Florida’s discretionary sales surtax is a county-level tax added on top of the state’s 6% sales tax, with combined county rates running from 0.5% to 2% depending on where the buyer takes delivery. Not every county charges it, and the counties that do set their own rate based on which specific surtaxes local voters have approved. The tax is authorized under Chapter 212 of the Florida Statutes, and the money stays in the county that collects it to pay for things like transportation, infrastructure, schools, and healthcare.1Florida Legislature. Florida Statutes Chapter 212 – Section 212.054 Discretionary Sales Surtax
How Much Is the Surtax in Your County
Most counties that levy a surtax fall between 0.5% and 1.5%. Hamilton County currently sits at 2%. Citrus and Collier currently impose no surtax at all.2Florida Department of Revenue. Discretionary Sales Surtax Rate Table The Florida Department of Revenue publishes a rate table you can check before a transaction, and any rate change takes effect on January 1 and ends on December 31 of the year the tax expires.3Florida Department of Revenue. Why the spread? Florida law lets counties layer several surtax types on each other, each with its own cap. The authorized categories include transportation, local infrastructure, school capital outlay, indigent care, public hospitals, emergency fire rescue, and pension liability.4Florida Legislature. Florida Statutes Chapter 212 – Section 212.055 Discretionary Sales Surtaxes A charter county transportation surtax alone can run up to 1%, local infrastructure can add 0.5% or 1%, and certain combinations are capped at 1% or 1.5% together.
Which County’s Rate Applies
The surtax rate follows the buyer, not the seller. If a store in a county with no surtax ships a product to a customer in a county with a 1% surtax, 1% applies to that sale. It works the other way too: a seller in a surtax county who delivers into a county with none charges no surtax. For admissions like event tickets or theme park entries, the rate is based on the county where the event takes place.3Florida Department of Revenue. Discretionary Sales Surtax Brochure GT-800019
This matters most for anyone selling across county lines or shipping statewide. Getting the delivery county wrong means collecting the wrong amount and often eating the difference.
The $5,000 Single-Item Cap
This is where the surtax works differently from the state sales tax. For tangible personal property, the surtax applies only to the first $5,000 of the sales price of any single item. The state’s 6% tax still applies to the full price. A $7,000 piece of furniture delivered to a county with a 1% surtax generates $420 in state tax (6% of $7,000) plus just $50 in surtax (1% of $5,000), for a total of $470.3Florida Department of Revenue. The cap does not apply to every taxable transaction. Surtax is charged on the full amount for:
- Admissions, including event tickets and theme park entries
- Taxable services, including service warranties and prepaid calling arrangements
- Transient rentals such as hotels and short-term vacation rentals
- Commercial real property rentals, including office space, retail space, and warehouses
- Parking and docking fees for motor vehicles, boats, and aircraft
If you rent out a hotel room or lease commercial space, surtax hits every dollar of rent with no ceiling. Property managers who assume the $5,000 cap applies universally get caught by this.
What’s Exempt
Because the surtax rides on the state sales tax, anything exempt from state tax is also exempt from the surtax. Florida does not tax most grocery food purchased for home use. Prescription drugs and medicinal drugs that federal or state law requires be dispensed by prescription are exempt, along with medical gases and certain opaque drugs used in medical treatment.1Florida Legislature. Florida Statutes Chapter 212 – Section 212.054 Discretionary Sales Surtax Florida also enacts temporary sales tax holidays for things like back-to-school supplies, disaster preparedness items, and recreational equipment, and the surtax drops off during those windows too.
What Businesses Have to Do
Any business making taxable sales in Florida must register with the Department of Revenue and get a Certificate of Registration before starting operations. Registration is free and done online.5Florida Department of Revenue. Account Registration Once registered, you collect the 6% state tax plus any applicable county surtax from the buyer and remit the full amount to the Department of Revenue, which routes the surtax portion back to the counties.6Florida Dept. of Revenue. You report everything on the Sales and Use Tax Return (Form DR-15), which has a dedicated section on the back for the surtax component. How often you file depends on your annual tax collections:7Florida Dept. of Revenue. Florida Sales and Use Tax
- More than $1,000 per year: monthly
- $501 to $1,000: quarterly
- $101 to $500: semiannual
- $100 or less: annual
If you paid $5,000 or more in sales and use tax during the state’s prior fiscal year (July 1 through June 30), you have to file and pay electronically for the entire following calendar year.7Florida Dept. of Revenue. Florida Sales and Use Tax
Dealers who file and pay electronically on time get a small collection allowance of 2.5% of the first $1,200 of tax due, capped at $30 per reporting location. File late and the allowance disappears. Florida also requires you to keep sales tax records for at least three years for audit purposes, and the Department of Revenue can audit beyond that window if you never filed or filed something substantially incorrect.8Florida Department of Revenue. Penalties
Filing late or failing to remit collected tax carries a penalty of 10% of the amount owed, with a $50 minimum even when no tax is due for the period. A floating interest rate also runs on any underpayment from the original due date until it’s paid, and the Department of Revenue publishes the current rate on its website.7Florida Dept. of Revenue. Florida Sales and Use Tax A business that consistently fails to collect or remit can have its Certificate of Registration revoked, which ends its ability to make taxable sales in Florida legally. Collecting sales tax from customers and keeping it rather than remitting is treated as theft of state funds under Florida law and can lead to criminal prosecution.
Deducting the Surtax on Your Federal Return
Because Florida has no state income tax, the surtax carries extra weight at federal tax time. If you itemize on your federal return, you can choose to deduct either state and local income taxes or state and local general sales taxes. For Florida residents, the sales tax option is usually the better one. You make the election by checking box 5a on Schedule A of Form 1040, and you can base the deduction on actual receipts or on the IRS optional sales tax tables.9Internal Revenue Service. Topic No. 503, Deductible Taxes
The county surtax you pay counts as part of your deductible general sales tax. For 2026, the state and local tax (SALT) deduction is capped at $40,400 for most filing statuses and $20,200 for married filing separately under changes made by the One, Big, Beautiful Bill.10Internal Revenue Service. IRS Releases Tax Inflation Adjustments for Tax Year 2026 If you made big purchases during the year, saving receipts that show the surtax can push your actual total above what the IRS tables alone would give you.
