and ongoing monitoring for red flags.7FinCEN. BSA Expectations Regarding Marijuana-Related Businesses Many banks refuse cannabis clients altogether; those that accept them charge substantially higher fees. Line up a banking relationship early. Running a multi-million-dollar operation on cash creates security and accounting problems that compound quickly.

The Federal Tax Picture After 2026 Rescheduling

Federal taxation used to be the harshest part of holding a cannabis license. Section 280E of the Internal Revenue Code bars any deduction or credit for a trade or business trafficking in Schedule I or II controlled substances.8Office of the Law Revision Counsel. 26 USC 280E – Expenditures in Connection With the Illegal Sale of Drugs With marijuana on Schedule I, MMTCs could not deduct rent, payroll, or utilities, and some operators reported effective tax rates above 70%.

On April 28, 2026, the DEA issued a final order rescheduling marijuana subject to a state medical marijuana license from Schedule I to Schedule III.9Federal Register. Schedules of Controlled Substances – Rescheduling of FDA-Approved Products and State-Licensed Medical Marijuana Because 280E applies only to Schedule I and II substances, Florida MMTCs are now exempt and can deduct ordinary business expenses.

Rescheduling also opened a DEA registration pathway for state-licensed medical marijuana entities. MMTCs may register with the DEA as manufacturers, distributors, or dispensers using their state credentials as evidence of state authorization.9Federal Register. Schedules of Controlled Substances – Rescheduling of FDA-Approved Products and State-Licensed Medical Marijuana Annual DEA registration fees are $3,699 for manufacturers, $1,850 for distributors, and $888 covering three years for dispensers. Whether operators can amend prior returns to reclaim deductions disallowed in earlier years remains an open question awaiting Treasury Department guidance.
