Florida Digital Products: SaaS, Streaming, and Use Tax Rules

Florida sales tax on digital products generally does not apply when the product is delivered entirely over the internet. The state’s 6% sales tax reaches “tangible personal property,” and a file you download does not meet that definition.1Florida Senate. Florida Statutes 212.02 – Definitions Two things change that answer: a physical object in the transaction, and streaming subscriptions, which are taxed under a separate law at a higher rate.

Why Electronic Delivery Is Not Taxed

Florida’s statute defines tangible personal property as something that “may be seen, weighed, measured, or touched or is in any manner perceptible to the senses.”1Florida Senate. Florida Statutes 212.02 – Definitions An eBook, an MP3, a movie file, or a prewritten software program delivered by download or email link doesn’t satisfy that physical-presence test. The Florida Department of Revenue has stated directly that “Florida law does not currently impose sales or use tax on the sale of electronic books” and that streaming video services are “neither tangible personal property nor any of the enumerated taxable services.”2Florida Department of Revenue. The exemption turns on how the product reaches the buyer, not what the product is. Buy a software program as a download and no sales tax applies. Buy the same program on a disc at a store and you owe 6% plus any local discretionary surtax, because a physical object changed hands.3Florida Department of Revenue. Tax and Interest Rates

Software as a Service

SaaS sits even further from the taxable line. You never receive a copy of the program; you pay for access to software running on the vendor’s servers. Florida treats that as a service rather than a sale of property, so subscription fees for cloud-based tools like project management platforms, accounting software, and design applications are not subject to Florida sales tax. The same reasoning covers other cloud-hosted services where no file is transferred to the buyer.

When a Digital Purchase Becomes Taxable

Two situations pull an otherwise exempt digital product into the tax base.

The first is physical delivery. A USB drive, a DVD, a printed manual, or any other tangible medium shipped alongside the digital content turns the sale into a transfer of tangible personal property, and the full purchase price is taxed at 6% plus local surtax.

The second is bundling. If a seller charges one combined price for a taxable physical item and an otherwise exempt digital product, the entire sale is taxable. A common example is a printed textbook sold with a companion digital download for a single price. Separately, the digital file would be tax-free, but combined into one charge with the book, the full amount is taxed.4Florida Department of Revenue. FAQ – Sales Tax on Bundled Transactions Sellers can avoid that result by itemizing the physical and digital components separately on the invoice. When the digital portion is broken out with its own price, only the physical item triggers sales tax.

Streaming Services Are Taxed Separately

Here the rule flips. Even though digital downloads are generally tax-free, streaming subscriptions face a separate levy called the Communications Services Tax (CST), governed by Chapter 202 of the Florida Statutes.5Official Internet Site of the Florida Legislature. Florida Statutes 202 – Communications Services Tax Simplification Law The CST applies to “video services,” defined broadly as the transmission of video, audio, or other programming to a purchaser, regardless of who owns the delivery infrastructure.6Florida Senate. Florida Statutes Chapter 202 – Communications Services Tax Simplification Law Platforms like Netflix, Hulu, and Spotify fall within that definition.

The combined state-level CST rate is 7.44%. Each city and county adds its own local CST rate on top, and the total burden regularly exceeds 10% in parts of the state. Direct-to-home satellite service is taxed at a combined state rate of 11.44%, with no local add-on.7Florida Department of Revenue. Florida Communications Services Tax

That is why a Netflix bill carries a tax line while a one-time iTunes movie download does not. A download is a nontaxable transfer of an intangible product. A subscription giving continuous access to programming is a taxable communication service. Same content, different tax treatment based on how it reaches you.

Rules for Out-of-State Sellers

If you sell into Florida from another state, the economic nexus law decides whether you have to register. Since July 1, 2021, any business with more than $100,000 in taxable remote sales into Florida during the previous calendar year must register, collect sales tax, and remit it electronically.8Florida Department of Revenue. Tax Information Publication TIP 21A01-03 Florida uses a sales-only threshold; there is no separate transaction-count trigger.

Two details shape how that number is calculated. Only taxable sales of tangible personal property delivered into the state count. Exempt sales and sales made through a registered marketplace facilitator are excluded. Because purely digital downloads are not taxable sales of tangible personal property in Florida, they generally do not push a remote seller over the threshold. A seller whose Florida business is entirely digital downloads may have no collection obligation at all; a seller who also ships physical goods needs to watch the running total of those taxable sales.

Marketplace Sales

Florida requires marketplace facilitators to collect and remit sales tax for third-party sellers using their platforms, and the same $100,000 threshold applies to the facilitator’s aggregate Florida sales.8Florida Department of Revenue. Tax Information Publication TIP 21A01-03 When you sell through a qualifying marketplace, the platform handles tax on those transactions. Your own registration obligation turns on sales made outside those platforms, such as direct sales through your website.

Use Tax on the Consumer Side

Florida imposes a use tax at the same 6% rate on taxable goods brought into or delivered into the state when sales tax was not collected at purchase.9Florida Department of Revenue. Florida Sales and Use Tax Because most purely digital downloads are not taxable to begin with, use tax rarely comes up for digital purchases. The case where it does: buying software on a disc, or any other physical digital-media product, from an out-of-state retailer that didn’t charge Florida tax. That purchase technically triggers use tax owed by the buyer.
